Hello Samantha, Thankyou for providing the comments and request for additional information below. The affected portions of Wetland 1 (comment 1.a.) and Non -Wetland Waters 1 (comment 1.b.) are within a Duke Energy transmission line easement. See the attached exhibit which shows the easement in relation to the proposed impacts. The jersey barriers (temporary impacts) are required to protect the transmission poles during construction. The use of a retaining wall was considered to avoid or minimize impacts to Wetland 1 and Non -Wetland Waters 1, however, Duke Energy does not allow the use of a retaining wall within their transmission line easement. Duke Energy also only allows a maximum slope of 4:1 within the transmission line easement. The maximum allowable slope is planned to minimize impacts. The information above was unintentionally not included the permit application. This information and the avoidance and minimization sections that were included in the permit application together should provide sufficient documentation that wetlands and tributaries were avoided to the maximum extent possible. Please provide the following information within 30 days of this email. Please note that the application will be considered "on hold" until receipt of all the requested information. 1. Please provide more details regarding avoidance and minimization of Wetland and Non -Wetland (Streams) impacts for this project. [15A NCAC 02H .0506(f) and (g)] a.
