Guidelines for Access: The staff of the Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility
to the public to safeguard these records and to carry out our day-to-day program obligations.
Please read carefully the following before signing the form:
1: Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment for file review so you can be accommodated.
Appointments are scheduled between 9 00 a.m. and 3 00 p m Viewing time ends at 4 45
p.m. Anyone arriving without an appointment may view the files to the extent that time and
staff supervision are available.
2. You must specify files you want to review by facility name or incident number, as
appropriate. The number of files that you may review at one appointment will be limited to
five.
3- You may make copies of a file when the copier is not in use by the staff and if time permits.
There is no charge for 25 or less copies cost per copy after the initial 25 is 2.5 per copy
Payment is to be made by check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received them. Files may not be taken from the office:
No briefcases large totes etc are permitted in the file review area To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00.
5.. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo ID, sign-in, and receive a visitor sticker prior to
reviewing files.

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection Report".
The report summarizes the findings of a recent inspection of the project's stormwater controls conducted
on January 8, 2009 to determine compliance with Stormwater Permit Number SW8 980719 issued on
April 20, 1999.
The required actions that are necessary to bring this site into compliance are noted on the attached
inspection report. Please inform this Office in writing before March 20, 2009, of the specific actions that
will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the assessment of
civil penalties of up to$10,000 per day.
As indicated in the attached inspection report the following issues must be resolved:
1. Submit an application for a modification to the stormwater permit that includes any changes since
the original permit was issued including increased built-upon area.
2. Submit the Engineers Certification that was required once construction has been completed and
prior to issuance of a Certificate of Occupancy.
Please be reminded that if any ownership or name change has occurred it is the permittee's responsibility

Dear Mr. Heffernan:
On May 5, 2004, Wilmington Regional Office personnel performed a Compliance
Inspection of the subject project, located at US 17 South in Hampstead, pender County,
North Carolina. The inspection was performed to determine the status of compliance
with Stormwater Permit Number SW8 980719, issued to you on April 20, 1999.
The project has been found in violation of Stormwater Permit Number SW8 980719 ,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section 11.13- The following items will require a modification to the permit-
(d) redesign or addition to the approved amount of built-upon area.
Additional built-upon area has been constructed at this site, but a permit
modification has neither been submitted or approved.
2. Section 11.3- The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater system
functions at optimum efficiency. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to: (c) mowing
and revegetation of side slopes; (d) immediate repair of eroded areas; (0
debris removal and unclogging of the outlet structure, orifice device, catch
basins and piping.
The east slope of the pond has stabilization problems and the orifice is
clogged.
3. Section 11.7- Upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, a
certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in
accordance with this permit, the approved plans and specifications and
other supporting documentation. Any deviation from the approved plans
and specifications must be noted on the Certification.

To correct these violations you must
1. Provide a written "Plan of Action" which outlines the actions you will take
to correct the violations and a time frame for completion of those actions,
on or before June 12, 2004.
2. Submit a plan revision for approval. The Division must verify that all built-
upon area from the new phase is directed into the pond in a manner that
does not short-circuit the pond, and that the amount of built-upon area
does not exceed the permitted maximum for the pond.
3. Repair and revegetate the slopes of the pond and provide a healthy
permanent stand of grass cover.
4. Perform routine maintenance and unclog the orifice.
5. Provide the required designer's certification.
Failure to provide the "Plan of Action" by June 12, 2004, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Pender County Building Inspector, this Office is requesting
that the Building Inspector consider withholding building permits and Certificates of
Occupancy for this project until this matter is satisfactorily resolved.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
2. The drainage area to the system contains no more than the permitted
amount of built-upon area.
3. All the built-upon area associated with the project is graded such that the
runoff drains to the system.
4. The outlet/bypass structure elevations are per the approved plan.
5. The outlet structure is located per the approved plans.
6. Trash rack is provided on the outlet/bypass structure.
7. All slopes are grassed with permanent vegetation.
8. Vegetated slopes are no steeper than 3:1.
9. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
10. The permitted amounts of surface area and/or volume have been
provided.
11. Required drawdown devices are correctly sized per the approved plans.
12. All required design depths are provided.
13. All required parts of the system are provided, such as a vegetated shelf,
and a forebay.
14. The dimensions of the system, as shown on the approved plans, are
provided.

STORMWATER COMPLIANCE INSPECTION REPORT

Water Body: Old Topsail Creek Classification: SA
Directions to site, address: Off Highway 17 in Hampstead,just south of Country Club Road.
2. Inspection Date: May 24, 2001
Weather Conditions: sunny, warm
3. Compliance Issues:
a. The pond slopes are in need of grass stabilization. Many bare areas and areas of erosion are
evident.
b. The outlet structure needs a trash rack.
C. An additional unapproved inlet to the pond has been created
d. The future building will need to be submitted and permitted prior to construction.
e. The required designer's certification has not been submitted.
4. Required Actions:
a. Please seed/sod the slopes to establish a vigorous vegetative growth.
b. Please provide a trash rack, per the approved plans.

d. Please submit grading and dimension plans for the future building,indicating that the proposed
BUA is within the allotted future amount, and that the runoff is directed to the forebay of the
pond.

Dear Mr. Heffernan:
The Division of Water Quality received your letter regarding the permitted detention pond at Spring
Branch Junction, in which you request an additional 6-12 months to construct the required detention pond, due
to financing problems. Financial problems are not considered to be a valid reason in defense of your inaction
regarding getting the required detention pond built per the permit requirements and the approved plans It is not
possible for the Division to exempt a commercial development from the stormwater regulations when the one
acre disturbed limit has been exceeded, whether intentional or not.
The permit for this shopping center and detention pond was issued in April, 1999. If there was a problem
meeting the permit requirements, or a question about the terms or conditions, the permit allowed 30 days from
the date of issue to adjudicate any term or condition. Since there was no adjudication, it was assumed that there
was no question about the terms and conditions of the permit, and it was expected that the facility would be
built in accordance with the approved plans in a timely manner.
Please make the necessary arrangements to get the pond constructed within the next 60 days. Please
inform this Office in writing of the expected construction schedule. If you have any questions, please do not

Dear Mr. Heffernan:
On August 1, 2000, Wilmington Regional Office personnel performed a Compliance Inspection of
the project known as Hampstead Printing at Spring Branch Junction, located 6865 US Hwy. 17 North
Hampstead, NC in Pender County,North Carolina. The inspection was performed to determine the status
of compliance with Stormwater Permit Number SW8 980719, issued to Mr. Douglas P. Heffernan on
April20, 1999.
The project has been found in violation of Stormwater Permit Number 980719, issued pursuant to
the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section II. No. 1. The stormwater management system shall be constructed in it's entirety,
vegetated and operational for its intended use prior to the construction of any built-upon
surface except roads. The State Stormwater Permit No. SW8 980719 for this project was
issued on April 20, 1999, since this time no treatment system, i.e. detention pond, has been
constructed to treat runoff from this development.
To correct these violations you must
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation(s) and a time frame for completion of those actions, on or before September 3,
2000.
2. Please construct the detention pond according to the approved plans and have it certified by
a professional engineer immediately in order to protect surface waters of the State.

Failure to provide the 'Plan of Action" by September 3, 2000, or to correct the violations by the
date designated in the 'Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result
in the initiation of enforcement action which may include recommendations for the assessment of civil
and criminal penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Pender County Building Inspector, this Office is requesting that the
Building Inspector consider withholding building permits and Certificates of Occupancy for this project
until this matter is satisfactorily resolved.

Dear Mr. Heffernan:
On July 7, 1998, personnel of this office inspected a project located on Hwy 17 in Hampstead
in Pander County, North Carolina. This inspection was performed to determine compliance with the
North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land-disturbing
activity of approximately 1.2 acres being conducted.
It is our understanding that you are responsible for this land-disturbing activity. The purpose
of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 1 13A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If'you feel that you are not
responsible for the following violations, please notify this office immediately.
I , The violations that were found are:
1. Failure to file an erosion and sedimentation control plan with this office at least 30 days prior
to beginning a land-disturbing activity on a tract comprising more than one acre, when more
than one acre is to be uncovered, failure to secure this office's prior approval of the plan for
any land-disturbing prior to beginning the land-disturbing activity. NCGS 1 13A-57(4) and 15A
NCAC 4B.0007(c).
A land-disturbing activity greater than one acre in size is taking place without an approved
erosion and sedimentation control plan. (1.2 acres)
An acceptable erosion and sedimentation control plan must be filed with and approved by this
office and implemented on the site sufficient to prevent off-site sedimentation. Temporary
measures must be provided immediately to control erosion and prevent sedimentation damage.
Any additional land-disturbing activities conducted without an approved erosion and
sedimentation control plan will constitute additional violations of the Act. We will notify you
following our review of the plan if additional measures are required.

2. Failure to take all reasonable measures to protect all public and private property from damage
by such land-disturbing activities. 15A NCAC 46.0005.
Sedimentation and erosion potential exists, especially from building and parking lot runoff.
To correct these violations, you must:
1. Submit an erosion and sedimentation control plan to this office for the reference project.
2. Install erosion control measures to curb erosional processes.
Please be advised that if these violations are not corrected within 30 days of receipt of this
notice, the Director, Division of Land Resources, will be requested to take appropriate legal action
against you pursuant to NCGS 1 13A-64. That action could be the assessment of a civil penalty and
the amount may be up to $500 per day for each day of the violation. The penalty may be assessed
from the date of your receipt of this Notice of Violation. (15A NCAC 4C.0007). If these violations
are corrected within the time period specified for compliance, no further legal action will be pursued.
Please be advised that any new land-disturbing activity associated with this project must not
begin until the area presently disturbed is brought into compliance with the Act. When corrective
actions are complete, you should notify this office so the work can be inspected. You should not
assume that the property is incompliance with the Act until we have notified you. After installation,
all erosion control measures must be maintained in proper working order until development is complete
and the site is completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the
same time, it is your responsibility to understand and comply with the requirements of the Act. Copies
of the relevant statute and administrative rules may be examined at this office or will be sent to you
upon request. Should you have questions concerning this Notice or the requirements of the Act,
