application: Existing conditions consist of a wooded property with a Duke power line bisecting and jurisdictional stream
adjacent to the southeastern property boundary. The general land use in the vicinity of the project is mixed residential,
industrial and wooded land.

The purpose of the proposed project is to provide access and utilities to the site and construct a single family residential
development.

Impact Justification and Mitigation

Avoidance and Minimization

Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S&EC completed a wetland delineation and Neuse River Butler evaluation for the entire property in order to identify
natural resources so that impacts could be avoided & minimized to the maximum extent practicable. Impact Area 1 is a
proposed road crossing to a perennial stream. Proposed impacts include 103 linear feet of permanent stream. 11 linear
feet of temporary stream, 38 linear feet of permanent -no permanent loss stream (i.e. energy dissipater) and associated
riparian buffer impacts. Headwalls and have been utilized to minimize stream and riparian buffer impacts, This impact is
necessary to access the property, Impact Area 2 is a proposed sanitary sewer crossing to a perennial stream. Proposed
impacts include 31 linear feet of temporary stream and associated riparian buffer impacts. This impact is necessary to
provide sanitary sewer to the proposed development. All temporary impacts to streams will be brought back to original
elevations and stream banks stabilized.
Furthermore. the applicant is aware of the regional conditions associated with the Nationwide Permits 29. With respect to
residential developments (NWP 29 -Regional Conditions section 4.0) the applicant does not anticipate any impacts to
streams or wetlands associated with stormwater facilities, there are no impact associated with single-family recreation
facilities, the permanent stream fill required by the road will utilize a NWP 14, the stream classification for this project is C,
NSW (i.e. not Outstanding Resource Waters, High Quality Waters. Coastal Wetlands or welland adjacent to these waters)
and riprap stabilization is not anticipated. The applicant is also aware of the regional conditions associated with the
Nationwide Permit 14, The applicant is not proposing to create any upland for this project: the proposed stream crossing
is strictly an upland to upland crossing. The stream classification for this project is C: Nutrient Sensitive Waters (NSW)
(i.e. not Outstanding Resource Waters or High Quality Waters).

the project engineer: During construction, an erosion and sediment control plan will be utilized to minimize impacts and

We have reviewed the "Draft Internal Policy. Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs"document prepared by the NC Division of Water Quality on April 10. 2004, version 2.1. The draft
states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill,
most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The
Sterling -Phase 2 project is a residential development. The property is within the City of Durham's, therefore the adjacent
properties that have potential for development will have the following regulations to protect downstream waters: 1) the
Neuse River Basin Riparian Buller Protection regulations. these regulations require limited development within the
riparian buffer areas. in addition to "diffuse flow" requirements and could require Best Management Practices that control
nitrogen if diffuse flow cannot be achieved, 2) the Phase 11 NPDES Stormwater Permit Program, this program includes
permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction slormwater
management requirements. We anticipate that the DWR will advise us if any additional information is needed.
4.

The information that was received by the Raleigh Regional Office on January 21, 2001 has been reviewed.
The map and other information was provided to allow a determination to be made as to whether or not the
site would require compliance with the Neusc Buffer Rulc. This project is referenced by the Raleigh
Regional Office as NBRRO 01-021.
The features represented on the Wake County Soil Survey and the USGS S.E Durham Quadrangle
(topographic) naps were evaluated to determine their subjectivity to the Neuse Buffer Rule. Eight features
depicted on the naps were reviewed. On January 24, 2001 1 completed a site visit and determined that
features A.B,C.D,F and H arc ephemeral futures and therefore arc Dot subject to protection under the Neusc
Riva Basin Nutnent Sensitive Watcrs Management Strategy. Protection and Maintenance of Existing
Riparian Areas, Administrative Code 'I 15A:02B.0233 (NCAC 0233) Feature G, below point NBR-10, and
feature G, below point NBR-12. are sabfeet to the Neuse Buffer Rule
This letter only addresses the applicability of the Neuse Buffer Rules on this specific site. Thank you for
