Thank you for providing an explanaƟon of measures taken to reduce impacts to the southern perennial stream. Please provide an explanaƟon of why impacts to the intermiƩent stream (impact S2 in the PCN) cannot be avoided or minimized through project design. [15A NCAC 02H .0506(b)(1)] The intermiƩent stream (Impact S2) cannot be avoided due to the lack of space within the parcel’s acreage. AddiƟonally, to preserve the maximum streambed acreage of all perennial streams (parƟcularly stream SA), the building and parking lot were adjusted to the northern side of the parcel, in turn sacrificing a porƟon of the intermiƩent stream. 2. Please clarify whether the Army Corps of Engineers has approved the delinea Ɵon of surface water features provided with the PCN, including whether the Corps agrees with the jurisdic Ɵonal status of features, so that the Division can fully evaluate all proposed impacts. [15A NCAC 02H .0506(a)(9)] The PCN applicaƟon includes the approved jurisdicƟonal determinaƟon (AJD) request directed towards the USACE. Buncombe county’s USACE representaƟve, Mitchell Anderson, is aware and noƟfied of the request. The AJD applicaƟon is currently pending along with the naƟonwide permit, and 401 cerƟficaƟon. 3. The Division has determined that your applica Ɵon is incomplete and cannot be processed. The applicaƟon is on-hold unƟl all of the following informaƟon is received: 1. Please provide your response by July 5, 2024. If all of the requested informa Ɵon is not received, the Division will be unable to approve the applicaƟon and it will be denied as incomplete.
