SCHEDULE OF COMPLIANCE 1. The offsite stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built-upon surface associated with this project. 2. During construction,erosion shall be kept to a minimum and any eroded areas ofthe.system will be repaired immediately. 3. Wal-Mart Stores, Inc., shall at all times provide the operation and maintenance necessary to assure the permitted stormwater management system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety, and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, drawdown device, catch basins and piping. L. Access to the outlet structure must be available at all times. 4. The permittee is responsible for keeping the collection system on the lot clear of debris,and keeping the site stabilized.. 5. Wal-Mart Stores, Inc., must keep records of maintenance activities make them available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken: 6. Any deviations from the approved plans and specifications must be noted on the Certification. 8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 9. This lot is limited to the amount of built-upon area indicated in the supporting calculations and per approved plans. The project must have a built-upon area less than or equal to the amount permitted under Stormwater Permit#SW8 990421. Additional built-upon area will require a modification to the overall Permit. 10. Wal-Mart Stores, Inc., must record any deed restrictions as required by their permit , and they must verify that the proposed built-upon area does not exceed the allowable built-upon area. Once the lot transfer is complete; the built-upon area may not be revised without approval from the permittee, and responsibility for meeting the built-upon area limit is transferred to the individual property owner. 11. The drainage features shown as a part of the stormwater management system on the approved plan shall not be filled in, altered, or piped by any party without first submitting a revision to the permit and receiving approval from the Division. 4 I State Stormwater Management Systems Permit No. SWS 960701 Modification 12. The following items will require a modification to this permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area. e. Further subdivision, acquisition or selling of the project area. The project area is defined as all i property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 13. The Director may determine that other revisions to the project should require a modification to the permit. 14. The Directc: may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or 1 may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The permit may be modified; revoked and reissued or terminated for cause. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches at any time. 2. Accumulated sediment and trash will be removed from the collection system as necessary. Swales and ditches will be reseeded or sodded following sediment removal. 3. Eroded areas of swales and ditches will be repaired and reseeded. Swales and ditches will be revegetated as needed based on monthly inspections. 4. The collection system, including catch basins, curb cuts, velocity reduction devices, and piping, will be inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts, velocity reduction devices, and piping. 5. The collection system may not be altered in any way without prior approval from NCDENR Division of Water Quality. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: l. The original Wal-Mart permit allotted a total of 74,000 square feet for Bob King Boulevard, which included the entire road, both on the Wal-Mart tract and on this tract, and sidewalks. Originally, this road was fairly straight and was proposed to be located down the south side of the King tract, but has since been curved around to run down the north side of the tract, adding street length. After scaling both street parts on this plan and the original approved Wal-Mart plan, a total of 76.551 ft2 is proposed for the street, which exceeds the permitted amount. The 201,700 ft2 proposed for the actual tract development is about 46,400 ft2 less than the permitted amount. Are you willing to transfer BUA from the tract allotment of 248,100 to cover the 2,551 ft2 overage in the street in order to expedite this permit? 2. We have revised our plans to show the hardstand area to remain "as is" and the removal of the 15"outlet structure and piping. The owner desires to begin clearing and grading in the near future. He understands that no new impervious area or modifications to the existing pond will be allowed until the new Wa1Mart pond is completed and certified. The tract is bounded by road rights-of-way to the north and west, office uses to the south, and commercial properties to the east. The tract is essentially flat with medium sized pine trees and small oaks. The project is primarily new development consisting of clearing, grading, and construction of a 14,000 square foot car sales and repair building and a 9,400 square foot truck facility with associated parking areas. Total impervious area for the site is 201, 700 square feet, or 78%. Six acres will be disturbed by the construction work. Approximately 2.2 acres is existing impervious surface draining to an existing pond permitted under SW8 960701. STORMWATER MANAGEMENT MEASURES Runoff will be collected in curb inlets and roof drains and piped to an proposed regional detention pond serving the Wal-Mart development (SW8 990423). That pond is designed for 90% TSS removal in accordance with state regulations. Allowable impervious coverage for this site is 85%. The existing pond will not be removed from service until the new off-site pond is completed. The grading contractor and developer will provide maintenance during construction.
