Responses are provided below and based on discussion from our April 26, 2024, site meeting. 1. It appears that the PJD application to the U.S. Army Corps of Engineers (USACE) was submitted at the same time as the 401 application. Has the PJD review with the USACE been scheduled or completed yet? A Preliminary Jurisdictional Determination was submitted concurrently with the permit application. The project has been assigned to Lyle Phillips of the USACE. 2. No photos or description of the existing conditions on site are presented with the application materials. These need to be included to be able to demonstrate that this stream is in need of restoration. Photo pages have been included in this response. As shown on the attached photographs, the UT to House Creek is significantly degraded due to channel incision and associated eroding banks. The stream has little to no access to the floodplain within the project area. In addition, the UT to House Creek is located in a mature riparian corridor. There is a significant amount of non-native vegetation in the corridor, including Chinese privet, English ivy, Japanese honeysuckle and liriope. 3. There are no maps showing the watershed of the project. Please provide a copy of the most recent bound and published county soil survey. Please cleanly draw or delineate the site boundaries on the soil survey. Please provide the most recent version of the 1:24,000 USGS Topographic Map. Please cleanly draw or delineate the site boundaries on the topographic map. USGS Topographic mapping and Soil Survey mapping notating the watershed for the project have been included in this response. [1] TRANSYSTEMS 4. The existing and proposed channel dimensions, bank height ratios, and entrenchment ratios were not provided. How was the newly designed channel sized, and what reference reaches were used in the design? The table on Plan Sheet C-202 and Purpose and Need section on page 2 of the Permit Supporting docs do not provide enough information orjustification for how the design of the new channel will achieve the water quality and restoration goals stated. The restoration design is based loosely on the concept presented in the Vision Plan. The Vision Pion proposed a Regenerative Stormwoter Channel (RSC) for the entire length of the UT. TranSystems determined RSC was not appropriate for the entire length. Based on the existing channel slope and confined valley, a step -pool system was designed for the reach upstream of the Blue Loop. The channel slope flattens and valley widens downstream of the Blue Loop therefore, a riffle -pool system was designed for this reach. Keeping with the theme of the Vision Plan, the reach upstream of the Blue Loop was labeled as an RSC. Existing and proposed parameters are presented below. DWR considers a Regenerative Stormwater Channel (RSC) an inappropriate design for a perennial stream. Typically, RSCs will lack the full suite of functions and habitats that a more typical restoration or enhancement would restore in a perennial channel and would be considered an impact and loss of function. RSCs are only recommended in ephemeral systems or stormwater conveyances upslope of jurisdictional features. Please remove/relocate the proposed SWC in the design appropriately. [21 TRANSYSTEMS Stream restoration of House Creek and the UT to House Creek was included in the 2012 North Carolina Museum ofArt Museum Park Vision Plan (Vision Plan) prepared by others. A link to the Vision Plan is below. The Vision Plan proposed an RSC design for the entire length of the UT and House Creek. TranSystems was brought into the stream restoration project well after the plan was prepared and scoped to develop a restoration design for the UT only. TranSystems evaluation of the UT determined that an RSC was not appropriate for the UT. It was determined that a step -pool systems was appropriate upstream of the Blue Loop. Downstream of the Blue Loop crossing, a riffle -pool system was designed. To keep nomenclature consistent with the Vision Plan, the step -pool was labeled as an RSC. This label has been changed to step -pool in the revised plans. The Vision Plan can be accessed here: 200012NCMAVision Plan-DRAFT.indd (ncartmuseum.org) 6. On Page 5 of the supplemental application document it states "The restoration work starts at the beginning of the unstable section of stream and ends at a stable section. The beginning ties into a pervious stream restoration project." Is this a typo and meant to say "previous"? The upstream pervious/previous stream restoration project is not included in any of the drawings or site descriptions. Can you describe what the existing project is and how this project's design will tie in to it? "Pervious" is a typo. The project starts at previous restoration project terminus. The project will tie into this restoration work. The previous work included the stabilization of a 170 foot section of eroding channel beginning at the outlet of a culvert under the greenway. The proposed stream restoration will tie into the previous work bygrading the intersection to smoothly conform. 7. On page 5 of the supplemental application document it states that "The project will address increases in impervious surfaces and associated stormwater runoff in the individual project design through the use of stormwater management control devices (SCMs).". Is this project expected to increase the existing impervious surface? I could not find in the plans where this might happen, and what SCM's would be used beyond the in -channel stream restoration. The project does not include an increase impervious area. This is an in -channel stream restoration project only. 8. Additionally, the Staging access area in the sewer line easement still constitutes a change of use and negative impact to the stream buffer of House Creek. This is not accounted for in the impacts table in the ePCN despite being noted in the 90% design plans as an impact. Additionally, DWR would prefer this impact be avoided or minimized by utilizing the fields on the north side of the project outside of the stream buffer area. Is there a reason that this cannot happen? The maintained City of Raleigh sewerline easement is utilized as the construction access to avoid removing trees outside of the buffer. Preservation of existing trees is a high priority of the [31 TRANSYSTEMS NCMA. Stream restoration and construction access was designed to minimize tree removal inside and outside of the buffer. The attached plans show the existing trees in the staging area and construction access. The staging area was revised to avoid the sewerline easement. The City of Raleigh requested that no equipment or material be stored in the easement. The City is agreeable to using the easement for access only. The easement will be restored to pre -construction conditions and is included in the planting plan developed for the project. 9. The pedestrian bridge that is proposed across UT to House Creek at a later date may need to be permitted as a separate project (if there are permittable impacts) unless design and construction plans are reflected in the supplied project sheets. Foundations will be outside of stream banks to avoid stream impacts. The proposed bridge location is included in the revised permit drawings application for any buffer impacts. 10. The impact table has all of the stream and buffer impacts lumped together. Seeing as different approaches are being proposed on different reaches of stream, DWR prefers this to be reflected in the table as separate impacts. The buffer impact table was revised to separate impacts for different reaches and areas. 11. Please note that all erosion control matting should be 100% biodegradable on restoration projects. Erosion control matting that is made of 100% coconut fiber is specified for the project. A copy of the requirements from the project specification is below. THE CONTRACTOR SHALL PREPARE STABILIZED CONSTRUCTION ENTRANCE, HAUL ROADS AND SHALL MOBILIZE EQUIPMENT, MATERIAL, PREPARE STAGING AREA(S) AND STOCKPILE AREA(S) AS SHOWN ON THE PLANS. THE CONTRACTOR SHALL CLEAR AND GRUB AN AREA ADEQUATE TO CONSTRUCT THE STREAM CHANNEL AN GRADING OPERATIONS AFTER ALL EROSION AND SEDIMENTATION MEASURES HAVE BEEN INSTALLED AND APPROVED, IN GENERAL, THE CONTRACTOR SHALL WORK FROM UPSTREAM TO DOWNSTREAM AND IN -STREAM STRUCTURES AND CHANNEL FILL MATERIAL SHALL BE INSTALLED USING A PUMP -AROUND OR FLOW DIVERSION MEASURES AS SHOWN ON THE PLANS. THE CONTRACTOR SHALL CONTINUE CONSTRUCTION BY EXCAVATING CHANNEL FILL MATERIAL. THE CONTRACTOR MAY FILL NON -JURISDICTIONAL DITCHES WHICH DO NOT CONTAIN ANY WATER DURING THE GRADING OPERATION. ALONG STREAM REACHES EXCAVATED MATERIAL SHOULD BE STOCKPILED IN AREAS SHOWN ON THE PLANS. STREAM FLOW WILL BE DIVERTED BACK INTO THE CONSTRUCTED CHANNEL ONCE THE RESTORED CHANNEL AND ASSOCIATED RIPARIAN AREA HAS BEEN STABILIZED, AS DETERMINED BY THE ENGINEER AND IN COMPLIANCE WITH THE APPROVED PERMIT REQUIREMENTS. Apply flocculants at or before the inlets to Erosion and Sediment Control Measures. 3. Apply flocculants at the concentrations specified in the NC DWR List of Approved PAMS/Flocculants and in accordance with the manufacturer's instructions. 4. Provide ponding area for containment of treated Stormwater before discharging offsite. 5. Store flocculants in leak -proof containers that are kept under storm -resistant cover or surrounded by secondary containment structures. EQUIPMENT AND VEHICLE MAINTENANCE 1. Maintain vehicles and equipment to prevent discharge of fluids. 2. Provide drip pans under any stored equipment. 3. Identify leaks and repair as soon as feasible, or remove leaking equipment from the project. 4. Collect all spent fluids, store in separate containers and properly dispose as hazardous waste (recycle when possible). 5. Remove leaking vehicles and construction equipment from service until the problem has been corrected. 6. Bring used fuels, lubricants, coolants, hydraulic fluids and other petroleum products to a recycling or disposal center that handles these materials. LITTER, BUILDING MATERIAL AND LAND CLEARING WASTE 1. Never bury or burn waste. Place litter and debris in approved waste containers. 2. Provide a sufficient number and size of waste containers (e.g dumpster, trash receptacle) on site to contain construction and domestic wastes. 3. Locate waste containers at least 50 feet away from storm drain inlets and surface waters unless no other alternatives are reasonably available. 4. Locate waste containers on areas that do not receive substantial amounts of runoff from upland areas and does not drain directly to a storm drain, stream or wetland. 5. Cover waste containers at the end of each workday and before storm events or provide secondary containment. Repair or replace damaged waste containers. 6. Anchor all lightweight items in waste containers during times of high winds. 7. Empty waste containers as needed to prevent overflow. Clean up immediately if containers overflow. 8. Dispose waste off -site at an approved disposal facility. 9. On business days, clean up and dispose of waste in designated waste containers. PAINT AND OTHER LIQUID WASTE 1. Do not dump paint and other liquid waste into storm drains, streams or wetlands. 2. Locate paint washouts at least 50 feet away from storm drain inlets and surface waters unless no other alternatives are reasonably available. 3. Contain liquid wastes in a controlled area. 4. Containment must be labeled, sized and placed appropriately for the needs of site. 5. Prevent the discharge of soaps, solvents, detergents and other liquid wastes from construction sites. PORTABLE TOILETS 1. Install portable toilets on level ground, at least 50 feet away from storm drains, streams or wetlands unless there is no alternative reasonably available. If 50 foot offset is not attainable, provide relocation of portable toilet behind silt fence or place on a gravel pad and surround with sand bags. 2. Provide staking or anchoring of portable toilets during periods of high winds or in high foot traffic areas. 3. Monitor portable toilets for leaking and properly dispose of any leaked material. Utilize a licensed sanitary waste hauler to remove leaking portable toilets and replace with properly operating unit. EARTHEN STOCKPILE MANAGEMENT 1. Show stockpile locations on plans. Locate washouts at least 50 feet from storm drain inlets and surface waters unless it can be shown that no other alternatives are reasonably available. At a minimum, install protection of storm drain inlet(s) closest to the washout which could receive spills or overflow. 7. Locate washouts in an easily accessible area, on level ground and install a stone entrance pad in front of the washout. Additional controls may be required by the approving authority. 8. Install at least one sign directing concrete trucks to the washout within the project limits. Post signage on the washout itself to identify this location. 9. Remove leavings from the washout when at approximately 75% capacity to limit overflow events. Replace the tarp, sand bags or other temporary structural components when no longer functional. When utilizing alternative or proprietary products, follow manufacturer's instructions. 10. At the completion of the concrete work, remove remaining leavings and dispose of in an approved disposal facility. Fill pit, if applicable, and stabilize any disturbance caused by removal of washout. HERBICIDES, PESTICIDES AND RODENTICIDES 1. Store and apply herbicides, pesticides and rodenticides in accordance with label restrictions. 2. Store herbicides, pesticides and rodenticides in their original containers with the label, which lists directions for use, ingredients and first aid steps in case of accidental poisoning. 3.
