On November 6, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected Carleton Place in New Hanover County to determine the
status of compliance with the State Stormwater Management Permit Number SW8 970314
issued on July 9, 1997. DEMLR file review and site inspection revealed that the site is
compliant with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of
the recent inspection
Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including operation and maintenance of
your permitted stormwater system. Violations of your Stormwater Management Permit may be
subject to the assessment of civil penalties of up to $25,000 per day per violation.
If the project has changed its name, ownership, or mailing address, it is your responsibility to
submit a completed and signed Name/Ownership Change form to DEMLR at least 30 calendar
days prior to making the changes. Please include the name, mailing address and phone
number of the person or entity that is now responsible for this permit on the Name/Ownership

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in

1. Your permit expired on February 25, 2008. To date, this Office has not received your renewal request. You are reminded that
the operation of a stormwater system without a valid permit is a violation of NC General Statute 143-215.1 and may result in
appropriate enforcement action including the assessment of civil penalties of up to $10,000.00 per day.
2. We have an Engineer's Certification for Pond #1 but not for pond #2. You must submit this with your renewal request.
3. There are some areas on both ponds that still have small areas of erosion.
4. Sediment levels in both forebays should be checked to see if they need to be mucked out.
S. The sideslopes in pond #2 appear to be greater than a 3:1. Please verify.
6. New Operation & Maintenance forms must be submitted with your renewal request. There should be one filled out for each
pond.
7. The outlet structures in both ponds appear different than what was on the approved plans. Pond #1's orifice was extended
and lowered. Pond #2's orifice could not be seen on the pond side. There was also no bypass weir on the structure. '

Dear Mr Shiver:
This letter is in response to your certified letter concerning the "Notice of
Violation" for Carleton Place received earlier this month. Since your letter we have
already started taking action on your addressed concerns as follows:
Plan of Action
1. Discussed the letter and desired time frame with Gary Beecher per a phone
conversation. He indicated that he would like everything done within 5 or 6 months.
We should easily exceed this time frame.
2. Met with Phil Tripp, the original site engineer, to walk and observe drainage and
other issues as mentioned in your letter. He will assist as needed and said he did not
see any problems. He will assist with providing any information as requested on a
revised plan that will show building changes, impervious changes, swale changes, and
pond depths and calculations.
3. The ponds have been mowed and added to the landscape maintenance program.
4. We have worked with the unit owners of the building that the complaint was filed
from to re-establish the swells. Several unit owners had altered swells after they
moved in without permission that had affected drainage in the rear of a couple of
yards in that building.

5. We are adding a general information letter to the closing packages of new unit sales
briefly explaining the common area policies, drainage issues and other concerns as
outlined in the restrictive covenants.
6. We have started to add sod in all rear yards of the new units to make owners less
likely to change grades. This will also help with erosion control.
7. The homeowners general rule package has been updated to also include common
areas and drainage concerns as per the restrictive covenants.
8. We have implemented a more thorough inspection policy for site operation and
maintenance through the Homeowners Association. Monthly inspections have been
taking place for a good while.
9. The HOA will be glad to assist with inspections as requested with a 30 day notice to
allow ample time to have people to unlock gates,to allow access to rear yard areas as
needed.
10. Phase III is not under construction yet, so we cannot install swells as requested.
When we construct this phase we will certainly install the swells.
In closing, we will work to address all of your concerns in a timely matter and within
the desired deadline or no later than March 30,2005. If there is anything else we can do
to accommodate you on this matter please let us know. Thanks for your time in this
matter and we will assure you the utmost cooperation on our part.

Grading Permit Number: 18-97 - Carleton Place
Site Location: Carleton Place on College Acres Drive
Location/Description of Violation(s): Land disturbing activity has been done outside the
approved limits of construction on the utility easement and along College Acres Drive.
Dear Mr. Blanton:
This letter constitutes Notice of Violation of Section 7-18(b) and Section 7-5(b) of New
Hanover County's Soil Erosion and Sedimentation Control Ordinance.
Section 7-18(b) Erosion and Sedimentation Control Plans states:
Persons conducting land-disturbing activity on a tract which covers one or more acres
shall file three copies of the erosion control plan with the County at least 30 days prior to
beginning such activity and shall keep another copy of the plan on file at the job site.
After approving the plan if the County either upon review of such plan or on
inspection of the job site determines that a significant risk of accelerated erosion or
off-site sedimentation exists. the County will require a revised plan. Pending the
preparation of the revised plan work shall cease or shall continue under conditions
outlined by the appropriate authority.
Section 7-5(b) Protection of Property states:
Persons conducting land disturbing activity shall take all reasonable measures to protect
all public and private property from damage caused by such activity.

Corrective measure(s) needed- Install silt fence along the utility line adjacent to the creek
within two (2) days and stabilize this area immediately. Resubmit revised plans within fifteen
(15) days of receipt of this letter.
Time to Comply Two (2) days to install the silt fence and fifteen (15) days to submit
revised plans.

Chestnut Street, Wilmington, North Carolina 28401, [phone], regarding the required
compliance action.
Your failure to take the above noted corrective action within the above time period will
result in assessment of a civil penalty, or other enforcement action, pursuant to Section 21(A)(1)
of New Hanover County's Soil Erosion and Sedimentation Control Ordinance.
