Letter dated September 1, 2023 for the subject project.
1. Please provide the total depths pilings will be driven below the surface of the bottom substrate.
-Approximately 10'-15' embedment with the likely refusal in that range.
2. Due to the high probability that there are various public/private utility and transmission lines
located beneath the bridge and within the alignment of the proposed structure, please provide
an additional figure or update an existing one to indicate where all possible risks are located.
Please also include the resources or contact information used to determine these risks.
-The applicant contracted with ESP Associates, Inc. to research and locate utilities. Please find
attached a summary of findings and supporting documentation (ATTACHMENT A).
3. Please provide alternative analysis that considers the minimization of public trust usurpation.
-Originating the proposed pier and connection further landward would require the entire
structure to be fixed. Due to comments from NCDOT, the portion under the bridge needs to be
floating and removable. Since this area is classified as PNA, the floating portion is shown as far
landward as possible. Not to obstruct public access to waters landward of the proposed pier, the
elevated sections have been added and modified as noted in Item 4 below. Please see attached
updated figures (ATTACHMENT B).

4. The Division asks that the applicant consider increasing the navigability of the elevated bridge
sections to allow maximum vessel travel underneath the structures. Additionally, the division
requests that the applicant provide signage at these elevated bridge sections notifying the public
that they are allowed to travel beneath them.
-The elevated spans have been increased from 10' to 12' in length and from 6' to 8' in height
above MHW. Signage can be placed at all three sections. Please see attached updated figures
(ATTACHMENT B).
5. Both the fixed and floating structures cross an easement between the two properties. Please
provide a copy of the deed indicating ownership of the parcel located underneath the bridge.
Also, please provide a copy of the DOT easement, or at minimum the book and page where it has
been recorded.
-The applicant retained the Law Office of Matthew A. Nichols to evaluate the easement and parcel
located underneath the bridge. Please find attached a letter from Matthew Nichols and
supporting documentation (ATTACHMENT Q.

Summary of Subsurface Utility Findinp-s

Project: Davey Resource Group, Sennett Brothers/ Isabel Holmes Bridge
ESP Project Number: LAU1..800
Purpose of this project was to collect available utility records and identify potential utility conflicts
adjacent to the Isabel Holmes Bridge in New Hanover County, NC.
Level of Service C Utility Investigation:
ESP Associates performed a Level of Service (Los C) investigation and was able to collect
utility/facility records for: AT&T, Cape Fear Public Utility Authority (CFPUA), Lumen Technologies
(CenturyLink), Piedmont Natural Gas (Duke Energy), and Windstream Communications. These records
are attached as reference and do not show any conflict.
Duke Energy (Power Transmission) and NCDOT did not provide records of the areas adjacent to the
Isabel Holmes Bridge. ESP Associates contacted Tim Godwin (NCDOT, Division 3) for any available
NCDOT facility plans. Mr. Godwin responded on March 8, 2024 that no records were found for utilities
at the Isabel Holmes Bridge. This correspondence is attached for reference.
Level of Service B Utility Investigation:
ESP Associates performed a Level of Service (Los B) Sue investigation on February 27, 2024. This
investigation focused on utilities on the east end of the Isabel Holmes Bridge. The utilities found were to
the northeast of the bridge along US741NC1331North 3" Street. This area included power and
communication utilities servicing the bridge. A Subsurface utility Field Sketch is attached as reference.
Without performing Level of Service A (Los A) excavations, ESP cannot confirm or guarantee all
utilities have been recovered or mapped within the Subsurface Utility project Area.

I represent OTH Realty, LLC with regard to the above -referenced matter. This letter
follows my October 25, 2023 letter in response to Mr. Luck's previous correspondence dated
September 1, 2023, requesting a copy of the deed indicating ownership of the parcel located
underneath the Isabel Holmes Bridge in downtown Wilmington, New Hanover County, and a copy
of the corresponding NCDOT easement. A copy of my October 25, 2023 correspondence to Mr.
Luck, including Exhibits A-1 and A-2, is attached hereto for your reference as Exhibit 1.
This letter also follows communications with State officials following my October 25, 2023
correspondence, including NCDOT District Engineer Benjamin T. Hughes, PE (Division 3,
District 3) and Special Deputy Attorney General John F. Oates, Jr. (NCDOJ Transportation
Division), both of whom are also copied on this letter.
Based upon my review of the New Hanover County Register of Deeds online public
records, it is my understanding that NCDOT owns the Isabel Holmes Bridge and the riparian land
underneath the bridge. I have attached a copy of the deed from Eastwood Developers, LLC to
NCDOT recorded on May 3, 2000, in Deed Book 2743 at Page 1, New Hanover County Registry

(attached hereto as Exhibit 2), for what I understand to be the riparian property under the bridge
(or a significant portion of that property). I have not plotted the metes -and -bounds description on
Exhibit A to this deed, which is somewhat difficult to read due to the condition of the original
recorded document.
I have also attached a copy of the maps recorded in Map Book 11, Page 11 (which is
referenced in the aforementioned deed to NCDOT) (attached hereto as Exhibit 3) and Highway
Map Book 2, Pages 82-94 of the New Hanover County Registry (attached hereto as Exhibit 4).
The Grantor (Eastwood Developers, LLC) in the aforementioned deed to NCDOT is listed as the
owner of Parcel No. 8 as shown on NCDOT Plan Sheet No. 5. (Please see Parcel Index Sheet and
Sheet and Plan Sheet No. 5, recorded pages 84 and 86 of the attached Highway Maps).
My office has reviewed the Grantor out -conveyances for NCDOT in the New Hanover
County Register of Deeds online records since the recordation of the above -referenced deed on
May 3, 2000, and I do not see where NCDOT has conveyed the subject property.
While I am not providing an opinion on title to the Isabel Holmes Bridge or the riparian
property underneath the bridge, if it is NCDEQ-DCM's or NCDOT's position that NCDOT does
not own the Isabel Holmes Bridge and the riparian property underneath the bridge, please let me
know.
It is also my understanding that the portion of the proposed water -dependent facility within
the scope of the CAMA Major Permit Application will be located beyond the mean high-water
mark of the Northeast Cape Fear River in this vicinity, which is public trust waters/lands. If
required by NCDEQ-DCM and/or NCDOT, my client is willing to enter into a standard
encroachment agreement with NCDOT for the proposed water -dependent facility.

Dear Mr. Luck:
I represent OTH Realty, LLC with regard to the above -referenced matter. This letter is in
response to Item No. 5 in your September 1, 2023 correspondence requesting additional
information as follows:
5. Both the fixed and floating structures cross an easement between the two
properties. Please provide a copy of the deed indicating ownership of the parcel
located underneath the bridge. Also, please provide a copy of the DOT
easement, or at minimum the book and page where it has been recorded.
Based upon our review of the New Hanover County Register of Deeds Office and New
Hanover County Tax Department and GIS online records, there does not appear to be an
identifiable or defined tax parcel for the property located underneath the Isabel Holmes Bridge in
this vicinity. I have attached maps from the New Hanover County GIS illustrating the same
(Exhibits A-1 and A-2).
Furthermore, based upon our research we could find no deed recorded indicating ownership
of the subject area underneath the bridge. We could also find no recorded NCDOT easement for
the subject area. It is my understanding that the portion of the proposed water -dependent facility
within the scope of the CAMA Major Permit Application will be located entirely beyond the mean
high-water mark of the Northeast Cape Fear River, which is public trust lands.
