This permit, issued on 'Z�)- — 3 — 9 a , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Subdivision - General 1) The Division of Water Quality approved this subdivision project and amenities described in the application on December 2, 1997 under stormwater management permit No. SW8961216. Any violation of that permit will be considered a violation of this CAMA permit. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This planmust be filed at least thirty (30) days prior to the beginning of any land -disturbing activity. Submit this plan to the Dept. of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405-3845. (See Attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 2001 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Middle Point Subdivision Permit #14-98 Page 2 of 3 ADDITIONAL CONDITIONS NOTE: Future development on individual lots will require separate, Minor CAMA Permits if any portion of the land disturbance or development falls within the 75' from mean high water, i.e., the Estuarine Shoreline Area of Environmental Concern. NOTE: The pennittee and/or his contractor is urged to meet with a representative of the Division of Coastal Management on the site prior to project initiation. Boat Ramp Area 2) In order to protect juvenile shrimp and finfish populations, excavation of the boat ramp area will not be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management in consultation with the Division of Marine Fisheries. 3) The riprap material must consist of clean rock or masonry materials such as, but not limited to, granite or broken concrete. 4) No marsh grass, outside of the boatramp footprint, will be excavated. 5) All portions of the boatramp structure will be on the permittee's property and within the permittee's riparian corridor. 6) The proposed access pier along the boatramp will be a minimum of 15' from the adjacent riparian corridor line. 7) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 8) All excavated materials will be confined above mean high water and landward of regularly or irregularly or flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 9) No fill material will be placed at any time in vegetated wetlands outside the footprint of the boatramp. NOTE: This part of the Middle Point project is authorized under General Water Quality Certification No. 3112 issued by the Division of Water Quality on August 18, 1997. Middle Point Subdivision ADDITIONAL CONDITIONS Piers and Walkways Permit #14-98 Page 3 of 3 10) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this project without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. No mooring slips are hereby authorized. 11) The 10' x 10' gazebo at the end of the walkway shall be located over highground. 12) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 13) The authorized structures and associated activities must not cause an unacceptable interference with navigation. 14) No boat slips or mooring of boats is being authorized by this permit. The structures herein authorized are for pedestrian water access only. 15) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having the permit transferred to a third party. 16) The authorizes structures and associated activity will not cause an unacceptable interference with navigation. NOTE: The permittee is reminded that excavation of new channels or basins in Middle Creek, designated as a Primary Nursery Area by the Marine Fisheries Commision, could not be authorized under present Rules of the Coastal Resources Commission. NOTE: Permanent reflectors should be attached to the waterward ends of the pier, gazebo and platform in order to make them more visible during hours of darkness or inclement weather. Archaeological Resource 17) By letter of January 6, 1998, the Division of Archives and History accepted the permittee's report and agreed that no further archaeological investigation needs to be conducted. However, the project site is located in an area having a high probability of containing cultural resources such as artifacts, human remains, etc. If such materials are encountered, the permittee must immediately stop work in that area and notify the District Engineer, Wilmington Corps of Engineers at 910/251-4629 and the Division of Coastal Management at 910/395-3900.
