Dear Linda:
We are in receipt of your February 26, 1999 correspondence. In response to your
comments, we offer the following:
1. The correct grate is now in place. We have learned from our discussion with the
contractor that the original grate, which did satisfy the permit requirements, was
broken after our certification inspection. It was mistakenly replaced with a fully
open grate without our knowledge. Upon notification from our office, the correct
replacement grate was obtained and installed.
2. The installation at the time of inspections satisfied state requirements.
Unfortunately, we were unaware of the change.
We trust this will satisfy the violation. Please contact us with questions, comments or
if you require additional information. Thank you.

Dear Mr. Korman:
On February 25, 1999, Wilmington Regional Office personnel performed a Compliance Inspection
of the project known as Craft Hardware, located at 7002 Wrightsville Avenue, across from Plaza East,
Wilmington in New Hanover County, North Carolina. The inspection was performed to determine the
status of compliance with Stormwater Permit Number SW8 970218, issued to you on August 15, 1997.
The project has been found in violation of Stormwater Permit Number 970218, issued pursuant to
the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section II, No. 4- Failing to construct the project in accordance with the approved plans. A
closed grate, as required by the approved plans, has not been provided over DI-2. Some of
the runoff from the parking area entering the drop inlet is allowed to bypass prior to being
treated in the infiltration trench. The amount of runoff entering on this side of the grate has
the potential to be a large quantity, based on the approved site grading. The water level in
DI-2 has just at the bottom of the overflow, so the next rain event will immediately begin
discharging through the bypass.
2. The Engineer's Certification for this project has been received. The situation as described
in Item #1 above should have been caught and remedied at the time of that inspection. The
State will now consider what action, if any, will be taken against the engineer.

To correct these violations you must
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation and a time frame for completion of those actions, on or before March 26, 1999.
2. Immediately provide the 1/2 solid 1/2 grated cover over DI-2, as specified on the approved
plans. The solid side of the grate goes over the side of the inlet that has the large bypass
piping to the swale along the southeast side of the project.
Failure to provide the 'Plan of Action" by March 26, 1999, or to correct the violations by the date
designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in
the initiation of enforcement action which may include recommendations for the assessment of civil and
criminal penalties, pursuant to NCGS 143-215.6A.

COMMENTS: (each NO answer should have a comment)
The following items were noted during a file review and site visit;
1. Your permit expired on August 15, 2007. This office has received your request for renewal, however during the site visit it was
noted that what was constructed was not what was permitted or approved on your plans.
2. The built upon area was increased with the addition of parking spaces on the left side of the building and eliminating a 3:1
swale in the 22' buffer that was shown on the plans.
3. Additional impervious was added by placing trailers (the large tractor-trailer type) on the grass at the edge of the pavement.
Also, large items were stored on the grassed areas.
4. The swale in the back left corner appeared to be modified and little or no Swale was left.
5. The plans showed a pad for the dumpster in the right rear corner of the building, however, a dumpster was located on the
grass on the left side.
6. The grassed area 22' buffer on the right side had items stored on it also.
7. No maintenance records were available on the inspection date.
B. As per your permit any revision to the approved plans regardless of size redesign or addition to the approved amount of built-
upon area or filling in altering or piping of any vegetative conveyance shown on the approved plan requires a modification to
your permit This office has not received a request for any modification to your site.
