To date, this Office has not received your renewal request. You are reminded that the operation of a stormwater system without a valid permit is a violation of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000.00 per day. 2. We have an Engineer's Certification for Pond #1 but not for pond #2. You must submit this with your renewal request. 3. There are some areas on both ponds that still have small areas of erosion. 4. Sediment levels in both forebays should be checked to see if they need to be mucked out. S. The sideslopes in pond #2 appear to be greater than a 3:1. Please verify. 6. New Operation & Maintenance forms must be submitted with your renewal request. There should be one filled out for each pond. 7. The outlet structures in both ponds appear different than what was on the approved plans. Pond #1's orifice was extended and lowered. Pond #2's orifice could not be seen on the pond side. Since your letter we have already started taking action on your addressed concerns as follows: Plan of Action 1. Discussed the letter and desired time frame with Gary Beecher per a phone conversation. He indicated that he would like everything done within 5 or 6 months. We should easily exceed this time frame. 2. Met with Phil Tripp, the original site engineer, to walk and observe drainage and other issues as mentioned in your letter. He will assist as needed and said he did not see any problems. He will assist with providing any information as requested on a revised plan that will show building changes, impervious changes, swale changes, and pond depths and calculations. 3. The ponds have been mowed and added to the landscape maintenance program. 4. We have worked with the unit owners of the building that the complaint was filed from to re-establish the swells. Several unit owners had altered swells after they moved in without permission that had affected drainage in the rear of a couple of yards in that building. Page 2 5. We are adding a general information letter to the closing packages of new unit sales briefly explaining the common area policies, drainage issues and other concerns as outlined in the restrictive covenants. 6. We have started to add sod in all rear yards of the new units to make owners less likely to change grades. This will also help with erosion control. 7. The homeowners general rule package has been updated to also include common areas and drainage concerns as per the restrictive covenants. 8. We have implemented a more thorough inspection policy for site operation and maintenance through the Homeowners Association. Monthly inspections have been taking place for a good while. 9. The HOA will be glad to assist with inspections as requested with a 30 day notice to allow ample time to have people to unlock gates,to allow access to rear yard areas as needed. 10. Phase III is not under construction yet, so we cannot install swells as requested. When we construct this phase we will certainly install the swells. In closing, we will work to address all of your concerns in a timely matter and within the desired deadline or no later than March 30,2005. If there is anything else we can do to accommodate you on this matter please let us know.
