1. Your application indicates that 40 linear feet of the unnamed tributary were impacted by
the installation of the culvert for a road crossing. The site plan indicates the culvert
length is 40 feet. Please note that the stream impact length should encompass the full
linear footage of impact, including meanders, and therefore is generally more than the
culvert pipe length. Please confirm the stream impact length and provide a revised
length if necessary. See attached Site Plan map that depicts the exact footage of
impact to account for meanders, etc. as well as boulders to be added to address
aquatic life passage. Also see updated PCN impact sheet to address for this 56 feet
of impact.
2. As NC WRC has noted, it appears the 36" HDPE culvert is not buried in accordance
with culvert burial requirements (20% for culverts less than or equal to 48 inches).
When bedrock is present in culvert locations, culvert burial is not required, provided
that there is sufficient documentation of the presence of bedrock. Please provide a
response in accordance with WRC's comments, including proposed reinstallation and
consideration of alternative culvert material to ensure continued and long-term aquatic
passage during low flows. See attached Pipe Detail. We propose to place boulders
downstream of the pipe to an elevation 20% of culvert diameter (7.5" minimum).
This boulder placement will back water and bedload/native-material in a way that
will impact the stream less than a total culvert replacement. This will address any
"perched" culvert considerations and retroactively allow for low flow passage of
aquatic life.
3. It also appears no outlet protection (e.g., keyed in rip -rap) is present or proposed, which
poses stability concerns, especially considering that the culvert is currently perched at
the outlet. Please provide documentation and/or revisions, as necessary, to indicate how
stream conditions near the outlet will be protected from increased erosive effects to the
extent practicable to ensure the continuation of aquatic passage during low flow
conditions. See Site Plan and Pipe detail.
4. Please provide cross sectional details of the culvert showing the provisions for aquatic
life passage. Shown in attached Pipe Detail.
5. DWR has concerns regarding the feasibility of the development of Lot 4 without
additional impacts to streams/wetlands. Lots must be developable without further
impacts to jurisdictional waters. Please provide a site plan with building envelopes to
verify the lot can be developed without further impacts to jurisdictional features. See
attached Site Plan that addresses Lot 4 concerns.
6. We note that you are listed as the applicant for this project. The applicant will become
the `Permittee' and will be responsible for compliance with all general and regional
permit conditions, 401 and water quality regulations, as well as any permit non -
compliances or unauthorized activities associated with this project. Please verify that

aquatic passage:
1) Boulders will be placed downstream of the current outlet invert to an
elevation at least 7.5" above the invert elevation. This is to cause
bedload material to back up within the 36" pipe and allow for low flow
passage of aquatic life.
materials:
1) Pipe - acceptable culvert materials include concrete, corrugated
metal, corrugated plastic, new or used high quality steel and any
other materials. For this project the project engineer recommends
corrugated plastic.
2) Bands - bands shall be either rod and lug type or hugger bands. bands
shall be of some material as pipe. For this project, no bands are
anticipated.
3) Fill material - general. as soon as practical, backfill the excavation
after placement of the permanent structure. Use backfill free from
stones large enough to interfere with compaction; large or frozen
lumps that will not break down readily under compaction; and wood
or other extraneous material. Obtain backfill material from excavation
or from other sources approved by the project engineer. In areas not
supporting a completed roadbed, retaining wall, or embankment,
place backfill in layers at most 6''-8" deep (loose measurement). In
areas supporting a portion of a roadbed, retaining wall, or
embankment, place backfill in uniform layers at most 8 in. deep (loose
measurement). Compact each layer to meet the density requirements
of the roadbed, retaining wall, embankment material, or as shown on
the plans.
4) Fabric filter cloth - shall be non -woven needle punch, see nres national
engineering manual part 642 material specification
592-geotextiles. The project engineer recommends class 1 fabric filter
cloth.
5) Surfacing stone - shall be crusher run stone or as otherwise specified.
6) Headwall boulder - shall be angular rock with a minimum diameter 2.0'
Construction:
Culvert
1) Bedding - whenever possible place pipe on the natural streambed
grade or slope. do not excavate a trench to accomodate an
oversized pipe for increased capacity. for this project, the pipe invert
will be placed 6" below the proposed streambed grade.
2) Bands - install rod and lug type or hugger bands according to
manufacturer's recommendations. Dimple bands shall not be used.
After bands have been properly installed, wrap joints with filter cloth to
prevent soil movement through the joint.
3) Headwall - install headwall boulders at a maximum 1.5:1 slope,
offsetting the rocks into the road embankment. Sill the headwall 4'
into the bank and 2' below the proposed streambed grade along the
length.
Fill Material
1) Avoid damaging culvert or coating during filling and tamping
operations.
2) Place fill in layers of 6'' to 8" thickness. evenly distribute fill along the
length of the conduit and compact before placing the next layer.
3) Extra care should be exercised in filling around the pipe. All fill placed
under the pipe and up to half the diameter of the pipe shall be hand
tamped to fill all voids under the pipe and around the corrugations.
The remaining fill shall be carefully compacted using manual methods
or mechanical rolling equipment.
4) Overfill shall be sufficient to maintain a crown over the pipe after
settlement has occurred.
Fabric FilterCloth
1) Fabric filter cloth shall be trenched in on the downstream side of the
road or trail.
2) Filter fabric shall be trenched in on the upstream side of the
emergency overflow.
3) Use mulch netting staples to hold fabric filter cloth flat during
placement of surfacing stone.
Surfacing Stone - place stone over fabric filter cloth to a depth of at least 6"
before allowing equipment to use road or trail. the final stone
depth shall be 8''. the roadbed will be 12' wide and 30' long from
the road embankment over the stream into the floodolain.
Seeding- seed and mulch all disturbed areas as soon as construction is
completed
