Subject: Additional Condition #3, 401 Certification
Dear Mr. McKinley:
On November 28, 2007, this office received your letter dated November 25th regarding
the above noted condition. Mr. Alan Johnson of this office has reviewed your letter and agrees
that allowing the sprouts from the stumps (of the trees that were previously cut) to continue to
grow so that the buffer can function as intended by the Catawba Riparian Buffer Rule. There is
no need to plant any new trees.
Be advised that failure to allow the trees to grow will be in violation of the 401 Water
Quality Certification issued on October 24th and could result in civil penalties of up to $25,000
per day, as well as criminal penalties for violation of state environmental laws and regulations.
