Ms. Willmer,
Thank you for the prompt review of the Fast Track Application for the Town of Maggie Valley
sewer extension project. I regret that the incorrect box was selected on the form – we are
aware that Jonathan Creek is a designated trout stream, and the project has been designed to
comply with the required 25-foot setback requirements.
Please let me know if you have any additional comments or need additional information.

Good morning,
A review of the application and supporting documents for the subject application has been
completed in accordance with 15A NCAC 02T .0107. Please provide the additional or revised
information for the following comments, in order for the office to complete the review:
1. The application notes under Section IX.4 state that the project is not located in a river basin
subject to State buffer rules and the second part of the question was left blank. Please note,
Trout Buffered Streams, as defined in 15A NCAC 2B.0202, have setback requirements for any
land disturbing activities regardless of size. Jonathan’s Creek (adjacent to the planned
extension) is Classified C, Trout. Please, verify the work will meet the 25-foot setback
requirements under 15 NCAC 04B.0125.
An email stating the setback requirements will be met will be adequate to proceed processing the
application. A response to the above comments is considered required in order to proceed with the
review of the application and issuance of the permit. If a complete response is not received within
30 days, the application and supporting documents will be returned to you in accordance with 15A
NCAC 02T.0107(e)(2).
