Staff review of the plans and specifications has determined that the project;as proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 990929 dated November 19, 1999, for the construction of Jones Brothers Partnership Shell Buildings. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supercede any other agency permit that may be required. This permit covers the construction of 121,397.3 square feet of built-upon area. 2. The overall tract built-upon area percentage for the project must be maintained at 25%,as required by Section .1005 of the stormwater rules. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways to provide access. 2 ' State Stormwater Management Systems Permit No. SW8 990929 II. SCHEDULE OF COMPLIANCE 1. Projec ts covered by this permit will maintain a minimum 30 foot wide vegetative buffierbetween all impervious areas and surface waters. 2. The permittee is responsible for verifying thatthe proposed built-upon area does not exceed the allowable built-upon area. 3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4. Prior to the sale of this project, in whole or in part,the following deed restrictions must be recorded with the Office of the Register of Deeds and submitted to DWQ: "The built-upon area is limited to 121,397.3 square feet. Construction of additional built-upon area will require a permit modification." "Construction of additional impervious areas such that low density requirements are no longer met must be submitted to DWQ and a permit modification must be issued prior to construction.An engineered system will be required to collect and treat the runoff from all built-upon area associated with the project, including that area permitted under the low density option." "Filling in or piping of any vegetative conveyances(ditches, swales,etc.)associated with this development, except for average driveway crossings, is strictly prohibited by any persons." "A minimum of 30' of vegetated buffer area shall be provided between surface waters and all impervious surfaces." 5. Filling in or piping of any vegetative conveyances(ditches,swales,etc.)associated with the permitted development, except for average driveway crossings, is strictly prohibited by any persons. 6. Projects within CAMA's Area of Environmental Concern (AEC)are subject to a reduction of the permitted amount of built-upon area due to CAMA jurisdiction within the AEC. 7. -A copy of the recorded restrictions must be received by this Office within 30 days of the date of sale. 8. The following items will require a modification to the permit.Revised plans, specifications and calculations must be permitted prior to the permittee beginning construction on the modification: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area. e. Further subdivision,acquisition,or sale of the project area.The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, altering or piping any vegetative conveyance shown on the approved plan. 9. The Director may determine that other revisions to the project should require a modification to the permit. 10. Swales and other vegetated conveyances shall be constructed in their entirety,vegetated,and be operational for their intended use prior to the construction of any built-upon surface. 11 During,construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3 State Stormwater Management Systems Permit No. SW8 990929 12. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 1.3. Within 30 days of completion of the project,the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 14. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. M. GENERAL CONDITIONS 1. Failureto abide by the conditions and limitations contained in this permit may subjectthe Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143- 215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit,or terminating the permit as allowed by the laws,rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality accompanied by the appropriate fee,documentation from both parties involved,and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. 6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all components of the stormwater management facility. 7. The permittee shall notify DWQ of any mailing address changes within 30 days of such change. 8. The issuance of this permit does not preclude the Petmittee from complying with any and all statutes, rules, regulations,or ordinances which may be imposed by other government agencies(local,state and federal)which have jurisdiction. Impervious materials include asphalt,gravel,concrete,brick,stone,slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Swales shall not be filled in,piped,or altered except as necessary to provide driveway crossings. 4. Built-upon area in excess of the permitted amount requires.a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shalt be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. Type of Development The Jones Brothers Partnership Shell Buildings project site is located in Morehead City, Carteret County,N.C.. The intended use of the Jones Brothers Partnership Shell Buildings is a manufacturing facility for Jones Brothers Marine. The project is proposed as low density development. 2. Earth Disturbing Activities a. Excavation and grading for the installation of drainage, and utility improvements. b. Grading for the construction of proposed buildings and parking. 3. Drainage The site presently drains to the north west to the Newport River by way of Beech Swamp Marsh Canal. The developed site as proposed will continue to drain to Beech Swamp March Canal allowing runoff to sheet flow over the site to the marsh. FIIe:C W P8\kg\987nar.wpd B. Erosion and Sedimentation Control Measures The following measures are proposed for the site. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete, i.e., drainage swales, utility easements, etc. I. Sediment Fence- Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off-site sedimentation in controlled. 3. Stone Check Dams- Stone check dams are to be installed at locations shown on plans to reduce erosion within drainage channels by restricting flow velocity. 4. Seeding - All disturbed areas will be seeded within 14 days following construction in accordance with the seeding schedule shown on plans. 5. Stone Construction Entrance - Stone construction entrance will be used to reduce transport of sediment off site. 6. Sediment Trap - Sediment trap will be used to store sediment and prevent sediment transport off site. C. Construction Sequence 1. Clear site of debris. 2. Install portion of gravel road at entrance and sediment fencing as shown. 3. Construct swales and sediment trap seeding immediately after construction. Install stone check dams where specified. . 4. Rough grade site and prepare building pad. 5. Seed site within 14 days following completion of land disturbance. 6. Construct buildings. 7. Fine grade site. 8. Install gravel access road and parking area. 9. Construct concrete sidewalks. 10. Complete final seeding and landscaping. 11. Remove sediment fencing and stone check dams once disturbed areas are stabilized. D. Design Assumptions 1. Design storm is ten years. 2. The rational method was used for design. Coastal Stormwater Regulations The North Carolina Division of Environmental Management implemented coastal stormwater regulations in coastal counties on January 1, 1988. these regulations are detailed in 15 NCAC 2H.1000 Stormwater Runoff Disposal. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. In order for a project to be low density, the entire vegetated site area must be utilized for treatment. The impervious area of this project is concentrated in one area, and the stormwater flows into a grassed swale and is directed off of the property. The project is considered a pocket of high density and a designed stormwater treatment system is necessary. This project could remain low density if the grassed swale is removed and the stormwater is directed to sheet flow across the entire site area or if the impervious area is spread out. 2. Please verify the receiving stream class. Beech Swamp Marsh Canal is an unnamed tributary to the Newport River. It appears that the site area drains to a portion of the Newport River that is classified SA. If this is the case, low density projects must have no more than 25% impervious surface. High density projects that drain to SA waters are not permitted to build a wet detention pond. 6. DEED RESTRICTIONS AND PROTECTIVE COVENANTS The following italicized deed restrictions and protective covenants are required to be recorded for all subdivisions,outparcels and future development prior to the sale of any lot. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number as issued by the Division of Water Quality. Impervious materials include asphalt,gravel,concrete,brick,stone,slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Swales shall not be filled in,piped,or altered except as necessary to provide driveway crossings. 4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted.
