State Permit # 47-87 was originally issued on February 17,1987 for the hydraulic dredging of the NCSPA shipping berths and was modified through a variance granted by the Coastal Resource Commission (CRC) on September 6, 2000 for the use of a barge mounted agitation dredge to sweep accumulating fines from the berth area to avoid the creation of shoaled areas. The NCSPA received a Major Modification to State Permit #47-87 through a CRC -Final Order granted on January 7, 2016, and issued on January 13, 2016, to allow for the relocation of an existing bulk pier, the expansion of the turning basin dredge footprint from 1,200' to 1,400' in diameter, and dredging depth limit of 44' mean lower low water (MLLW) to accommodate Post-Panamax ships. A Major Modification to State Permit # 47-87 was issued on May 26, 2016 for a one-time emergency maintenance dredging of the western portion of the turning basin. State Permit # 47-87 was modified on June 21, 2018 authorizing the change in methodology to allow for water injection dredging to maintain water depths at the berths. State Permit# 47-87 was modified through a Major Modification issued by CRC Variance on May 6, 2019 to construct a toe wall on the eastern side of the basin and expand the turning basin dredging footprint from 1,400' to 1,524' in diameter, and dredging depth of -45 MLLW. A Minor Modification of State Permit # 47-87 was authorized on June 19, 2019 for expansion of existing finger piers and boatlift installation. Additionally, dredging during the In -Water Work Moratorium was authorized by a Minor Modification of State Permit # 47-87 on January 24, 2020. This permit has been continually renewed and modified. State Permit # 47-87 is due to expire on December 31, 2027. The action proposed in your request consists of encapsulating 930 linear feet of existing bulkhead, regrading and repaving existing asphalt, and replacing the existing storm water system at F-West and H-Yard at the Port of Wilmington. Per the provided work plans, 930 linear feet of bulkhead would be encapsulated with concrete and stop at the existing substrate (See Sheet 7 and 9 of 9 for cross section). Existing tie -rods and anchors would be repaired as needed. New tie -rods would be added in two locations. This information was requested by both DWR and DCM. The modification request also includes states 13.85 acres of existing asphalt would be regraded and repaved and the existing stormwater system would be replaced with no proposed changes to the existing outfalls. This request includes site plans labeled Sheet 1 through Sheet 9 of the proposed work. The applicant submitted a $100 check (check no.203256) on 3/26/24 for the fee amount. This office would have no objection to the modification of State Permit No. 47-87, provided it is consistent with all other local, state, and federal regulations. By copy of this memo, DCM is requesting that the USACE and NC DWR provide any comments that your agency may have on the proposed project to Cameron Luck of DCM's MHC office within 14 days of receipt of this memo. Dec 31, 2027 Dear Mr. Hall: The North Carolina State Ports Authority, Port of Wilmington requests a minor modification to the Division of Coastal Management Major Permit Number 47-87. This permit currently has an expiration date of December 31, 2027. The NCSPA is requesting the modification to allow repairs to the existing bulkhead and adjacent pavement improvements at the Port of Wilmington berthing areas. This project repairs and improves approximately 13.85 acres of built upon area including the bulkhead sheet pile wall at the Port of Wilmington. The work includes regrading and repaving an existing 13.85 acres of asphalt pavement, pavement striping, replacing existing hi -mast lights, adding fire hydrants, replacing the existing storm water system (with no change in existing outfalls). Replacing an existing concrete access ramp between the land and the wharf. The existing 930 linear feet of steel bulkhead will be cleaned, repaired, and encapsulated in concrete. Steel walers and tie -rods where none currently exist, will also be added per the enclosed drawings. All work will be performed in the dry. As a reference, the Division of Water Resources project number is 2016- 0517v2 and the USACE action id No is SAW-1986-00493. Please find enclosed the required $100.00 processing fee and the associated engineering drawing for this project.
