Laws. All records, books, etc., shall be property of the church.
TREASURER/CHURCH ACCOUNTANT
The church shall,upon nomination by the nominating committee, elect annually a
church treasurer, unless the church decides to "outsource"this position. He shall receive,
preserve and payout,upon proper authority, all money or things of value paid or given to
the church keeping at all times an itemized account of all receipts and disbursements;he
shall render monthly reports and an annual one to the church to be preserved by the
church. The treasurer shall study the best methods of keeping the financial records and
make recommendations to the church.
Prior to the rendering of the annual report,thirty days after the end of the year,the
treasurer's records shall be studied by the Finance Committee, or others designated by the
church. Approval of the report shall appear at the end of the annual report before it shall
be accepted by the church. All books, records and accounts kept by the treasurer shall be
the property of the church and shall be open for inspection, at any or all times,by any
member of the church with the exception of the record of tithes and offerings paid by the
church members and these only can be reviewed by the Finance Committee. He shall
receive the empty offering envelopes after the money has counted by the Ushers, and
from these envelopes he shall give each donor individual credit. He shall be responsible
for preparing and mailing the annual statements to all contributing members.
TRUSTEES:
There shall be at least three(3)trustees. They shall be presented to the church by
the nomination committee for election by the church and shall serve until resignation or
some reason by the church for their dismissal. They shall meet as so needed, elect a
chairman, and may meet upon a call by the chairman of the Deacons. The trustees as
provided by law and the action of the church hold in trust the title,to all properties of the
church and shall represent the church in all matters of legal responsibility regarding the
purchase improvement, insurance and disposal of church property. They shall execute all
legal papers relating to the church and community as the church may direct. They have
no power to sell, buy,mortgage, lease or transfer the title of any property of the.church
without a special vote of the church authorizing such action.
USHERS
A Head Usher and Assistant Head Usher shall be nominated by the Nominating
Committee and voted on with the yearly election of officers. They shall see that the
services of ushers are carried out. They are to make sure that there are an appropriate
number of ushers at both Sunday and special services. They are responsible for the
training&equipping of ushers to allow them to effectively perform their duties. They
shall receive and count the offerings at worship & special services
The Ushers shall care for the seating and comfort of the congregation, the greeting and
introduction of visitors, the prevention of interruptions and distractions and similar
needed services and that they have the proper supplies for visitors, such as a bulletin, ink
pen, and visitor cards. They are to help maintain the traffic during all church services.

Good morning Ashley, I am working on the permit renewal for Castle Hayne Baptist Church and read
that a designer's certification that the project was constructed in accordance with the approved plans
should be included with the application. Unfortunately, our church does not have any storm water
documents dating back to 2008. However, we will be providing the permit renewal as requested. I
hope this is sufficient.

I have attached a copy of the most recently issued permit as well as some documents that may help explain this process.
The letter you received from our office is for the parcel photographed on the GIS attachment. The most recently issued
permit for this site was in December 2008. At that time, these post construction state stormwater permits were renewed
every 10 years, giving the expiration date of 2019 as listed on the cover letter. Since then, the laws have changed and
they are now required to be renewed every 8 years. On August 5, 2009, the Governor signed Session Law 2009-406. This
law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of
the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The
law extended the effective period of any permit that was set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for
a total of four(4) years extension. This is the reason the letter lists the expiration date as 2023 instead of 2019 as you see
in the permit.
This permit is for the construction, operation, and maintenance of the wet detention pond shown on the parcel image. The
state stormwater permits also last in perpetuity and do not automatically transfer with the sale of property. However, the

GIS page shows that the parcel is still owned by Castle Hayne Baptist Church. The church also still holds the permit. Per
15A NCAC 02H. the current permit holder must be the permittee to renew the permit. Per Permit Condition 111.1 of the
2008 permit, this permit is not transferable without the approval of the Division. If the property has been sold, the Division
should have been notified at that time.
I have also attached the North Carolina Secretary of State business registration page for Castle Hayne Baptist Church. I
understand the church is considered a non-profit therefore is not required to file annually on the business registration
page however, we do use this page as official documentation of the officers and addresses. As shown in the NC SOS
attachment, the address listed on the webpage is 4535 Parmele Road. This explains why the letter was delivered to that
address instead of the 4544 address you stated below.

We received a letter from Christine Hall this week, dated 9/5/23 regarding the expiration of a storm
water management permit. The letter was mailed to our former address, 4535 Parmele Rd, Castle
Hayne, NC. This location was sold approximately 5 years ago. Our church has moved to 4544
Parmele Rd, Castle Hayne. We have no knowledge of the required permit and why we are being
charged for it. If this permit is for 4535 Parmele Rd, then we are no longer responsible for it. I have
worked at the church for almost nine years and have never been made aware of this permit. We
would need more details before we renew this permit and pay the $505 fee. However, it seems to me
that the new owners of 4535 Parmele Rd should be responsible for this.

The Wilmington Regional Office received and accepted a State Stormwater Management Permit Renewal
Application for the subject project on September 28`s, 2023. A preliminary in-depth review of that
information has determined that the application is not complete, and that additional information is needed.
To continue the review,please provide the following additional information in a single, hard cony
submittal package:
1. 15A NCAC 02H.1040(1)(a) and .]045(3)(a)(iii): The application was signed by Merle Graham;
however the provided documentation from the NC Secretary of State does not identify Merle
Graham as a principal executive officer of at least the level of vice president of this corporation.
In the case of a corporation, the application must be signed by a principal executive officer of at
least the level of vice-president. Please either:
a. Provide official documentation showing that Merle Graham is a principle executive
officer of at least the level of vice president and authorized to sign for the corporation.
b. Have one of the identified executives of the corporation sign the application documents;
or
c. The signature by other agents shall be accepted on the application only if accompanied by
a letter of authorization signed by the appropriate authority. Provide a letter of
authorization from one of the identified executives of this corporation authorizing Merle
Graham to sign on their behalf.
Please remember to confirm that any revised information is presented consistently throughout the
application documents. Please also remember to provide a hard copy of any updated documents per 15A
NCAC 02H.1045(3).
The requested information should be received in this Office by November 2",2023, in accordance with
15A NCAC 02H.1045(4)(a)(i).Please note that only two letters requesting additional information is
allowed in the State Stormwater Program, this being the first. If the required information is not
satisfactorily provided by this date,the project will be returned in accordance with 15A NCAC
02111045(4)(a)(ii). If the project is returned and you wish to re-submit later,you will need to resubmit
all required items at that time, including the application fee.

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Castle Hayne Baptist Church on November 11, 2008. Staff review of the plans
and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No.
SW8 980819 dated December 31, 2008, for the construction of the subject project.
This permit shall be effective from the date of issuance until June 16, 2019, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.
