Financial problems are not considered to be a valid reason in defense of your inaction regarding getting the required detention pond built per the permit requirements and the approved plans It is not possible for the Division to exempt a commercial development from the stormwater regulations when the one acre disturbed limit has been exceeded, whether intentional or not. The permit for this shopping center and detention pond was issued in April, 1999. If there was a problem meeting the permit requirements, or a question about the terms or conditions, the permit allowed 30 days from the date of issue to adjudicate any term or condition. Since there was no adjudication, it was assumed that there was no question about the terms and conditions of the permit, and it was expected that the facility would be built in accordance with the approved plans in a timely manner. Please make the necessary arrangements to get the pond constructed within the next 60 days. Please inform this Office in writing of the expected construction schedule. To correct these violations you must 1. Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s) and a time frame for completion of those actions, on or before September 3, 2000. 2. Please construct the detention pond according to the approved plans and have it certified by a professional engineer immediately in order to protect surface waters of the State. 127 Cardinal Dr.Ext.,Wilmington,North Carolina 28405 Telephone 910-395-3900 FAX 910-350-2004 An Equal Opportunity Affirmative Action Employer 50% recycled/10% post-consumer paper Mr. Heffernan August 3, 2000 Stormwater Permit No. SW8 980719 ----------------------------------------------- Failure to provide the 'Plan of Action" by September 3, 2000, or to correct the violations by the date designated in the 'Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil and criminal penalties, pursuant to NCGS 143-215.6A.
