Sergei, Thank you for the opportunity to review and provide comments on the Cape Fear draft permit. I have the following comments/requests: 1. All ash basin are in the dewatering phase. Please replace references of decanting to dewatering. 2. Outfall 007 —The discharge flow will be from stormwater and episodic emergency flow from Internal Outfall 005. Please remove "commingled ash basin wastewater that discharges to Outfall 008" from the description of wastewater for this outfall. The commingled wastewater discharge to Outfall 007 was removed with the removal of Outfall 001. 3. Condition A(1) Internal Outfall 005 — Reference in b. should be Condition A(2). 4. Condition A. (2) — Outfall 007 — Removal of the Selenium limits based upon modification of the NC Water quality criteria for selenium and the Fish Tissue Sampling Results submitted with permit application. The contributing flows to Outfall 007 would be emergency episodic discharges from 1985 Ash Basin. The discharge from 1985 Ash Basin contributes to and is measured as commingled ash basin wastewater discharged to Outfall 008. 5. For clarification, Outfall 007 has a Chronic Toxicity sampling requirement which is waived by Internal Outfall 005 condition b. Since the discharge consists of stormwater and wastewater from Internal Outfall 005 the Chronic Toxicity would not be required to be sampled during the emergency discharge. 6. Condition A. (3) Outfall 008 Dewatering - a. Removal of nonstandard permit language concerning notification of any exceedance of 85% of allowable level of certain constituents. b. Change of monitoring frequency of Chronic Toxicity from monthly to quarterly based upon compliance during permit term and to align with other re -issued Duke Energy Permits. 7. Condition A (4) — Outfall 008 Dewatering/Groundwater Remediation a. Removal of the Selenium limits based upon modification of the NC Water quality criteria for selenium, the Fish Tissue Sampling Results submitted with permit application and RP predictions from concentrations at Outfall 008 dewatering and Groundwater Remediation. 8. Condition A (8) — Removal of "and 1.7% for Outfall 008" Fact Sheet: 1. Outfall 007 —The discharge flow will be from stormwater and episodic emergency flow from Internal Outfall 005. Please remove "commingled ash basin wastewater that discharges to Outfall 008" from the description of wastewater for this outfall. Please let me know if you have questions/comments.
