Subject: Summary of 5/28 Visit/Meeting
Mr. Amick,
Thank you for meeting with us yesterday to discuss the NOV (NOV-2024-PC-0211) and lagoon closure. We had a
very productive conversation and believe we have a good path forward to resolve the violations in the NOV. Below
is a summary of items we discussed:
• Soil Mitigation Plan —We recommend working with an agronomist to help develop a soil sampling
plan to address the areas of observed over application (visual and/or records). See the attached
general over -application map outlined in red. Also included are wooded areas that had visual evidence
of waste runoff and will need to be incorporated into the Soil Mitigation sampling plan as well. This
plan should be submitted to us for approval prior to implementation. This soil sampling will tell us the
condition of the soils and if there are any corrective action measures that need to be taken to get the
fields back to pre -over application condition. We request that you coordinate with our office when this
work is scheduled so that someone from our staff can be present and split samples at our discretion.
• All records need to be submitted for review. NCDEQ does acknowledge that some of these records
may have been previously submitted not in response to the NOV and by other agencies and therefore is
requesting resubmittal of all the following records from 2023 to date:
o These records include —waste applications, weekly freeboard, sludge survey, waste
analyses for sludge, agitated liquid, and non -agitated liquid (when applicable), 120-minute
inspections, weather codes, crop yields, rainfall records with monthly and 1" rainfall inspection
initials, lease agreements, SLUR 2 forms, soil analyses (good for three years), calibration of
equipment (good for two years). (It's our understanding that Grayson Sarif would have the
information regarding the lease agreements).
• Provide approved/engineer sealed design for conversion to freshwater pond for our records.
• OIC issue — DWR will discuss this with Central Office. We understand that an OIC was not/has not
been designated and the work done was not done under an OIC. With the conversion to a freshwater
pond there should not be any more waste being removed. If waste is removed for whatever reason, this
work will be completed by an OIC or under an OIC supervision and associated paperwork should be
completed.
• We discussed records we would review during a typical inspection and what is needed for closure
(gave Mr. Amick a copy for reference as well as a copy of his COC/ Permit).
• We also discussed being able to move forward with closure activities related to converting lagoon
to a freshwater pond. NCDEQ has permit authority related to Permit # AWI840001. The Permit requires
the closure to be completed to NRCS Standards/Codes and thus NRCS has authority over the lagoon
closure for Twin J/ J-Caine 84-01 (i.e.: requirements, design, etc.) and therefore will be the agency to
make decisions regarding that work.
We would like to set up a meeting with NCDEQ-DWR, NRCS, NCDA, and Mr. Amick to discuss the outcome of
DEQ's 5/28/24 meeting and the path forward regarding NOV resolution and closure activities (sent separate
email to setup meeting).
