Residence on April 30, 2001. Staff review of the plans and specifications has determined that the project, as
proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000. We are forwarding
Permit No. SW8 970141 Modification dated June 26, 2001, for the construction of Ladd Nelson Residence.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein, and does not supercede any other agency permit that may be required.
If any parts,requirements,or limitations contained in this permit are unacceptable,you have the right to request an
adjudicatory hearing upon written request within thirty(30)days following receipt of this permit.This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh,NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes
of 3:1 (H:V) as defined in the stormwater rules and approved by the Division.
5. No piping is allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access.
6. Unless specified elsewhere,permanent seeding requirements forthe swales must followthe guidelines established in
the North Carolina Erosion and Sediment Control Planning and Design Manual.
7. Roof drains must terminate at least 30' from the Mean High Water line.

2. The permittee is responsible for verifying that the proposed built-upon area does notexceed the allowable built-Upon
area.
3. The Director in aynotifythe permitteewhen thepermitted site does not inectone or more of the minimum requirenicrits
of the permit. Within the time frame specified in the notice,the permittee shall submit a written time schedule to the
Director for modifyingthe site to meet minimum requirements.The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
4. Prior to the sale ofthis project,in whole or in part,the following deed restrictions must be recorded with the Office of
the Register of Deeds and submitted to DWQ:
a. "Construction ofadditional built-upon area inexcessof19,925 square feetwillrequireapermilmodification."
b. "Construction of additional impervious areas such that low density requirements are no longer met must be
submitted to DWQ and a permit modification must be issued prior to construction.An engineered system will
be required to collect and treat the runoff from all built-upon area associated with the project, includingthat
area permitted under the low density option."
C. "Filling in or piping of any vegetative conveyances(ditches,swales,etc.)associated with this development,
except for average driveway crossings, is strictly prohibited by any persons."
d. "A minimum of 30' of vegetated buffer area shall be provided between surface waters and all impervious
surfaces."

6. Projects within CAMA's Areaof Environmental Concern(AEC)are subjecttoa reduction ofthe permitted aIllOUlu Of
built-upon area due to CAMA jurisdiction within the AEC.
7. A copy of the recorded restrictions must be received by this Office within 30 days of the date of sale.
8. The following items will require a modification to the permit. Revised plans,specifications and calculations must be
permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of sire.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision,acquisition,or sale ofthe project area.The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
9. The Director may determine that other revisions to the project should require a modification to the permit.
10. Swales and other vegetated conveyances shall be constructed in their entirety,vegetated,and be operational for their
intended use prior to the construction of any built-upon surface.

C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
13. Within 30 days ofcompletion ofthe project,the perinittee shall certify in writ ing that the project has been constructed
in accordance with the approved plans.
14. Thepennitteeshallsubmitall information requested bytheDirectororhisrepresentativewithin the time framespccif ed
in the written information request.
Ill. GENERAL CONDITIONS
I. Failureto abide by the conditions and limitationscontained inthis permitruaySUbjcctthc Pennittecto an enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-
215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance, or termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and
reissuing the permit,or terminating the permit as allowed by the laws,rules,and regulations contained in Title 15A of
the North Carolina Administrative Code, Subchapter 211.1000;and North Carolina General Statute 143-215.1 ct.al.
5. The permit is not transferable to any person except after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. A formal permit request must be submitted to the Division of Water Quality
accompanied by the appropriate fee,documentation from both parties involved,and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits, and may or may not be approved.
6. The permittee grants permission to DENR Staffto enter the property for the purpose of inspecting all components of
the stormwater management facility.
7. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days.
8. The issuance ofthis permit does not preclude the Permittee from complyingwith anyand all statutes,rules,regulations,
or ordinances which may be imposed by other government agencies(local,state and federal)which havejurisdiction.

collection system as defined by 15A NCAC 2H .1002(18). Low density requirements and density factors can

]'his letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is
considering sending a recommendation for enforcement action to the Director of the Division of Water Quality.
The recommendation concerns the violation of North Carolina General Statute NCGS 143-215.6A(2); Failing to
apply for or secure, and/or act in accordance with the terms, conditions, or requirements of a permit required by
NCGS 143-215.1. You have failed to respond to a request for a Stormwater Management Permit Application
regarding the modification to the project, sent to you on July 7, 2000.
If you have an explanation for this violation that you wish to present,please respond in writing to me within
ten (10) days following receipt of this Notice. Your explanation will be reviewed and if an enforcement action is
still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his
consideration.
By copy of this letter to the Building Inspector,this Office is requesting that the Building Inspector consider
withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily
resolved.

Formerly Inlet Point Harbour Subdivision (Section 111)
New Hanover County, NC
The total drainage area of this project is 10.34 acres, of which 9.44 acres is from the old
subdivision and an additional 0.9 acre is on an adjacent lot containing the residence. This
project was a proposed residential subdivision of 19 lots. The previous plan is now being
abandoned in favor of one residential lot. An asphalt roadway of 12,000 sf is existing. In
addition are an existing driveway and walk of 2560 sf, existing residence of 3800 sf,
proposed garage of 1500 sf, and existing pump-house of 65 sf for a total impervious area
of 19,925 sf There is no curb and gutter. We calculate an impervious built upon area of
4.5%. This site drains to Myrtle Grove Sound. The classification of this area is SA.

This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is
considering sending it recommendation for enforcement action to the Director of the Division of Water Quality.
The recommendation concerns the violation of North Carolina General Statute NCGS 143-215.6A(2); Failing to
apply For or secure, and/or act in accordance with the terms, conditions, or rcquircments of a permit required by
NCGS 143-215.1. You have failed to respond to a request for a Stormwater Management Permit Application
regarding the modification to the project, sent to you on July 7, 2000.
If you have an explanation for this violation that you wish to present, please respond in writing to me within
tell (10) days following receipt of this Notice. Your explanation will be reviewed and if an enforcement action is
still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his
consideration.
By copy of this letter to the Building Inspector,this Office is requesting that the Building Inspector consider
withholding building permits and Certificates of Occupancy for this pro:eei milli tills Inatler Is satisfactorily

On February 18, 1998,you received a Storm water Management Permit fora 19 lot single family subdivision
known as Inlet Point Harbor,Phase lll.The entire subdivision;except for 4 lots,has since been sold to Myrtle Grove
Properties, LLC. I talked to you several months ago to request that you submit a stormwater permit modification
for the subdivision, and I talked with the new owners and requested they submit a new permit application for the
property they purchased from you. To date, neither party has submitted an application.
I have today sent a Notice of Intent to Enforce to Myrtle Grove Properties, and have placed Inlet Point on
administrative hold at this time, pending receipt of a modified application from you. Please respond to this letter
by April 5, 2001, with either an expected date of submittal, or a complete application, or you will be subject to
enforcement action, pursuant to NCGS 143-215.6A. A completed application will include 2 sets of plans
(topographic and layout) showing the street and the 4 remaining lots, a completed application and low density
supplement. a copy of the recorded deed restrictions, and the application fee of$420.00.
