Work will be confined to the existing 40-foot maintenance limits; no trees will be cut within the existing 60-foot ROW; no fencing will be affected; ditches will not be relocated, but maintained where necessary to ensure proper dreinage; existing pipe at permit site (Station 50 + 50) will be replaced in kind and in place. RESULTS, AND CONCLUSIONS: HPOW2b reVIEW2d Ofl 8 AUgUSt 2013 and yielded one NR (Jones-]ohnson-Ballentine Farms Rurai Historic District (WA0723)), and no SL, LD, or DE properties in the Area of Potential Effects (APE). The Division has adjusted the projed to avoid the nearby SS, the Paul Stephenson House (WA0562) (to the west of the project area), as well as incorporated other avoidance and minimization efforts detailed above. Wake County current GIS mapping, aerial photography, and tax information indicate an APE of some woodland, cultivated fields, and several residential and agricultural properties dating to the early, mid, and late twentieth century (8 August 2013). The county architecturel surveys (1988-91 and 2005-6) and related publication recorded no properties in the APE other than the ]ones-]ohnson-Ballentine Farms Rural Historic Distrid (WA 723), which includes the Ballentine Dairy Farm (WA 571) (Keily �ally, 71reHistoncArchi[ectureofWakelounty, North Carolina (Raleigh: Wake County Govemment, 1994, pp. 152, s�a-3�5)). Google Maps "Stf22Y VIEW�� confirmed the presence of the previously recorded resources and the hvo additionai early-twentieth-century resources in APE (8 August 2013). The APE extends 100 feet from either end of the proposed 0.511-mile project length and 100 feet to either side of the existing SR 1400 (Ballentine Dairy Road) centerline to encompass aIl proposed construction activities as currently defined. As the project is state funded, only GS 121-12(a) applies, however the Federal permit area is also subject to Section 106 review. The presence of the NR-listed historic district, as well as the unrecorded resources, indicated the need for a field investigation. An NCDOT architectural historian met with Division 5 representatives on site on 4 September 2013 and confirmed the proximity of the NR district to the project area and discussed possible design adjustments. The two previously unrecorded properties contain circa-1920 resources (#1305 and #1500 Ballentine Dairy Road), but both are unexceptional examples of their types and also located outside the permit area. Resolution of ROW issues and minimization of design impacts reached completion in November 2015, and on 1 December 2015 representatives of NCDOT, HPO, and USACE considered project effects and established the finding detailed below. A drive over survey of the project found the ROW staked along the entire route (Figure i ). The earthen dam located near the eastern terminus of the proposed project was inspected because of the possibility of a mill near the roadway (Figure 2& 3). No such evidence was found, no structure or foundation remains and there was no evidence of a millrace below the dam. The dam showed no evidence of a mill operation as well. A pedestrian survey of the agricultural fields at the western end of the project yielded no cultural evidence. The permit area for replacement of the banel crossline is present in Figure 4. The impounded pond is not present on the 1914 Soil Map of Wake County thus dating the dam construction to sometime after 1914 (Figure 5). No further work is warranted.
