drawings sheets 1-14 of 14 dated 12/10/97 w/rev. and Middle Point survey dated 4/29/97.
This permit, issued on 'Z�)- — 3 — 9 a , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Subdivision - General
1) The Division of Water Quality approved this subdivision project and amenities described in the
application on December 2, 1997 under stormwater management permit No. SW8961216. Any
violation of that permit will be considered a violation of this CAMA permit.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This planmust
be filed at least thirty (30) days prior to the beginning of any land -disturbing activity.
Submit this plan to the Dept. of Environment and Natural Resources, Land Quality Section,
127 Cardinal Drive Extension, Wilmington, NC 28405-3845.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 2001
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
NOTE: Future development on individual lots will require separate, Minor CAMA Permits if any
portion of the land disturbance or development falls within the 75' from mean high water,
i.e., the Estuarine Shoreline Area of Environmental Concern.
NOTE: The pennittee and/or his contractor is urged to meet with a representative of the Division of
Coastal Management on the site prior to project initiation.
Boat Ramp Area
2) In order to protect juvenile shrimp and finfish populations, excavation of the boat ramp area will not
be permitted between April 1 and September 30 of any year without the prior approval of the
Division of Coastal Management in consultation with the Division of Marine Fisheries.
3) The riprap material must consist of clean rock or masonry materials such as, but not limited to,
granite or broken concrete.
4) No marsh grass, outside of the boatramp footprint, will be excavated.
5) All portions of the boatramp structure will be on the permittee's property and within the permittee's
riparian corridor.
6) The proposed access pier along the boatramp will be a minimum of 15' from the adjacent riparian
corridor line.
7) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
8) All excavated materials will be confined above mean high water and landward of regularly or
irregularly or flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
9) No fill material will be placed at any time in vegetated wetlands outside the footprint of the
boatramp.
NOTE: This part of the Middle Point project is authorized under General Water Quality Certification
No. 3112 issued by the Division of Water Quality on August 18, 1997.

10) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structures,
whether floating or stationary, may become a permanent part of this project without permit
modification. No non -water dependent uses of structures may be conducted on, in or over public
trust waters without permit modification. No mooring slips are hereby authorized.
11) The 10' x 10' gazebo at the end of the walkway shall be located over highground.
12) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
13) The authorized structures and associated activities must not cause an unacceptable interference with
navigation.
14) No boat slips or mooring of boats is being authorized by this permit. The structures herein
authorized are for pedestrian water access only.
15) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having the permit transferred to a third party.
16) The authorizes structures and associated activity will not cause an unacceptable interference with
navigation.
NOTE: The permittee is reminded that excavation of new channels or basins in Middle Creek,
designated as a Primary Nursery Area by the Marine Fisheries Commision, could not be
authorized under present Rules of the Coastal Resources Commission.
NOTE: Permanent reflectors should be attached to the waterward ends of the pier, gazebo and
platform in order to make them more visible during hours of darkness or inclement weather.
Archaeological Resource
17) By letter of January 6, 1998, the Division of Archives and History accepted the permittee's
report and agreed that no further archaeological investigation needs to be conducted. However,
the project site is located in an area having a high probability of containing cultural resources
such as artifacts, human remains, etc. If such materials are encountered, the permittee must
immediately stop work in that area and notify the District Engineer, Wilmington Corps of
Engineers at 910/251-4629 and the Division of Coastal Management at 910/395-3900.

Dear Mr. Parker:
Reference the application of Bill Clark Homes of Greenville, North
Carolina for a Department of the Army permit to construct a boatramp with
riprap which includes excavation of approximately 60 square feet of wetlands.
In addition, the applicant proposes constructing a 6-foot-wide by 80-foot-long
fixed pier/walkway along the boatramp, an elevated 5-foot-wide by
620-foot-long pier extending along a canal to a 10-foot by 10-foot gazebo, and
a 6-foot-wide by 100-foot-long pier with a 10-foot by 20-foot "T" extending
into Middle Creek, adjacent to the Intracoastal Waterway at the proposed
Middle Point subdivision, on Sloop Point Loop Road, near Hampstead, Pender
County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorizatio" n: 1` '
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
f 2. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party.
3. The authorized structures and associated activity will not cause an
unacceptable interference with navigation.
C� 4. No fill material will be placed at any time in vegetated wetlands
outside the footprint of the boatramp.

Dear Sir:
Reference your application for a Department of the Army permit to
construct a boatramp with riprap which includes excavation of approximately 60
square feet of wetlands, a 6-foot-wide by 80-foot-long fixed pier/walkway
along the boatramp, an elevated 5-foot-wide by 620-foot-long pier extending
along a canal to a 10-foot by 10-foot gazebo, a 6-foot-wide by 100-foot-long
pier extending into Middle Creek with a 10-foot by 20-foot "T", in the
Intracoastal Waterway at the proposed Middle Point subdivision, on Sloop Point
Loop Road, near Hampstead, Pander County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plane revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

This permit, issued on '7 — 9 X , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) This permit modification authorizes 240 feet of pier at the waterward end of the previously
authorized "canal walk; the relocation, and enlargement of the previously authorized gazebo to 16'
x 20', and constructing the canal walk as an elevated wooden structure.
2) The waterward end of the pier must be set back a minimum of 80' from the near edge of the AIWW
project alignment as determined by the U. S. Army Corps of Engineers.
3) This permit modification must be attached to the original of permit No. 14-98 issued on 2/3/98 and
both documents must be readily available on site when a Division representative inspects the project
for compliance.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.2001
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Reference the Department of the Army permit issued on February 23, 1998.
and your written request of July 16, 1998, for permit modification to
construct a 240-foot-long pier at the end of the previously authorized "canal
walk", to relocate and enlarge the previously authorized gazebo to 16 feet by
20 feet, and to construct the canal walk as an elevated structure on and
adjacent to the Atlantic Intracoastal Waterway (AIWW) at the proposed Middle
Point subdivision, on Sloop Point Loop Road, near Hampstead, Fender County,
North Carolina.
The permit is hereby modified to include the work as shown on the
enclosed plan. It is understood that all conditions of the original permit
remain applicable and that the expiration date is unchanged. Please be
advised that no portion of the proposed structures may extend closer than 80
feet from the near bottom edge of the Federally -maintained AIWW. Enclosed
please find a copy of the AIWW survey plat. Your surveyor should utilize the
information on this plat to ensure your compliance with this permit condition.
