Smith Gardner, Inc. (S+G) has prepared this Exceedance Reporting and Tier Notification on
behalf of Davidson County following the April 2022 stormwater monitoring event at the
Davidson County Landfill (Landfill). The Landfill is currently permitted to discharge water
from landfill related activities under Certificate of Coverage Number NCG120038, General
Permit Number NCG120000 (Permit) issued July 1, 2022.
Currently, the facility is required to monitor discharge at six (6) Stormwater Discharge
Outfall (SDO) locations summarized in Table 1, below. As you are aware, the Request for
Representative Outfall Status was granted to the Landfill by the North Carolina Department
of Environmental Quality (NCDEQ), Division of Energy, Minerals and Land Resources
(DEMLR).
As required the Permit, notification of the date and value of each parameter exceedance and
change in tier status shall be submitted to NCDEQ-DEMLR within two weeks of receiving
sampling results. Sampling was conducted on April 18, 2022, the results of which were
received April 27, 2022. Based on the results of this sampling event, the following outfalls
measured exceedances for the following parameters (full analytical lab report is attached):
• Phase 2 Pond 2:
o TSS = 877 mg/L
• Phase 2 Pond 3:
o TSS = 177 mg/L
• Phase 2 Pond 4
o TSS = 6,270 mg/L
o COD = 129 mg/L
• Phase 2 Pond 5
o TSS = 4,650 mg/L

As a result, tiered response actions are required for Phase 2, Ponds 2, 3, 4, and 5. Following
the April 18, 2022 sampling event, the tier status of each outfall at the Davidson County
Landfill is summarized in Table 1.

Notes:
1. Sampling frequency noted is representative of future sampling requirements following the results of the
current monitoring period.
2. 0utfalls at the Davidson County Landfill are not subject to Fecal Coliform exceedances due to site wide
alternate source approval due to wildlife activity.
3. C&D Pond has measured three (31 consecutive sampling events below the benchmark limits and is no longer
be subject to monitoring activities.
All tiered response actions required for Phase 2, Ponds 2, 3, 4, and 5 will be conducted within
the required timeframe, records of which will maintained in the landfill's Stormwater
Pollution and Prevention Plan (SWPPP). A written corrective action plan for the Phase 2
Pond 3 Tier 3 response actions will be submitted under separate cover. If you have any
