Millbrook Road, Suite 225 Raleigh, North Carolina 27609 Dear Mr. Hutton: This letter is regarding your prospectus documents dated February 2024, for the proposed establishment of the Wildlands Falls Lake Neuse 01 Umbrella Mitigation Bank (UMB), and the associated Camp Creek and Monkey Wrench Mitigation Sites. The proposal consists of the establishment and operation of a private commercial umbrella mitigation bank, and two mitigation sites totaling 66.0-acres located in Durham and Orange County, North Carolina. The proposed mitigation sites would include stream restoration and enhancement, in addition to wetland restoration, enhancement, and preservation activities within the Neuse River watershed (8-digit hydrologic unit code (HUC): 03020201). The Corps determined the Prospectuses were complete and issued a public notice (P/N # SAW-2023-01616, SAW-2023-01868) on March 26, 2024. The purpose of this notice was to solicit the views of interested State and Federal agencies and other parties either interested in or affected by the proposed work. Incorporated in this email and attached are comments received in response to the public notice from the North Carolina Department of Natural and Cultural Resources State Historic Preservation Office, the Catawba Indian Nation Tribal Historic Preservation Office(s), U.S. Fish and Wildlife Service, and U.S. Army Corps of Engineers. The Corps has considered the comments received from members of the Interagency Review Team (IRT) and information that was discussed during the IRT site field review on September 12, 2023 and December 13, 2024. We have determined that the proposed umbrella mitigation bank appears to have the potential to restore aquatic resources within the 8-digit HUC 03020201 of the Neuse River Basin; however, we request that you address the enclosed agency concerns in the draft mitigation plan. -2- Please provide a response to the attached comments with your draft mitigation plan submittal. The 30-day comment deadline was April 24, 2024. 2. Emily Dunnigan, USACE: a. It would have been easier to review the soils report if the map had symbology for hydric vs. non-hydric borings. Why were no soil borings completed along Copley Branch or the hydric area north of Camp Creek? Please include a more detailed survey in the draft mitigation plan. b. The prospectus indicates pebble counts would be conducted in all monitoring years. Is wildlands planning to do this even though it’s not a requirement unless the IRT requests it? c. The prospectus indicates that the IRT will approve vegetation monitoring to stop at MY5 if criteria are met. Vegetation monitoring is to be completed through MY7/close out. If the stream is large enough, NRWD would probably be more likely a concern than Carolina madtom. Above Falls Lake, I think we only have madtom records from the Eno watershed, and based on a dra document we are working on with the Corps, we would not expect Carolina madtom to be present in North Fork Lile River. It is hard for me to tell if the stream is suitable for NRWD, but Chris can probably tell you prey quickly whether or not he recommends a suitable habitat assessment. NRWD is usually found in larger streams (for example, Crabtree Creek, Swi Creek, or that lower reach of Gideon Swamp). Like I hinted above, we are working on a document with the Corps, that will help the PMs and consultants make determinaons for listed aquac species. That is the first step. If you haven't, I would suggest hiring a consultant who is qualified and permitted to conduct mussel surveys - that way, if there is suitable habitat present, they can go ahead and survey for the species. While suitable habitat surveys can be conducted by anyone who has enough knowledge and experience to determine if the habitat is suitable for the species, actual mussel surveys should be conducted only by people who are permitted by the USFWS and state to handle listed mussel species. Those folks are also very good at identifying suitable habitat or lack thereof. If all the surveys have been done and no listed species were identified, then you can just submit the survey report to the Corps with your mitigation plan, and we'll review it and provide comments to the Corps. If a listed mussel was identified and you are proposing to impact the stream where they are present, then yes, we would expect a biological assessment to be provided, because we will probably have to issue a Biological Opinion for the project. The difference between Monkey Wrench and Great Meadow is that we have records of several species adjacent to Great Meadow, but for Monkey Wrench, noone has surveyed north of NC Highway 57 (where Atlantic Pigtoe was identified in 2019), so we don't know whether it is present on your site. For the Camp Creek site, it is outside of the area where we would assume it could be present (we have ample historic survey information to show that listed species are likely not present in 030202010401). The IRT agreed with NCDWR stream determination that the uppermost reach is a wetland area. As such,  Wildlands will remove the stream enhancement and target either nutrient offset (if allowable) or  wetland enhancement.     Wildlands Engineering, Inc.    page 2  Monkey Wrench Mitigation Site  December 13, 2023 IRT Draft Prospectus Site Walk Meeting Notes   Reach 1 begins at the headcut and continues to the existing ford crossing. The IRT agreed with the  restoration approach and emphasized a flow gage will be expected toward the upstream end. Reach 2  continues a restoration approach but adds flow from Lathan Branch.    Reach 3 is below the main crossing on Rocky Creek. The IRT accepted the proposed Enhancement I  approach and requested a crest gage to show bankfull events.    Reach 4 is also proposed for stream restoration. Wildlands noted that construction would be conducted  to minimize tree loss where possible but noted that it is difficult to do well between filling the old  channel, building a new one, and creating a haul route down the channel.  Clumps of trees will be  prioritized over individuals.  Lathan Branch   The IRT agreed with Wildlands proposal to do Priority 1 restoration. They recommended we attempt to  raise the grade on the property directly upstream. Wildlands will attempt to acquire a temporary  construction easement to do this. A flow gage will be needed on this channel.  Kitty Branch   The IRT agreed with Wildlands proposal to begin with Priority 2 restoration before transitioning to  Priority 1 below the spring beyond the right bank. A flow gage will be needed on this channel. Wildlands  should consider if adequate space is available for future repairs and maintenance to the septic line.  Wildlands will attempt to get accurate estimates of the drain field and repair area.    Confirm septic access crossing width is sufficient for future maintenance and discuss the  risks/uncertainties of having a drainfield adjacent to the site.    Spike Branch   The IRT recommended a JD as the first step. If the channel is jurisdictional, then the tie in elevation and  below is all that should be credited as Enhancement II. Installing a sill or constructed riffle above the JD  point, to assist with headcut stabilization, may be incorporated. A similar rill about 100 feet downstream  from Spike Branch should be considered in the JD and also stabilized.    If Spike Branch or any other site drainages do not end up being jurisdictional, they should still be  stabilized and potentially integrated as BMPs.    North Fork Little River   The group looked at the downstream end of North Fork Little River before moving upstream.  Restoration, with a Priority 2 tie in at the downstream end, was acceptable. The existing channel will be  mostly filled. Vernal pools, with a maximum depth of 14 inches and which dry in the summer, may be  left, but not in wetland credit areas.    Try to extend CE boundary to the wetland credit area along the North Fork Reach 4 to provide a  protective buffer zone.    Another rill similar to Spike Branch was considered upstream of the main crossing. It should be treated  as Spike Branch; that is, if jurisdictional stabilize and credit the length as Enhancement II.    The group agreed that the reach targeted for Enhancement I should be changed to restoration that  makes use of the old oxbow channel north of the straightened existing channel.    Wildlands Engineering, Inc.    page 3  Monkey Wrench Mitigation Site  December 13, 2023 IRT Draft Prospectus Site Walk Meeting Notes   The group considered the proposed preservation in the upstream‐most reach. It was decided that  Wildlands should study this section further and decide between enhancement I and/or restoration. This  will be completed and the results included in the final prospectus.    The IRT and Wildlands agreed that pre‐construction wetland gages should be installed soon. This will be  important to show hydrologic uplift, which is a primary wetland function objective of the project.   General Discussion   Erin requested more detailed vegetation inventories in wetland credit areas where no grading is  planned.   Also, plots were requested in wetland areas to show before and after conditions where cattle are  present. Alternatively, understory plantings could be done in these areas.    It was suggested that river oats be included in the riparian seed mix since they’re abundant on the site.    JD wetlands should be shown on the existing conditions and concept maps in the mitigation plan.   Priority 1 and 2 restoration should be shown on the concept map in the mitigation plan by different line  types.    Any intermittent reaches on the project should have flow gages, and cumulative and consecutive flow  data should be provided in the monitoring reports.    Any JD wetlands within woods on Rocky Branch or North Fork Little River would be enhancement.    NCWRC may recommend mussel surveys for state‐listed species.    Comments on the draft prospectus:   Add sentence explaining 60‐foot crossing widths.   Delete early termination potential.   Explain soil overburden areas.   Limit discussion of wider buffers as justification in text.    Eliminate duplicate pages in PDF.   Edit language about gages for flow only on restoration reaches.   Callout stream names on all figures.  Summary Wildlands proposes E1 on T1, beginning below the power line crossing. Berms along the stream will be  removed and the profile will be stabilized to remove the incision that increases as the channel approaches Camp Creek. The IRT requested a streamflow gage and cross section on this reach to show  that the channel remains a stream after construction.    The group also discussed T1 at the power line and upstream.  The IRT views it as a linear wetland while  DWR considers it to be an ephemeral stream. Either way, stream mitigation will not be proposed above  the point at which the stream is considered intermittent. If the power line and utility easement can be  moved upstream to Isham Chambers Road, NCDWR believes it would be feasible to get nutrient offset  credit along the channel.   Ellis Branch   The IRT agreed with Wildlands proposal to do Priority 1 restoration following the path shown in the  draft Prospectus. This is intended to follow the path of the existing stream above Bahama Road and  where it appeared to be before 1972.    Wildlands will work with DWR to determine what to do with the ditch that runs across the field south of  Ellis Branch in the mitigation plan phase.    On Site areas west of Range Road, Wildlands does not plan to seek wetland credits. Instead, they will  propose buffer and nutrient offset credits. The BPDP will be included with the mitigation plan as an  appendix.     Camp Creek   Camp Creek Reach 1 (between Bahama Rd and Range Rd) has a bank height ratio of 1.4 but little erosion  is visible because the reach is backwatered by a relic beaver dam. The beaver dam is located  immediately upstream from Range Rd. Wildlands proposed E2 at 4:1 because the plan is to set grade  with a constructed riffle based on the elevation of the relic beaver dam. Instead, the IRT prefers an E1  approach to Reach 1 that adds constructed riffles; this will lower the bank heigh ratio and create a riffle  pool sequence. Wildlands proposes to do this at a 2:1 credit ratio.    Downstream from Range Rd, the IRT agreed with stream restoration on Reach 2 of Camp Creek.  Wildlands proposes to do this at a Priority 1 elevation until Priority 2 is required at the downstream end  to tie to existing grade. The group decided this is preferable to requesting a TCE from the downstream  landowner, which would extend Priority 1 on the Site and Priority 2 on the adjacent property.    The IRT would like to see additional soil mapping by an LSS. One area that will require more attention is  the proposed wetland enhancement area in the southwest corner near Range Rd. This will help to  characterize the different soil conditions across the Site and inform which wetland approach is  appropriate.    The IRT and Wildlands agreed that pre‐construction wetland gages should be installed soon. This will be  important to show hydrologic uplift, which is a primary wetland function objective of the project.    Kudzu was observed around the margins of Range Road. This will need to be eliminated to meet the  IRT’s zero tolerance requirement for kudzu. Other invasive species, including multilfora rose and privet,  will be controlled.    The Corps will conduct Section 408 research to determine what past projects related to Camp Butner  have been done in the area.          Wildlands Engineering, Inc.    page 3  Camp Creek Mitigation Site  September 12, 2023 IRT Draft Prospectus Site Walk Meeting Notes  TLC Branch   Wildlands proposed TLC Branch for preservation in the draft Prospectus. Upon further discussion and  seeing the channel in the field, the group agreed that restoration with an alignment that takes the  branch more directly to Camp Creek would be most beneficial for re‐establishing wetlands on the Camp  Creek floodplain. It appears that TLC Branch was initially created as a toe slope ditch but it has evolved  into a jurisdictional channel. A cross section and flow gage should be included in the monitoring phase  to show that TLC Branch remains a jurisdictional stream.    Wildlands will contact Triangle Land Conservancy, owner of the parcel immediately south of TLC Branch  and the Camp Creek floodplain, to gain their acceptance of potential hydrologic trespass resulting from  this project, as well as moving (and filling) TLC Branch.    Copley Branch   Wildlands proposed restoration on all but the upper 250 feet of this stream. Priority 2 restoration will be  required at the downstream end to tie to Priority 2 Camp Creek, but the rest will be Priority 1  restoration.    The upper approximately 250 feet of Copley Branch will be E2 at a 7:1 ratio. Most of the work is related  to planting a riparian buffer but some spot channel fixes may be done.    As with the Camp Creek floodplain, more detailed soil mapping should be done to characterize the  various hydric soil areas.   General Discussion   We understand non-connected wetlands are a moving target at this point. It doesn’t seem like it’ll make a big difference on this project given that most areas will be connected. And yes, you are correct that this will be part of a new UMBI that we are calling ‘Wildlands Falls Lake Neuse 01 UMBI’. We did initially propose Camp Creek to be part of the Neuse 01 UMB that contains Hatch’s Hill, but realized the timing didn’t work for that to happen. Thanks Chris. I do have a couple comments I just wanted to note for the record: 1. With regard to T1, the tributary in the area of the powerline crossing is indistinct. We did not object to this being the start of the channel; however I do think this may be an area where channel conditions may be problematic following enhancement. As you indicated, we do want to see a flow gauge here, but this will be an area to watch and photograph to document channel conditions, especially upstream of the headcut that is about midway down the system. 2. With regard to the wetlands in the Camp Creek floodplain, we asked for soils mapping as you indicated, but an additional reason for this is that Maria and I disagreed with the wetland boundaries as shown on the preliminary map, so hopefully the soils work will be used to update these boundaries. 3. During the site meeting, we discussed use of disconnected wetlands for mitigation, which we indicated was acceptable. Since that meeting, we have had further discussion about how to handle these areas and are waiting of further guidance from HQ on this issue. It is possible that we may end up changing our guidance on how wetland areas that end up being non- jurisdictional due to the 2023 WOTUS rules may be treated for mitigation. This site has the potential to have wetland areas that are not directly abutting relatively permanent waters, and therefore we may have to make a determination later in the process once we have further guidance on this matter. This is something I brought up during the ERA meeting last week, and is still a developing issue, so more to come soon hopefully. Other than these comments and your minutes, we have received no additional comment from the IRT, so please consider this to be our IRT response to your draft prospectus. We will coordinate with our District contacts regarding any potential for unexploded ordinance issues on the site and keep you informed. Lastly, please verify that this is now part of the Wildlands Upper Neuse Umbrella Mitigation Bank and not the Wildlands Neuse 01 UMB. When you first contact Kim with this site, I believe it was proposed to be part of the Neuse 01 bank, correct? We will need to update our records and files to make sure we have this correct, so just to verify, Hatch’s Hill is part of the Neuse 01 bank, but there is another site out there near Camp Creek that you plan to propose as part of the Upper Neuse bank?
