Dear Mr. Smart:

Please reference our May 4, 2023, notification to you regarding noncompliance
with the Department of the Army (DA) Nationwide Permit (NWP) 29 verification (SAW-
2019-00195) issued to you associated with construction of the Ridgemoor residential
development, located in the southwest quadrant of the intersection of Ackerman Road
and Hebron Church Road, at 2190 Ackerman Road, in Garner, Wake County, North
Carolina. Based on a site visit performed on May 24, 2023, and subsequent email
correspondence dated June 14, 2023, the U.S. Army Corps of Engineers, Raleigh
Regulatory Field Office (Corps) has determined that you have satisfactorily completed
all remedial and authorized actions requested of you.

Accordingly, no further legal action will be taken in this matter, and we consider
the case closed. Please note, however, that you must continue to comply with all terms
and conditions and special conditions of the NWP 29 verification. Please note that
satisfaction of the Corps’ enforcement resolution requirements does not necessarily
satisfy requirements from the North Carolina Division of Water Resources. Further, be
cautioned that the Corps may consider any future unauthorized work of similar nature in
waters of the U.S. a willful and intentional violation of Federal law and may result in
immediate referral of the matter to the U.S. Attorney or the U.S. Environmental
Protection Agency with recommendation for civil and/or criminal prosecution.
