Dear Mr. Sanders:
On August 10, 2021,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources
(DEMLR) inspected the subject project, located off Stone Chimney Road in Holden Beach in.Brunswick County
to determine the status of compliance with the State Stormwater Management Permit Number SW8 990913 issued
on April 2, 2008. This was not a full inspection,but instead was in response to concerns about a swale and yard
inlet next to Lot 232. The concern was that the swale was not stable,and that debris therefore collects on top of
the yard inlet preventing it from draining appropriately. NC DEMLR personnel observed that this swale may
require additional groundcover in areas to restrain erosion if the swale continues to erode. Please ensure that you
conduct regular maintenance to remove any debris that would interfere in the function of the stormwater system.
The State Stormwater permit is an environmental permit intended to settle out sediment and other pollutants
before they are discharged to surface waters. The permit does not prevent flooding. If you all elect to install inlet
protection to reduce the risk of flooding then that can be done,but it is not required by this permit. If you all
would like to change the swale's drainage configuration in some way,then please contact your consultant to
determine an appropriate design and then apply for a permit modification.

The attached letter will be mailed to the permittee. The swale and yard inlet appear to be installed as they were
designed. The swale may require additional groundcover in areas in order to restrain erosion if the swale continues to
erode, but it does not appear to be substantially eroded at this time. I have asked the permittee to conduct regular
maintenance which will remove debris which could clog the yard inlet. Hopefully this will address your concerns.

Your home (3585 Natchez Street SW, Supply, NC 28462) is covered by State Stormwater permit SW8 990913. 1 see that
there is a 100ft 5:1 swale adjacent to your home on the approved plans. I will work with the inspector for the area,
Caroline Dalis,to get the site inspected to ensure that the site is constructed per the approved plans and then we will
follow back up. For clarification,the State Stormwater permit is an environmental permit that is intended to allow
sediment and other pollutants to settle out of stormwater before being discharged to surface waters. The State
Stormwater permit does not regulate flooding. Additional information is available here.
We will let you know what we find.

Ms. Cudlin —There is no County Stormwater Permit for Seascape @ Holden Beach because it pre-dated the County
Stormwater Ordinance. The Swale would be part of the State Stormwater Permit requirements. Basically they require a
stormwater swale to be at least 100' long and vegetated but other than that I don't see that the State would be concerned
with the type of grate that is installed if there is a better alternative.
I have included Kelly Johnson with the State on this email. She should be able to let you know what the State would and
would not allow.

Good Morning,
I wanted to inquire into whether or not your departments could provide me with assistance/guidance into a serious
concern with a drainage ditch/swale within the Seascape @ Holden Beach community. My home is directly adjacent to a
drainage ditch [see attached photos] and ground level runoff grate within the community. As I am a new homeowner here
I am only now noticing this as a serious concern. I have seen with recent rains the ground level drainage grate will easily
get blocked and result in all the street fed storm water to be hindered in its relief and thereby overflow onto my
property. The first time this overflow occurred I thankfully was home and was able to wade through several feet of water
to clear the debris from the drainage grate to enable the water to flow. Had I not been home on that heavy rain day my
home could have easily been flooded.
In my attempts to work with the appropriate POA committee's here at Seascape they appear to be resistant in addressing
this issue. They provided the following statement in relation to the swale/ditch in response to any requests to address the
situation; " They are built to specifications established by the State of North Carolina DENR, Division of Water Quality, for
Seascape at Holden Plantation and must not be altered so as to remove the effectiveness of the swale." I fully
understand that arbitrary adjustments can impede the effectiveness but with the ground level grate at the end of the ditch
and all the debris coming in from the street it is difficult to understand other design features could not be considered.
Granted not all debris can ever be held back but right now there is really not much in place to help with the situation. The
erosion to property as well as flooding are of huge concern as the structure stands now. The length of the ditch/swale is
approximately 105 feet. About 18 feet from the ground level drainage grate there is now only one stone piling to catch
some debris as it flows down the ditch/swale from the street. I am clearly not an engineer but it appears that more such
pilings or a large gravel base could work to prevent debris from freely flowing to the drain.. Also as the ground level
drainage grate is at the end of this 105 foot ditch, that possibly an atrium style grate or other style could help catch debris
and still allow for water to flow?
I don't know if this is something the County or State offices manage. Who best at the local or state levels could assist with
an assessment of the drainage needs and/or design options, if any? I understand the original developers in the design of
all such storm water runoff were to have County engineers evaluation and approve and follow NC state
regulations. However, it is also my understanding the original design was some 20 years past and the drainage ditch in
question was noted to me by another resident to have been modified in recent years by the POA . I am not sure whether
County engineers were ever consulted on any work done to the ditch over the years or if these swales/ditches have had
any regular inspections completed.
I would appreciate any guidance your offices could offer to this serious issue. I hope in the coming weeks as the
storm/hurricane season marches forward that this issue can make some progress into being addressed and resolved as
best can be.

We just found out that when our home was originally built "someone" superimposed the house footprint onto the
official topographic survey and apparently passed that off as the BUA showing only 5100sf of impervious area.
My question/concern to you is does the permit holder, I believe Mark Saunders, file these BUA surveys with you when
each lot becomes developed? If so, I'd like to file a complaint concerning the fraudulent survey of my property. Also,
there appears to be issues with all of the drainage areas here with lots of overflowing when it rains.

You will have to hire an engineer to help you make that determination. We typically do not give built-
upon area (BUA) credit to existing/previously installed pavers because in order to receive the BUA
credit, the infiltrating permeable pavement system must be designed per 15A NCAC 02H .1050 and
.1055.

All,
We have received a couple of questions regarding the option of adding Infiltrating Permeable Pavement option to the
subject permit. In order to receive the 100% pervious credit for the infiltrating permeable pavement, it must be
designed per 15A NCAC 02H.1055. There are two options for adding the Infiltration Permeable Pavement for built—
upon area (BUA) credit option to a subdivision.The options are:
1) Option 1 is the preferred option, as it allows the HOA to oversee the approval of the infiltrating permeable
pavement. In this case, DEMLR will provide the HOA with a Infiltrating Permeable Pavement Review Form to use
to ensure the proposed permeable pavement will meet the stormwater rules to receive BUA credit. In order to
add this option to the existing permit, the current permittee must submit a minor modification application to
DEMLR that contains the following:
a. A written request to have this option be added to the permit
b. A soils report for the entire site or a condition that requires each lot owner to provide a soils report for
their lot with their application to the HOA.
c. An agreement that the HOA will hire an engineer to design the infiltrating permeable pavement or a
condition that requires each lot owner to hire an engineer to design the infiltrating permeable
pavement to ensure that it is designed per 15A NCAC 02H.1055 to meet the requirements to receive the
BUA credit.
d. A signed, dated and notarized form that they will amend the deed restrictions to add specific language
for the option to use infiltrating permeable pavement(this language can be acquired by DEMLR prior to
submittal, upon request)
e. A written statement regarding who will be responsible for maintenance of the infiltrating permeable
pavement, either the HOA or the individual lot owners. If the HOA oversees the maintenance,they must
submit an Operation & Maintenance agreement to DEMLR with the application. If the individual lot
owners oversee the maintenance, the lot owners will need to submit an Operation and Maintenance
agreement to the HOA when they propose adding the infiltrating permeable pavement.The HOA will
agree to keep these Operation and Maintenance agreements and the actual maintenance records on file
and make them available to DEMLR upon request.The HOA will also need to record an amendment to
the covenants, no less than once annually (unless no infiltrating permeable pavement projects are
completed that year),to document each lot that has installed infiltrating permeable pavement and who
is responsible for the associated Operation and Maintenance agreement for each lot. Copies of each
newly recorded amendment must be submitted to DEMLR upon recordation.
2) Option 2 is only allowed if the permittee/HOA is not willing to modify the permit. A signed statement from the
permittee/HOA to that affect must be provided. In this case, each individual owner who wishes to add
infiltrating permeable pavement for BUA credit would submit for a new High Density Permeable Pavement
permit for their individual lot.The Operation and Maintenance Agreement signed by the lot owner and a
reference to the stormwater permit must then be recorded as an amendment to their lot deed so that both are
associated with the individual lot in perpetuity.
