A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater Permit SW3081003. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Dutch Buffalo Creek, class WS-II waters in the Yadkin Pee-Dee River Basin. As a result of the inspection,the facility was found to be noncompliant with the conditions of the SW3081003 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Based on the inspection conducted the site was not compliant. The signed copies of the operation and maintenance agreement, engineer's certification, and a copy of the deed restrictions are not present in the file for the site. Portions of the inner slopes of the stormwater basin are bare and need denser permanent vegetative ground cover to ensure the risk of erosion is properly mitigated. Additionally, the riser inlet was almost fully covered over by about 1 inch of sediment. The riser inlets need to be unobstructed to function properly.
