The Wilmington Regional Office received a complete Stormwater Management Permit Renewal
Application for Hampstead Printing on September 30, 2009. The Division is hereby notifying you
that permit SW8 980719 has been renewed on October 16, 2009, and shall be effective until
April 20, 2019. The plans previously approved on April 20, 1999 have been revised on October
16, 2009 in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective
September 1, 1995. We are forwarding you an approved copy of the revised plans for your
files. Please replace the old approved plan sheets with the new ones. The plan revision includes
the following shift in impervious area:

This site was inspected on January 8, 2009. All deficiencies noted in the inspection report have ,
been addressed and the site is currently in compliance with the terms and conditions of this
renewed state stormwater permit.
Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of one wet pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications,
conditions and limitations:
1. The original permit conditions contained in the permit issued on April 20,
1999 remain in full force and effect, except as amended herein. (An additional
copy of this original permit can be obtained from the Division of Water
Quality, Wilmington Regional Office.)
2. This permit shall be effective from the date of issuance until April 20, 2019.
3. The permittee shall submit a,permit renewal application request at least 180
days prior to the expiration date of this permit. The renewal request must
include the applicable documentation and the processing fee.
4. Decorative spray fountains are not allowed in this wet detention pond
because the permanent pool volume is less than 30,000 cubic feet.
5. If the use of permeable pavement is desired, this permit must be modified to
add the permeable pavement conditions.

The Wilmington Regional Office received a State Stormwater Management Permit Renewal and Revision
Application for the project located at 16881 US Highway 17, Hampstead NC 28443 on July 28, 2009.
The Division of Water Quality has conducted a review of that information and determined that additional
information is necessary:
1. Please complete and return the enclosed renewal form.
2. Please add the dimensions to the proposed building, and submit two sets of revised plans.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to October 2, 2009.
If you need additional time to submit the information,please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90 days
from the receipt of a completed application to issue the permit.
Please reference the State assigned project number on all correspondence. Any original documents that
need to be revised have been sent to the engineer or agent. All original documents must be returned or
new originals must be provided. Copies are not acceptable. If you have any questions concerning this

Phil,
We received the renewal and revision request for this permit. It originally went to David Cox, but since it is a revision he
gave it to me to process in order to get one of the engineers to do the review. I noticed that Mr. Heffernan submitted a
name change form and noted that he wanted to renew his permit as opposed to submitting the standard renewal form
available at, http://h2o.enr.state.nc.us/su/bmp forms.htm.
Since so much time has elapsed I will go ahead and accept it for review and the review engineer will request the renewal
form. Also, FYI, we will need to plans to show all of the standard items including the dimensions of the impervious area.

Dear David:
We have reviewed the above site and find the pond to be in compliance with state
requirements in effect when the permit was issued, April 20, 1999. Our original design
included 67,262 sf of proposed impervious. Although not included in our original site
plan, we included in our design a future impervious area of 30,494 sf. Somehow the
second phase of the project was allowed to be constructed without further permitting.
Fortunately, the total impervious today, 60,116 sf, is within the original 1999 design. \
Please review the enclosed site plan, revised to include the facilities as they exist.

In reference to our phone conversation today regarding the Spring Branch Junction Stormwater
Compliance Inspection Report dated February 20, 2009, please be advised that I have taken the
necessary steps as outlined in the report to address the non-compliant issues of the inspection
performed on January 8, 2009.
As I stated in our phone conversation, I have hired Coastal Retention Pond Service (Tim Earley) to
advise and perform the work necessary to remedy the violations. I have also spoken with Phil Tripp
of Tripp Engineering about providing a copy of the original engineered plans and certificate to be
delivered to your office.

Dear Mr. Heffernan:.
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8980719
to Hampstead Printing for a High Density Stormwater Project on April 20, 1999. This permit expires on
April 20, 2009. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwaterrules) requires that
applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must
be accompanied by a processing fee, which is currently set at$505.00. If this is still an active project
please complete and submit the enclosed renewal application in a timely manner. If this project has not
been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing
address and phone number of the person or entity that is now responsible for this permit. Enclosed is a
form for change of ownership, which should be completed and submitted if the property has changed
hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

Referencing your letter of May 12, 2004, specifically addressing the numbered items on page 2:
#2) I contacted Mr. Phil Tripp, P.E. on,June 01 to prepare and submit a plan revision for
approval. If Mr. Tripp is unable to comply with our request in a timely fashion I will arrange to
retain another engineer.
#3) The slopes of the pond have already been weeded, hand raked and smoothed over. I plan to
install irrigation to that area within 30 days(as soon as I receive the contractor's plans and prices)
which should address the stabilization of the grass. Landscaping will be maintained weekly,
including cutting, fertilization and planting of appropriate trees.
#4) The orifice was unclogged the same day I spoke with Linda Lewis on June 01. Now that we
have been made aware of the 1-1/2" pipe in question we will inspect it monthly.
#5)As soon as Mr, Tripp (or a designated alternate)has completed his plan(see#2 above) he will
provide the required designer's certification of same.

Confirming our brief conversation prior to Thanksgiving and on Thursday, December 7, 2000,
financing arrangements have been made for the above referenced project. Subsequent to that we
have made good faith efforts to have the appropriate survey work done, and have made
arrangements with a local.contractor.
Notwithstanding initiall delays by the original surveyor and contractors, the survey work is being
done today by John Benson. Immediately upon completion of his field work, we have contracted
to have Van Robeson, of Robeson Construction, begin excavation of the pond site tomorrow,
December 12, 2000. Mr. Robeson plans to complete the pond in 2 - 3 weeks, weather permitting.
I hope this satisfactorily responds to your letter of October 16. Please contact me if there is any
additional information you may require. Thank you again for your guidance and patience in this
matter.

This will confirm receipt of your letter of August 3,as well as my two recent telephone conversations
with Mr. Edward Beck of your office.
At the time Spring Branch Junction was constructed, there were never any expectations to exceed
the one acre disturbed land limit. Based on this,no one had anticipated the need for a retention pond.
As discussed with Mr. Beck,there is no problem with my intent to comply with the existing statutes.
I have recently ascertained construction requirements, and have obtained estimates for that work.
However, due to the fact that the mortgage on Spring Branch Junction is already in place, and there
are no additional lines of credit available to me at this time,my only alternative is to refinance my loan
to proceed with the project. In light of current high interest rates and the lead time necessary to
arrange the appropriate financing,I respectfully request an extension of the compliance timetable by
six to twelve months.
Based on Mr. Beck's recommendations,I would also like to request a meeting to discuss the details
of my"plan of action" as well as the time table and applicable requirements under law.
