I'm a little confused about the paperwork that you haven't received I thought it had all been sent with the NOV
response ,would you let me knowthe paperworkyou will need on the 28th for our meeting .1 would like to make
sure I have all the documents needed.

Since we have not received all the paperwork that was requested as part of the NOV-2024-PC-0211,
please provide these records at the time of our meeting to review. In additional, be prepared to discuss
potential corrective actions for over -applications and other violations.
As stated in my previous email the lagoon must be "properly closed in accordance with the Natural
Resource Conservation Service (NRCS) North Carolina Standard for Closure of Waste
Impoundments, February 2005 or any subsequent amendment." DWR requires the submittal (to
DWR) of an updated Lagoon Closure Plan amendment with language incorporating the new design of a
conversion to a freshwater pond.
We look forward to our site visit on Tuesday. If you have any other questions, please do not hesitate to
reach out.

Jim has approved the spillway design but I'm confused who makes the call on the grading
contractor being able to start. Can you clarify if we can start or who needs to make this call.

Hello Grayson Sarif, et at,
I have cc'd permit holder Josh Amick to keep him in the loop. I also have cc'd Lee
Holcomb, NRCS, and Michael Shepherd, USDA, as they are involved in the lagoon
closure cost -share programs.
This email is in response to your text message received on 5/20/2024 at 5:14 PM,
"Hey Sierra. Want your thoughts on something. Amick has an NRCS approved
design to convert the lagoon to a freshwater pond. I assume it is fine that he begins
the conversion process while he is working with DEQ to resolve his NOV. He said
that he reached back out to you all to set a time to meet next week. Let me know is
you see any problem with this" and text message received on 5/21/2024 at 8:18 AM,
"They're planning on getting started this week. Need to know if this is a problem."
To current, DWR Mooresville Regional Office has not received any response from
Josh Amick, permit holder, regarding an email sent by Brandy Costner dated
5/16/2024 titled "Meeting Request" aimed to discuss the NOV issued on March 25,
2024.
DWR would like to emphasize that AW1840001 (Permit) Condition V. 3. states "Any
containment basin, such as a lagoon or a storage pond, used for waste
management shall continue to be subject to the conditions and requirements of
this Permit until properly closed. When the containment basin is properly closed in
accordance with the Natural Resource Conservation Service (NRCS) North
Carolina Standard for Closure of Waste Impoundments, February 2005 or any
subsequent amendment, the containment basin shall not be subject to the
requirements of this Permit. The Permittee must submit a letter to the Division to
request rescission of the Permit by providing documentation of closure of all
containment basins. - [15A NCAC 02T. l 306(a)] Closure shall also include a
minimum of 24 hours pre -notification of the Division and submittal of the Animal
Waste Storage Pond and Lagoon Closure Report Form to the address identified on
the form within fifteen (15) days of completion of closure. - [15A NCAC 02T
.0108(b)]".
If the NRCS standards noted above are met and proper documentation is
maintained and provided to DWR following the Permit conditions, then DWR may
accept this method of closure. However, at this time, DWR has NOT received all
proper documentation that fully supports the NRCS NC Standard for Closure of
Waste Impoundments and the facility, at this time, is still in Non -Compliance (see
NOV-2024-PC-0211). At the completion of closure, DWR must receive ALL proper
documentation/ records per Permit conditions and the facility must comply with the
Permit, and local, state, and federal laws and regulations, and any and all violations
including past, current, and future, if applicable, must be fully resolved with DWR
confirmation. DWR has the authority to deny permit recission, further questions
may be directed to Richard Rogers, DWR Director, Michael Pjetraj, Deputy Director,
and Ramesh Ravella, Animal Feeding Operation Supervisor.
