The form only lists the name of the LLC (Stars & Stripes) and it's manager, Darpac Investments, LLC, but does not provide an actual name of the person who signed. The notary's handwriting is not clear, either. I'm taking a few days of vacation and I have a presentation on Tuesday. The rest of the time will be spent in getting my express reviews completed before I head out for vacation. i While I may not be available to meet next week, Georgette may be. She did the physical inspection of the project and is more familiar with the situation out there than I am. I did speak with Doug last week and we agreed that the first order of business is to get the permits transferred to the correct owners. The State's other concern is to make sure that the permitted deed restriction statements are recorded prior to the sale of any more lots. It is my understanding that a few lots are already sold, but may not have a recorded deed restriction in place (Doug is checking on that). If those lots were sold without a deed restriction limiting the BUA per lot as specified in the permit, then Doug and I discussed allowing those lots to use the County's maximum BUA limit (a percentage of the lot size I believe) as the permitted maximum BUA for those lots, when the permitted BMP is redesigned prior to any further lot sales. The alternative is (after DRAPAC becomes the permittee of record) to get the signature of every current lot owner on the deed restrictions to acknowledge that their maximum BUA limit is as currently permitted and then to record the document prior to selling any more lots, or to propose a modification that changes the permitted maximum BUA limits on those lots that are already sold. The property was purchased by our group out of bankruptcy on 9/19/14 and we added a raw land tract the following year. Prior to my arrival at this company Doug Talbot of Land Development Specialist reviewed the site during Drapac's Due Diligence period. I have reached out to Doug to assist us again. Please allow this email to be my request to allow Mr. Talbot to represent us as we transition this permit into our name. Small bit of background on our company: The Drapac Group owns assets that were once active single family developments all over the Southeastern US. The portfolio of assets have not had active construction since the start of the GFC, generally 2008-2009. Our assets are in many different stages from raw land to almost complete developments. This creates many challenges to our the land management team. When San Rio was purchased we bought two phases, one of which is platted, roads paved, some infrastructure installed, and various lots sold to private individuals. However, the subdivision utilities were not completed and no one has been able to start home 2 construction. The next phases were graded and storm ponds installed when the development ceased. The Drapac Group has taken over maintenance of infrastructure to protect our investments over the tracts that were originally constructed (Lot owners do not contribute financially at this time). I have attached a composite survey and GIS tax parcel to the email for us to discuss further. In addition,I have attached the sections in the recorded covenants and restrictions discussing the maximum built-upon area allowed for each lot in the approved and recorded sections of San Rio. These covenants are included in the deed transfer of each lot and state the maximum built-upon area allowed. As we discussed and noted on the permit transfer form,Stars 2I LLC which is owned by Drapac Group USA,purchased the property from the bank after a foreclosure action allowed transfer of ownership to the bank. Stars and Stripes(Drapac Group)have not made any modifications to the property and do not intend to modify the property until further notice. The property is presently gated and closed off to the public and is maintained by Drapac. There are no homes constructed in the areas where stormwater has been partially complete. Currently there is no active Homeowners Association so the private roads and easements will remain in the name of the owner until such time as a transfer can take place. Drapac is in agreement with consolidating the two existing permits if you feel this is necessary and additionally Drapac will cooperate fully in the separation of the permits from Drapac to Mr. Charles Parish who purchased a portion of the permitted property. It is my understanding that a few lots are already sold, but may not have a recorded deed restriction in place (Doug is checking on that). i If those lots were sold without a deed restriction limiting the BUA per lot as specified in the permit, then Doug and I discussed allowing those lots to use the County's maximum BUA limit (a percentage of the lot size 1 believe) as the permitted maximum BUA for those lots, when the permitted BMP is redesigned prior to any further lot sales. Prior to my arrival at this company Doug Talbot of Land Development Specialist reviewed the site during Drapac's Due Diligence period. I have reached out to Doug to assist us again. Please allow this email to be my request to allow Mr. Talbot to represent us as we transition this permit into our name. Small bit of background on our company: The Drapac Group owns assets that were once active single family developments all over the Southeastern US. The portfolio of assets have not had active construction since the start of the GFC, generally 2008-2009. Our assets are in many different stages from raw land to almost complete developments. This creates many challenges to our the land management team. When San Rio was purchased we bought two phases, one of which is platted, roads paved, some infrastructure installed, and various lots sold to private individuals. However, the subdivision utilities were not completed and no one has been able to start home construction. The next phases were graded and storm ponds installed when the development ceased. The Drapac Group has taken over maintenance of infrastructure to protect our investments over the tracts that were originally constructed (Lot owners do not contribute financially at this time). All previous references to DWQ will remain in older stormwater permits issued prior to August 1,2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On August 5, 2009,the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes,which was current and valid at any point between January 1,2008, and December 31, 2010.The law extended the effective period of any stormwater permit that was set to expire during this time frame to three(3)years from its current expiration date. On August 2, 2010,the Governor signed Session Law 2010-177,which granted an extra year for a total of four(4)years extension. Accordingly,the Division is herewith notifying you that permit SW8 070202 is now effective from the date of issuance until February 15, 2021 and permit SW8 070834 is now effective from the date of issuance until October 18,2021, which includes all available extensions. On April 14, 2016,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources(DEMLR)conducted an inspection of San Rio located on Gray Bridge Road,Brunswick County, as a follow-up to the inspection conducted on March 28,2014.DEMLR's file review and site inspection revealed that the site is not in compliance with the terms and conditions of either the SW8 070202 permit or the SW8 070834 permit. An email was sent March 13, 2014 from Mr. Doug Talbot with Land Development Specialists, Inc.,to Mr. Chris Baker,DEMLR Engineer. The email stated that Mr.Talbot was performing due diligence on behalf of Wells Fargo Bank,who was the property owner at the time, in preparation of a new owner(s)purchasing the property, or portions thereof,from the Bank. On March 28, 2014,Mr.Baker conducted an inspection of the site upon Mr. Talbot's request, and noted that various permit requirements had not been met,resulting in deficiencies at the site. It was also discovered during the Division's recent file review that the entire project area for this subdivision is now owned by three different owners which include: a. Any deviations from the approved plans and specification must be noted on the Certification. Schedule of Compliance Condition 11.13 of the permit states that: The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. During the April 14,2016 inspection it was observed that the portion of the system that has been built needs maintenance,including adding missing grates to the catch basins and to determine the cause of the sinking road and gutter near the catch basins.Leaking pipe joints or breaks in the pipeline are the most common cause of"sinking pavement syndrome".
