Middleton Boulevard) Dear Ms. Chapman: As you know, NCDOT has been coordinating with the Town of St. James to compile the information requested by the Merger Team to further consider the Town's requested break in the special control of access limits on the subject project. The Town of St. James presented their request for a break in the special control of access limits at an agency meeting on November 20, 2013. During the meeting the agencies asked for the Town to supply additional information regarding a number of items as listed in the attached November 20, 2013 Merger Team Meeting Minutes. The Town provided its initial response with additional information on January 28, 2014. In subsequent correspondence, Merger Team members requested clarification on the St. James wetland deed restrictions and potential wetland protection on the Williamson parcel. The Town and Williamson parcel owners have committed to implementing deed restrictions to protect wetlands as shown on Attachment A dated May 21, 2014. Tlae Town has provided an example of a deed with the cutrent language used to protect wetlands within each parcel. As shown on Attachment A, the requested break in the special control of access is proposed at —L- Sta. 91+39.51 along SR 1105 (E.F. Middleton Blvd). The right of way along the proposed access road will provide a length of 460 feet of special control of access from Middleton Blvd. and will be 100 foot in width. The access road will continue for an additional 4632 feet with 60 feet wide right of way to its connection with St. James Drive. All roads and access points are designed to avoid wetland impacts. There are two small wetland areas within tl�e 60 feet wide right of way near its junction with St. James Drive but the Town's consultants have verified that these wetlands would not be impacted by the proposed road, fill slopes, or associated drainage. In accordance with the MOU and USACE permit conditions, the Surplus Right of Way Disposal and Control of Access Review Committee requests your approval for a break in the special control of access so that the committee can further consider the request. Based upon the November 20, 2013 Merger Team Meeting and coordination following the meeting, it is our understanding that the requested break in the special control of access will be subject to the following: • The break in the special control of access will be located at approximately —L- Sta. 91+39, Rt. • The proposed access road and associated fill slopes and drainage shall not impact any wetlands. • The proposed access road shall include 460' of special control of access. The 460' of special control of access will begin at the existing special control of access for SR I 105 and shall be 100' in width. Sight triangles shall also be provided at its intersection with SR 1105. • The provisions of the special control of access shall be the same as the provisions contained within the MOU. • Deed restrictions shall be placed on wetlands located on the Williamson property and St. James property as indicated in Attachment A dated May 21, 2014. If you axe in agreement with the proposed break in the special control of access and associated approval conditions, please forward this letter to the appropriate party within your agency for approval. If additional approval conditions are warranted, please indicate those below in the space provided and return the signed letter to LeiLani Paugh by August 15, 2014. If you need additional time or would like to further discuss, please let us know. Once your approval has been obtained, the request will again be reviewed by the Surplus Right of Way Disposal and Control of Access Review Committee. If the committee recommends approval, the break in the special control of access will be subject to the approval conditions above, any additional conditions provided by your agency, and any additional conditions recommended by the Surplus Right of Way Disposal and Control of Access Review Committee. November 20, 2013 Merger Team Meeting Minutes For Project R-2245-Second Bridge to Oak Island - Request from the Town of St. James for a break in the special control of access limits along SR 1105 (E.F. Middleton Boulevard) Debbie Barbour opened the meeting by providing the purpose of the meeting. Then, the attendees introduced themselves. An overall summary of the project background for the Second Bridge to Oak Island (project R-2245) was provided. The special permit conditions and the associated Memorandum of Understanding that relates to the special control of access limits along the Second Bridge to Oak Island project were also discussed. Mr. Robert Morrow, Mayor of the Town of St. James, presented the request for a break in the existing control of access and some supporting information. The Town's request is for a full movement access break along SR 1105 (E. F. Middleton Boulevard) at approximately -L- Station 85+90.00 (stationing from project R-2245 plans.) The Mayor and Mr. Ramey Kemp of Ramey Kemp and Associates provided information regarding safety concerns, predicted development, traffic studies, existing access conditions, and other access alternatives considered. A conceptual layout and location of the proposed access road along with property boundaries and wetland locations was shown at the meeting. Following the presentation by the Town, the discussion continued with the Merger Team regarding the specifics of the requested access break. Several members of the Merger Team asked for detailed information about the access break, the alignment of the access road, potential development along the proposed access road, and protective covenants on the surrounding property. It was noted during the discussion with the agencies that the special control of access limits along SR 1105 (E.F. Middleton Boulevard) and any roads accessing SR 1105 was provided to minimize indirect effects. There was a discussion regarding the proposed length of the control of access limits as it extends along the proposed Town of St. James access road. It was noted that the design and location of the access road could be improved if the control of access limits could be shortened along the proposed access road. During the discussion, the Town noted that the proposed access road will not have any jurisdictional impacts and would not require any permit actions. However, it was also noted that the NCDOT permit for project R-2245 would be affected by the requested break in the control of access limits along E. F. Middleton Road. NCDOT will need to submit a formal request for written concurrence from the MOU signatory agencies and a request for a permit modification to the USACE for the proposed break in the control of access. It was noted that one request would suffice for both purposes. NCDOT will need a written response of concurrence from the USACE and the MOU signatory agencies (NCDENR, USEPA, and FHWA) prior to the Surplus Right of Way Disposal and Control of Access Review Committee's further consideration of the requested break in control of access. If the signatory agencies or the USACE have any approval conditions, they should be noted in their response. NCDOT will make the break in the control of access subject to these conditions. In conclusion, for the request to be further considered, the Town of St. James will need to submit the following information to Leilani Paugh at Ipau�h@ncdot.�ov in order for the Merger Team to further consider the requested break in the special control of access limits. • Length and location of the proposed conceptual access road and right-of-way. • Length of control of access along the proposed access road (from the discussion, it was noted that 400 feet is a minimum acceptable length for the special control of access limits to extend along the proposed access road.) • Potential impacts of proposed road (This will need to take into consideration the proposed slopes and the associated drainage design.) • Avoidance and minimization measures to offset direct, and indirect and cumulative effects. • Habitat within proposed access road, lands slated for development along the proposed access road, and any affected wildlife corridors. • Potential development along proposed access road including any structures at the entrance. • Current delineations with preliminary Jurisdictional Determination including the area on the Williamson parcel. • Other access alternates considered in lieu of the requested break in the control of access limits and reasons why they are not feasible or desirable. • Plan view sketch showing the proposed break in the control of access limits, access road, wetlands, limits of the proposed control of access, etc. (This should be comparable to exhibits in MOU that were shown for the original access points.) • Any commitments that will be made by the property owners to alleviate direct, indirect and cumulative effects along the proposed access road. For example, in the meeting the Town noted there would be no lots platted that include wetlands within their development plans. At the conclusion of the meeting, Debbie Barbour noted to the Town that the appropriate agencies' approval would need to be obtained in accordance with the MOU and the USACE permit conditions. Following receipt of the written concurrence/approval, the request for the break in the control of access limits and associated information would be taken back to the Surplus Right of Way Disposal and Control of Access Review Committee for the review to be finalized. Paugh ICl/On-Site Mitigation Group Leader NCDOT Re: R-2245-Second Bridge to Oak Island - Request for break in controlled access Ms. Paugh, This letter and attachments are in response to the November 20, 2013 MOU meeting minutes. Those minutes asked The Town of St. James (The Town) to provide additional information re- garding ten questions. You and the team will find that information in the attachment docu- ments. Assuming these responses are satisfactory and NCDOT received the written response from USACE and MOU signatories noted in the minutes, we will be looking for a positive response from NCDOT. Once that is received by the Town, we will move forward in awarding a contract to an engineering firm. That work will provide for detail surveying and engineering of the mu- nicipal portion of the extension to St. James Drive. We will work with NCDOT on the require- ments for the configuration of the controlled access break (requesting full movement). We would expect to get NCDOT sign off on the completed road specification before moving to construction. We are anxious to move ahead as we are trying to have the road open before the 2015 hurricane season is upon us. Your help is greatly appreciated. The following information should be provided for the Team to consider the request: • Length and location of the proposed conceptual access road and right-of-way. The original requested access point was at Station 85+90. The new requested access point will be at Station 91+31.51. This change will help avoid any wetlands impact and reduces the difference in grade between SR 1615 and the requested access road. See A3 below. This change further straightens the road design as it passes through the DOT control access section. • Length of control of access along the proposed access road (from the discussion, it was noted that 400 feet is a minimum acceptable length for the special control of access limits to extend along the proposed access road.). o A2 - The length of the proposed controlled access is 460'. See Attachment B. Potential impacts of proposed road (This will need to take into consideration the proposed slopes and the associated drainage design.) o A3 — On December 12th, 2013, Paramounte Engineering conducted survey work in order to evaluate this. By moving the access point to the new proposed location the fill requirements have been reduced to 2-3'. As a result there will be no wetland impact resulting from fill slopes (see Exhibit B— Cross Section). Further engineering will need to be conducted to determine if any storm drainage is required under the controlled access but the preliminary review indicates none. The Town has not done detailed road engineering. The plan is to acquire approval for the control access break before spending additional tax payer dollars. It can be said that The Town will follow the recommendation of the engineering firm to install accepted methods of road drainage design and stormwater control. • Avoidance and minimization measures to offset direct, indirect and cumulative effects. o A4—The proposed route has been selected so no wetlands will be directly impacted. No wetland impacts from lot development on the St. James tract will occur. Stormwater and Erosion Control Plans will be prepared in order to minimize indirect and cumulative effects associated with the construction of the road and any development. Furthermore, on the St. James tract all of the wetlands along the northern boundary have existing conservation language on them as result of an individual permit issued to Reserve Development Co., LLC. in 2008. This IP concluded that that planned development would not affect any federally protected species. Any negotiations regarding indirect and cumulative effects, if required, should be handled directly with the property owners. Habitat within proposed access road, lands slated for development along the proposed access road, and any affected wildlife corridors. o A5 — On December 13th, 2013, staff of Land Management Group, Inc. evaluated the project area. The following is from there report. o There are several dirt roads that transect the area and some of the uplands has been cleared of trees. Other upland areas were found to contain a canopy of longleaf pines (Pinus palustris) and loblolly pines (P. taeda), and a sparse understory of turkey oak (Quercus laevis), water oak (W. nigra), and live oak (Q. virginiana). Most of the longleaf pines had an average DBH of between 6" and 10", but some trees were as large as 18". Trees greater than 10" DBH were evaluated for the presence of a red-cockaded woodpecker (RCW) cavity. No RCW cavities or individuals were observed during the evaluation. The wetland fingers that run through the project area are fairly dense and support loblolly pine, red bay (Persea borbonia), wax myrtle (Morella cerifera), and titi (Cyrilla racemiflora). The existing Wildlife Corridors are substantially to the north of this proposed control access break request. Copy of email report is Attachment C • Potential development along proposed road access including structures at entrance. o A6 — Determining the potential development along the proposed road access is difficult as the land is currently owned by two different development companies. That said, both developers have already received PUD approval on their respective tracts indicating their intended land use. See below. The St. James developer has already received an Erosion control permit in 2005 and a general stormwater permits in 2006 for clearing the extension of St. James drive. At this time they are working with the town to determine the final location of the proposed gatehouse within the ROW. They will be responsible for extending St. James drive to that point and build the gatehouse. The municipal road will start at the gatehouse and end at the control access point. The Williamsons have not indicated any plans for development in the near future. The only planned items at the controlled access point would be a street sign and a streetlight. • Current delineations with preliminary JD including the area on the Williamson parcel. o A7- o Williams Parcel: Action Id. SAW-2000-00757. Date issued 9-29-10. Expires 9-29-15. o St. James Plantation Parcel: SAW-2002-00768. Date issued 4-6-10. Expires 4-6-15. o The wetlands located both these JDs are shown on the attachments. • Other access alternates considered in lieu of the requested break in the control of access limits and reasons why they are not feasible or desirable. 0 A8 - Currently a single bridge provides the only ingress/egress for over 1000+ current residents (build out 2200) south of Polly Gully. This narrow 2 lane, 20+ year old causeway is over 400 feet long with a — 50 foot cored slab concrete bridge t. , Option #1: Improve the current causeway. deck in it spanning Polly Gully creek. The bridge has been over washed in the past in large weather events isolating all the residents. Prior to asking for a control access break three alternatives were looked at and rejected. In 2005 after hurricanes Ophelia and Tammy the developer employed McKim & Creed to conduct a hydraulic study to recommend both short and long term recommendations to provide alternatives for reducing the impact from large rainfall events to the plantation. This study covered the Polly Gully bridge area. The study concluded that the best way to improve this area was to divert a large portion of the drainage basin. Elevating the causeway and even the lower northern approach was not recommended as it would result in raising the upstream flood elevation which would negatively affect the existing structures on Trailwood drive. It was also apparent that any solution at this location would still leave the residents reliant on one point of egress and ingress. Option #2: Upland connection to Woodlands Park. In 2006 Reserve Development Co., LLC started working on the delineation and IP permit for the 2200 Ac tract (Action ID#200200768) with Land Management. The first draft submitted to the Corp staff for initial review identified W8 as an existing upland fill road that connected south to St. James Plantation LLC property. At that time the developer was requesting a 2.23 Acre impact of which W8 was 0.64 Acres. After initial comments the IP permit was submitted in 2007 completely eliminating this widening and requesting a 1.99 acre impact. By the time the permit was issued in 2008 the developer agreed to bridge some of the crossings but insisted on a 0.016 acre impact to now impact #29 to allow enough room for a one lane road. The final permit was issued with a 1.56 acre impact. This option was rejected by the Town as the one lane road would be too narrow to be safe as it would have to be elevated to stop it flooding. Option #3: New road to the existing control access at the foot of the bridge. We worked with the Corp to determine if we could extend St. James Drive west and then south across the Corp's leased land (from State of NC) to the existing access point at the northern end of the bridge. After a number of ineetings, the Corp best offer was to provide the Town an easement for 5 years. After five years the Town would need to remove the road and restore the land as we had found it. Obviously not a prudent way to spend tax payers' dollars. • Plan view sketch showing the proposed break in the control of access limits, access road, wetlands, limits of the proposed control of access, etc. (This should be comparable to exhibits in MOU that were shown for the original access points.) o A9- See Attachment B This shows the plan view sketch in the new location as suggested at the 11/20/2013 MOU merger meeting. • Any commitments that will be made by the property owners to alleviate direct, indirect and cumulative effects along the proposed access road. For example, in the meeting the Town noted there would be no lots platted that include wetlands within their development plans. o A10 - The purposed road has been laid out so that no direct impact on the wetlands will occur from the construction of the road. Any negotiations regarding indirect and cumulative effects, if required, should be handled directly with the property owners. That said, the Towns Unified Development Ordinance (UDO) covers the St. James Plantation tract and under 4.7.9, 7.9.5 and 12.7.7 (relevant pages in Attachment D). Wetlands protection is provided in order to insure the lot building setbacks do not include wetlands. Habitat within proposed access road, lands slated for development along the proposed access road, and any affected wildlife corridors. Habitat: On December 13th, 2013, staff of Land Management Group, Inc. evaluated the project area. There are several dirt roads that transect the area and some of the uplands has been cleared of trees. Other upland areas were found to contain a canopy of longleaf pines (Pinus palustris) and loblolly pines (P. taeda), and a sparse understory of turkey oak (Quercus laevis), water oak (W. nigra), and live oak (Q. virginiana). Most of the longleaf pines had an average DBH of between 6" and 10", but some trees were as large as 18". Trees greater than 10" DBH were evaluated for the presence of a red-cockaded woodpecker (RCW) cavity. No RCW cavities or individuals were observed during the evaluation. The wetland fingers that run through the project area are fairly dense and support loblolly pine, red bay (Persea borbonia), wax myrtle (Morella cerifera), and titi (Cyrilla racemiflora). It should be noted that the Army Corps of Engineers issued an Individual Permit in 2008 for the Reserve, which included most of this project area. This IP concluded that the planned development would not affect any federally protected species. Wildlife Corridors: Wildlife likely utilizes the project area as a corridor between undeveloped areas to the north and south. However, both areas are independently very large. The wetland area to the north is part of a larger, contiguous wetland system within St. James that is approximately 400 acres in size and the tract to the south is approximately 200 acres in size. Even if some animals choose not to cross the road, each of these undeveloped areas are large enough to support most wildlife known to occur in the area. Let me know if you have any questions. JAMES UNIFIED DEVELOPMENT ORDINANCE (PLANNING AND ZONING) 4.7.9 Approval Criteria In approving an application, the Planning Board shall consider the following: A. Compliance with all applicable requirements of this Ordinance; B. Agreement with the most recently adopted CAMA Land Use Plan/Comprehensive Plan and any applicable local area plans; C. Site design and development intensity as appropriate for and tailored to the unique natural characteristics of the site, such as significant wooded areas, specimen trees, wetlands, steep slopes and floodplains; D. For nonresidential and multifamily projects, the site plan displays the location of trash handling, recycling, grease bins and other waste-related facilities employed in the normal operation of the use; E. Adequacy and location of parking areas and pedestrian and vehicular access points; F. Adequacy of design of traffic patterns, traffic control measures and street pavement areas, with provisions for maintaining traffic flows and reducing unfavorable effects of traffic on nearby properties; G. Compliance with site construction specifications; H. Adequacy of stormwater facilities, water supply, sanitary sewer service, fire protection and hydrants, street signs, and street lighting as evidenced by conformance with Town standards, specifications and guidelines; and I. Compliance with requirements for easements or dedications. ARTICLE 7 USES BY DISTRICT — ST. JAMES UNIFIED DEVELOPMENT ORDINANCE 7.9.5 District Standards The standards in this Article, in the approved Concept Plan, in the approved Site Plan, and those in the approved Final Plat govern development within a PUD. A. Environmentally Sensitive Areas. The following must be left natural and undisturbed except for street crossings, utilities, and erosion control devices: 1. Land within a Floodplain; and 2. Wetlands, steep slopes, and other critical ecological areas. B. Density. Provisions governing the maximum residential density of the development are established by the Concept Plan. C. Minimum Lot Size. Provisions governing minimum lot size are established by the Concept Plan. D. Minimum Perimeter Setback. For portions of the development adjoining any R district, the interior setback standards of the adjoining district apply along the adjoining lot line. E. Minimum Street Setbacks. Provisions governing minimum street setbacks are established by the Concept Plan. F. Common Recreational Facilities. Common recreational facilities must conform to the design requirements of Article 12. G. Commercial Areas. There is some confusing language from St.James, in one instance it says all of the wetlands on tract B should be preserved but then it states any cumulative impacts would be settled with each property owner. It seems if it were all preserved there would be no need to discuss impacts with individual property owners. I think what would put this to rest if they could provide the Book number and Page number in the Brunswick register of deeds where it states exactly what is preserved and the language to accompany this. Our electronic records from the 2008 action are poor and I have having a hard time recovering the file in its entirety. Secondly, the USACE and DWR may feel more comfortable with the break request if we had confidence that the Williamson's would not develop into the wetlands located on the property. Has anyone approached the Williamson's to see if they would be willing to provide any commitment to this effect? If not I assume the recourse would be an updated ICE specifically addressing this property. Once that has been received then a decision would be made. Once the questions are answered, it's safe to assume the Corps would act on a modification request once the MOU signators have agreed and the MOU process complete. The Corps, absent of the MOU, would seek input from the same group in advance of any modification therefore it makes procedural sense to wait till the MOU is executed. The updated drawing shows: the approximate intersections to the Williamsons' property from the Town's proposed road. The Williamsons wanted the agencies to be aware of their plan so that we don't run into problems later. The intersections are laid out passed the 460 foot NCDOT control access. The Williamsons have agreed to place restrictions on the larger of the three identified wetland pieces (just south of the new road). The two smaller one they consider "isolated" wetlands and they are only willing to mitigate against their credits if necessary. St. James Development has also updated their portion of the drawing to show the latest wetland information and the four wetland pieces they are willing to place restrictions on. Please note that they will not place restrictions on the isolated wetland piece on Parcel A3 and any existing wetlands that extend into the proposed 60' ROW extension. They would also like the option to deed part of the restricted wetland as part of future lots with the lot setback being outside of the wetlands. The Town of St. James believes this clears up all the open items from the Agencies' merger meeting and would ask for approval/permit as soon as possible. We are planning to start construction June or July, 2014 to have the new road ready for 2015 hurricane season. The Corps and State partners have been engaged in discussions relative to this proposed break in control of access for several months now. The Corps and other review agencies have a responsibility to assure thai the break in access does not lead to additional secondary or cumulative impacts as the access' primary purpose as described by DOT is emergency evacuation. This has lead to a number of back and forth discussions about potential future impacts and ways to prevent secondary and cumulative impacts. Now at hand we have the plans generated by your engineer. The Corps has understood for some time that you desired to have an access into your property located off the south side of the proposed road. The Corps, until receipt of these plans, was never aware of any development plans to the north beyond an access point off the newly proposed road. The current plan shows a 60' R/W terminating into the wetland boundary with an additional parallel road along the wetland boundary. As drawn it does not extend into the wetland boundary but the Corps is interested to lcnow future plans and their potential effects on wetlands. It appears that the proposed 60ft R/W off of the North side of the proposed St James access, extends out beyond the 26 ft proposed R/W that parallels the wetland. This appears to us that you may have future plans to extend this road beyond what is shown on the plan sheet. Is this your intent? Do you intend on preserving this entire wetland system to the North of your design? Can your design be changed to show a typical "T" intersection at this location? The Corps and State partners again are trying to make sure that the break in access as well as access points of this break do not result in secondary or cumulative impacts.
