Adam and Heather,

We’ve received and started our review of the Three Creeks Farm Mitigation Bank NWP 27 application (SAW-2019-02341). Some additional information is needed to complete our review and make
a final permit decision. Please review the below list of requested information and provide required responses within 30 days of this email request (by COB on June 22, 2024).

1. Please elaborate on the purpose of the fill to grade activity associated with the proposed W1 impact. If the activity is to fill an existing ditch/swale to meet grade of the surrounding
wetland, please note that this would be considered a permanent fill impact but not a permanent loss of resource. This is an existing swale that is being filled to enhance hydrology
to Wetland 1 so per your comment above should be a permanent impact.

2. All of the proposed resource impacts on the permit impact figures 2A-2D appear to end at conservation easement (CE) boundary, but the design plans show construction outside of the
CE on UT1, UT2 and Little Brushy Fork. Can you please confirm that the PCN impact tables account for all proposed construction impacts (in and out of the CE)? I did not account for
the areas outside of the CE. S1-LBF goes from 2,983 lf to 3,033 lf (difference of 50 lf). S4-UT2 goes from 325 lf to 346 lf (difference of 21 lf), and S2- UT1 goes from 2,887 lf to
2,999 lf (difference of 112 lf). This would make the total permanent stream impact 7,728 lf.

3. For each proposed stream crossing impact can you please clarify (1) if is a new crossing or an upgrade/replacement crossing beyond of the footprint of an existing crossing, These
are new crossings (2) the purpose and type of proposed crossing, S6 is for agricultural farm equipment to cross. The other crossings are for cattle. and (3) whether it may meet the
requirements of an agricultural exempt activity. All crossings are for the use of farming or raising cattle.
