FACILITY OVERVIEW:
This facility is a public water treatment plant that is 100% industrial waste and treats surface water from the
First Broad River to produce finished potable water for the City of Shelby and surrounding areas. The facility is
owned and operated by the City of Shelby and has a designed potable water capacity of 12 MGD and generates
wastewater flows with a maximum monthly average wastewater discharge of 0.214 MGD (last three years
data). The system utilizes:
• Mixer • Two (2) 0.75 MG residual settling lagoons
• Twelve (12) flocculators • Dechlorination
• Ten (10) settling basins • Effluent meter
• Eight (8) filters
Chemical Usage Consists of: Phycomycin SCP and Oxidizer, Alum, Caustic, Carbon, Chlorine, Fluoride,
Sodium Thiosulfate, Polyphosphate Corrosion inhibitor
Raw Water Treatment Process: (from application and historical documents)
Water is drawn from the First Broad River, stored in a series of reservoirs and treated with phyomycin SCP and
Oxidizer. Water is then transferred to the water treatment plant where alum and caustic are added and mixed
to start flocculation as the water flows through the flocculators [two trains of six (6) each for twelve (12) total].
A carbon slurry is then added to the water before it is distributed across ten (10) settling basins. From the
settling basins the water is distributed across eight (8) multi -media filters where chlorine is added. From the
filters water flows to final potable water treatment where fluoride, caustic, chlorine and polyphosphate
corrosion inhibitor is added prior to distribution for use.
Wastewater and Treatment Process: (from application, and historical documents)
Potable water is stored in a backwash water tank and used to backwash the multi -media filters on average once
per day. The backwash wastewater is dechlorinated with sodium thiosulfate as it flows to the two (2)
wastewater settling lagoons. Stormwater from various parts of the facility also drains to the lagoons. The
decanted wastewater from the lagoons passes through the effluent flow meter prior to discharge at the outfall.
The lagoons are taken offline as needed (one lagoon at a time) and solids removed and allowed to dry. Solids
are then excavated for disposal.
APPLICATION
The Water Treatment Plant is operated by the City of Shelby. The application outlines a treatment process as
outlined above utilizing sedimentation, flocculation and filtration to produce potable water with wastewater
and sediments going to lagoons for holding prior to discharge. The application indicates backwash, reject water
and stormwater as being in the treatment lagoons and notes activities producing wastewater as filter backwash,
flocculator cleaning and sediment basin cleaning. The facility contracts with Pace Analytical for copper, TOC,
COD, WET, fluoride, TN, TP and aluminum analysis and with the Shelby WWTP for analysis of BOD, ammonia,
TSS and Turbidity. The application notes a number of parameters that are believed to be present, and these are
addressed in the permit.
INSPECTION
The most recent inspection occurred on September 14, 2022. The inspection report noted no issues were found
and the facility was well kept and organized. The inspection notes that the groundwater monitoring condition
was removed from the permit in 2021 but indicates the city should maintain the wells in accordance with well
construction standards (15A NCAC .02C) and the DWM Inactive Hazardous Site Program (NCD986176451).
COMPLIANCE:
This facility has not had an enforcement action with penalties since 2011. There were no NODS or NOVs during
the most recent permit cycle. There was one frequency violation (reporting error) and one limit violation for
TRC but the value did not exceed the compliance limit of 50 µg/L.
BIMS did show six (6) late or missing GW-59 reports, but no violation actions were taken. Discussion with the
regional office indicated that information in the BIMS system related to the GW-59 monitoring should be
removed since this monitoring is no longer required.

The data reviewed for the renewal is from January 1, 2021 through November 2023.
Note that average values in the table above are based on three years of data as required for the RPA evaluations
and maximum monthly average flow as required in the WTP Guidance. This three-year period is actually longer
than the previous permit cycle.
REVIEW OF PERMIT MONITORING AND LIMITS:
Flow - The facility's maximum monthly average flow from DMR records for the last three years - as used in RPA
analyses - is 0.214 MGD. This value is a bit higher than the maximum average flow in the previous renewal
process.
Note on flow values -The eDMR system calculates average flow in away that includes all zero values in the calculation. Days
with Waivers appear to be given zero values in eDMR and used in the average calculation. This data is taken over into BIMS
since the eDMR values are considered the "Copy of Record." Evaluating the flow by excluding the zero values would give a
maximum monthly flow of 0.343 MGD. Since the eDMR data is the accepted record and the data found in the system, these
results are used in the renewal process.
TSS. pH, Turbidity. TN and TP - Data for these parameters do not seem to indicate any major issues during the
review period. The turbidity limit has been removed from the permit since the turbidity impairment for the
receiving stream was delisted in the 2020 303(d) process. Monitoring for turbidity will be mainatianed.
TRC- There was one (1) exceedance of the 17 µg/L limit, but the value was below the compliance level of
50µg/L.
Total Aluminum (Al) - There is no water quality standard for this parameter to evaluate towards, but the values
from the data were well below the In -Stream Target Values from the Stream Standards guidance spreadsheet.
Maintain monitoring due to chemical usage and potential for presence.
Whole Effluent Toxicity (WET) - The facility failed two (2) of their WET tests in the three year period evaluated.
This represents 17% of their evaluations in that time period.

Reasonable Potential (RPA) Analysis (Copper and Fluoride) -
RPA Evaluations were run using the zero flow values for the low flow numbers and data from the last three
years - as established in the WTP Guidance - including the maximum monthly flow value of 0.214 MGD during
this time. Note: BIMS has stream flow numbers that appear to be for the First Broad River rather than for the UT
which has always been evaluated as zero flow. BIMS stream flow information in the system will be updated.
Copper Evaluation: In the 2021 permit renewal Cu limits were set at 7.88 µg/L monthly average and 10.47 µg/L
daily max. In this RPA evaluation one DMR value was higher than the allowable chronic Cw (7.88) and the
maximum predicted Cw (9.92) was well above the allowable Cw value. Because of this show of reasonable
potential, the permit limits will remain in the permit. The 2021 permit had given the City a five year compliance
period (to begin November 1, 2026). The city evaluated the cause of their Cu exceedance and changed their
biocide control chemical from Copper Sulfate to Phycomycin SCP. Since that change the facility has been
meeting their Cu limit. The previous permit gave five years for compliance which would run into the renewal
cycle, and require the schedule to be maintained in the permit. Division staff has discussed with the city the
possibility of making the limits effective now given their current compliance. The City responded in a February 1,
2024 email (from Brad Greene) that they wanted to remove the compliance schedule and make the limits effective
with the permit issuance (effective date). Unfortunately this was neglected in the draft permit. The City
commented on this needed change (see March 4, 2024 email) and the Final permit reflects this change.
The RPA evaluation for Cu included two values from the previous permit cycle so these values were used for a
second time in RPA analyses. One value is a high value of the data set (230) and could be excluded as an outlier.
Even without this value the data would still show reasonable potential.
Fluoride Evaluation:
The data evaluated in the RPA did not show any reasonable potential for water quality impacts. The maximum
value in the DMR data was 150 µg/L which is well below the allowable level of 1,800 µg/L. Monitoring could
potentially be removed for this parameter, but since fluoride is a chemical additive in the treatment process and
could be present, the quarterly monitoring will be maintained.
NCG59 GENERAL PERMIT EVALUATION
The facility requires a permit limit for copper so the system is not eligible for coverage under the general
permit.
FILE HISTORY REVIEW SUMMARY
• Original Issue Date in BIMS is given as December 31, 1980. Documents in Laserfiche only go back to 1990.
• December 18, 1985 - Authorization to Construct (ATC) - This ATC was issued for construction of a 0.72
MGD wastewater treatment facility with two (2) lagoons each having a capacity of 1,565,300 gallons and all
piping, etc. for influent and discharge.
• April 18, 1990 - Division letter to City's consultant noting that their recent considerations for expansion of
water treatment needs to be evaluated to determine the downstream impacts of additional withdrawal and
how it would impact the 7Q10 flow and downstream dischargers.

• October 1, 1992 - Division Comments on Environmental Assessment - The EA was for expansion of the
Water Treatment Plant from 10 to 18 MGD. The Division noted the need for the City to assess the impact of
this added withdrawal on the dischargers downstream since the 7Q10 could be impact and cause a need for

more stringent discharge limits. Comments indicated that the WTP expansion should not be approved until
the city properly evaluated the impact.
• April 27, 1994 - Permit Renewal - This renewal added monitoring for Iron, TRC and Aluminum. The staff
report noted minimal flow in the receiving stream. The report noted a facility design discharge flow of 0.72
MGD and indicated the treatment system as two alum sludge lagoons. This staff report was completed by
the MRO so Cleveland county had moved at this point from the ARO.
• November 23, 1998 - Permit Renewal - This renewal changed the daily max limit for settleable solids to 0.2
ml/L and eliminated monitoring for pH noting it was not required for WTPs. The staff report notesthe City
requesting reduction in flow for various parameters to twice per month but the requirements remained as
weekly in the permit.
• September 29, 2003 - Permit Renewal - This renewal added a daily max limit of 17 µg/L for TRC that was
set to become effective May 1, 2005. Footnote for TRC noted the 50 µg/L compliance level. Design flow in
the staff report continues to show 0.72 MGD but the application indicates a design capacity of 0.78 MGD.
• November 9, 2004 - ATC for modifications to add sodium thiosulfate storage and chemical feed system to
provide dichlorination. The document notes the need for an operator in responsible charge (ORC) once the
system is classified by the Certification Commission.
• August 29, 2008 - Permit Renewal - This renewal added pH back into the permit requirements with a 6 to 9
compliance range and removed total settleable solids and turbidity requirements. There were also a
number of additions to the parameter monitoring requirements. All requirements are summarized in the
table below.

The permit also required reporting of duration of flow with the flow monitoring. The staff report notes
wastewater coming from filter backwash that is dechorinated prior to going to the treatment lagoons. The
permit renewal application describes the water and wastewater treatment processes (similar to current
system) and indicates a facility with water treatment capacity of 12 MGD and discharge of 0.058 MGD.
August 13, 2009 - Permit Correction to change the permit flow limit from 0.20 MGD to 0.40 MGD as
requested by the City.
April 24, 2015 - Permit Renewal - This renewal made significant changes in the monitoring requirements.
- Flow limit was removed from the permit but monitoring maintained (WTP guidance)
- Removed calcium, Manganese, magnesium and fluoride monitoring requirements.
- Reduced copper and iron monitoring to quarterly to match WET testing.
- Added turbidity monitoring back to the permit.
- Added a special condition with compliance schedule for implementation of eDMR.
- Added a special condition with requirements for groundwater monitoring as requested by the
Groundwater Branch of DWR. The facility lagoons are located partially on top of an inactive Hazardous
Waste Landfill and information was requested to evaluate potential impacts.
As part of their application (February 6, 2013) the city requested removal of a number of parameters.
Copper, Iron, Aluminum and WET remained in the permit. Maximum monthly average discharge noted as
0.298 MGD
September 16, 2021 - Permit Renewal - This renewal included updated language for eDMR requirements,
outfall map, system process descriptions and treatment components, footnotes, and WET. The treatment
system classification, PC - I, was also added to the permit along with regulator citations, parameter codes,
duration of flow as a parameter and units of measure. Monitoring changes included:
- Added limits for turbidity based on 2018 designation of waters as impaired.
- Added limits for copper based on RPA analysis and a five-year compliance schedule (November 1,
2026).
- Monitoring added for fluoride (2019 application indicated use of fluoride), Total Hardness, Total
Nitrogen and Total Phosphorous.
- Groundwater monitoring was removed from the permit at the request of the regional office and the
cover letter outlined the city's ongoing responsibilities.
The maximum monthly average discharge was noted in the permit as 0.193 MGD. Monitoring Summary:

PROPOSED PERMIT CHANGES:
• Updated eDMR requirements to be consistent with final EPA rule.
• Added regulatory citations throughout permit as needed.
• Language on the Supplement to Permit Cover Sheet has been updated. This includes modification of the
treatment system components to include maximum average monthly discharge of 0.214 MGD and add the
use of phycomycin SCP in the place of copper sulfate.
• Total Copper - The Reasonable Potential Analysis (RPA) using data from the last three years continues to
show reasonable potential for discharge to result in potential water quality impacts. The previous permit
set a five-year compliance schedule with the limits becoming effective November 1, 2026. The compliance
schedule in Section A.(3.) has been updated.
• Turbidity - The receiving stream was declassified as impaired for this parameter in 2020. The limit has
been removed but monitoring is still required.
• Permit map and descriptive information on the permit map have been updated.
• Expiration date has been changed to March 31, 2029 to allow for a nearly full five year permit term.
• Groundwater wells removed from the permit in BIMS to avoid any future failure to monitor violations.

COMMENTS ON DRAFT PERMIT:
The city provided comments on the draft in an email from Brian Wilson received on March 4, 2024. The city
noted that the compliance schedule for Total Copper should have been removed from the permit. As noted
above in the Fact Sheet RPA section, the city had been approached by Division staff about forgoing the
compliance schedule into this permit cycle since the facility was meeting their limits. The city agreed to this in a
February 1, 2024 email. However, the February draft permit did not make this change. The Final Permit has
been corrected so that the Total Copper limits will be effective on the effective date of the permit. The city also
requested that three other parameters in the effluent table (Turbidity, Aluminum and Fluoride) be noted as
"Monitor and Report" like some other parameters without limits. This change has also been made in the final
permit.

Copper limits. I'm sorry that this change did not happen before the notice copy was sent out. Based on the information
you provided in your February 1, 2024 email we will correct this in the final permit and remove the schedule making the
copper limits effective on the effective date of the permit.

were removed in the renewal in 2021. However, over the last permit cycle BIMS was still producing late violations for

Just a few comments/questions on the draft:
In the RPA for copper, the value for 1/19/2021 was reported as 0.23 mg/L. Apologies if this was addressed in your
factsheet and I missed it, but was that a misreported value or unit?
I also noticed that the BIMS coordinates seem to be slightly different from those in the application, although it was quite
close.
Finally, just a formatting note, there is an extra blank bullet point in the factsheet under the facility overview.
The rest looked good to me; it was helpful to see a more in-depth factsheet example. Hope I didn't miss anything!

Yes, we do run the RPA analysis with the most recent data from their DMRs. We generally use the last three years of
data in the analysis. If you need to walk through any of that process let me know. Do you have the documents that
Sydney used in her WTP training late last year? That includes info on the RPA process.

Thanks for talking with me today about the permit renewal. As we discussed, I will leave the treatment system
description in the permit as indicating you have two (2) 0.75 MG settling lagoons. I was just making sure since some
previous applications and an old ATC had indicated two (2) 1.5 MG lagoons. Thanks for clarifying that for me.
Also, we discussed the Total Copper limits in your permit. In the 2021 renewal the limits were added with a five-year
compliance schedule in the permit which would put the limits effective November 1, 2026. The last permit gave you
until 2026 and we can certainly leave that in the permit as it is if you want. That would include the current requirement
that you provide annual response to our Division on the efforts toward compliance with the limits until the 2026
compliance timeframe. However, it looks as if you may have found to reason for your copper issues in changing the use
of copper sulfate in your process. Since that time, it appears that you have been meeting the copper limits. I wanted tc
see if the City was interested in removing the compliance scheduled from the permit and just having the copper limits
be effective with issuance of the permit. If so, please respond to let us know this is okay along with your response to my
January 16, 2024 email questions on permit contact changes and electronic submittal of permit documents.

Just wanted to touch base and let you know that I am working on this permit renewal now in case you guys have any
issues with this one. I hope to have it ready for public notice soon so I'll forward you a draft before that.
On thing I did want to get your feedback on. This facility apparently has lagoons that were built in an old closed
landfill. The permit used to have conditions related to groundwater well monitoring, but that section was removed in
the last permit renewal in 2021. 1 think the regional office requested to have this removed. Looking at data in BIMS I
noticed that there had been 6 instances noted over the this permit cycle of Late/Missing GW-59 reports. There were no
actions taken so I'm wondering if we need to make some adjustments in BIMS so the system isn't looking for these or is
there a reason for this to remain? Do they still have some responsibility for groundwater monitoring?
