Enclosed you will find the necessary Plan Sheets,Stormwater Permit Forms with Low Density documents, Deeds,
Letter of Consent for the work(from the owner to himself via one business entity to another),Check for the Review
Fee, USGS Quad Map with the site location, Stormwater Narrative along with other applicable erosion &
sedimentation items for Tri-County subdivision-a 15 lot single family subdivision on the far southwestern side of
Cumberland County.
This project's construction will consist of the grading and paving for the streets,storm drainage culverts,and the
water utilities necessary to support these 15 residential lots for the new residential subdivision. Lots are to be served
via public water system and private on-site septic systems.Total disturbed area is anticipated to be 3.41 acres and all
15 lots inthis subdivision will amount to 9.60 acres total(low density compliance was determined using only the
overall project area of 9.60 acres).The remainder portion of the parent parcels are not to be developed as those soils
will not work for on-site wastewater/septic systems for theses lots.
Furthermore,an erosion/sedimentation control plan &permit package was submitted to NCDEQ's Fayetteville
Regional Office but no letter of receipt or letter of approval or has been issued yet.Also,the parent tracts have been
evaluated by a wetlands consultant, Pilot Environmental. No environmentally sensitive areas lie within this
subdivision's overall 9.60 acres, but a potential jurisdictional non-wetland water(an old farm ditch)was discovered
several hundred yards away from this site to the northeast.And please note,the developer/applicant is Franklin
Johnson of JFJ Ill Investments, LLC.,which owns some of the existing parcels,while his other business entity J F
Johnson Family Farms, LLC.owns another parent tract. He has issued a letter of consent from himself to himself to
obtain permits as required under the JFJ III Investments, LLC. business entity doing the development. Last, but not
least,while NCDEQ's Surface Water Classifications GIS Mapper may have the dividing line for the Lumber/Cape Fear
River Basins as just east of this site, I can say that after walking the site and analyzing the most recent survey topo as
well as the state's LiDAR inventory,that all of this site is directed into the Cape Fear River Basin via an old farm-ditch
system back to the far northeast,outside of this site(it alleviates a depressed wooded area behind this site which lies
lower in elevation and is to remain undeveloped).All of this was discussed with Mike Lawyer of NCDEQ's Stormwater
Division for permitting guidance on May 3rd 2024 to try to help ensure full permitting compliance, clarification of the
site, in order to better convey my findings, and hopefully give NCDEQ a smoother review process of this submission.
