The Wilmington Regional Office received a complete modification to the Stormwater Mana0ement Permit
Application for Bob King VW GMC Truck Center on May 17, 2000. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A
NCAC 2H.1000. We are forwarding PermitNo.SW8 960701 Modification,dated July 7,2000,forthe construction
of Bob King VW GMC Truck Center.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein.
If any pans,requirements, or limitations contained in this permit are unacceptable,you have the right to request an
adjudicatory hearing upon written request within thirty(10)days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh,NC 27611-7447. Unless such demands

Il. SCHEDULE OF COMPLIANCE
1. The offsite stormwater management system shall be constructed in it's entirety, vegetated and operational
for its intended use prior to the construction of any built-upon surface associated with this project.
2. During construction,erosion shall be kept to a minimum and any eroded areas ofthe.system will be repaired
immediately.
3. Wal-Mart Stores, Inc., shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater management system functions at optimum efficiency. The approved Operation and
Maintenance Plan must be followed in its entirety, and maintenance must occur at the scheduled intervals
including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, drawdown device, catch basins and piping.
L. Access to the outlet structure must be available at all times.
4. The permittee is responsible for keeping the collection system on the lot clear of debris,and keeping the site
stabilized..
5. Wal-Mart Stores, Inc., must keep records of maintenance activities make them available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the
work and what actions were taken:
6. This permit shall become voidable unless the facilities are constructed in accordance with•the conditions of
this permit, the approved plans and specifications, and other supporting data.

to operation of the permitted stormwater management facility, a certification from an appropriate designer
for the system installed, certifying that the permitted facility has been installed in accordance with
Stomtwater Permit #SW8 990421, the approved plans and specifications, and other supporting
documentation. Any deviations from the approved plans and specifications must be noted on the
Certification.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
of ten years from the date of the completion of construction.
9. This lot is limited to the amount of built-upon area indicated in the supporting calculations and per approved
plans. The project must have a built-upon area less than or equal to the amount permitted under Stormwater
Permit#SW8 990421. Additional built-upon area will require a modification to the overall Permit.
10. Wal-Mart Stores, Inc., must record any deed restrictions as required by their permit , and they must verify
that the proposed built-upon area does not exceed the allowable built-upon area. Once the lot transfer is
complete; the built-upon area may not be revised without approval from the permittee, and responsibility
for meeting the built-upon area limit is transferred to the individual property owner.
11. The drainage features shown as a part of the stormwater management system on the approved plan shall not
be filled in, altered, or piped by any party without first submitting a revision to the permit and receiving
approval from the Division.

12. The following items will require a modification to this permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition or selling of the project area. The project area is defined as all
i property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
13. The Director may determine that other revisions to the project should require a modification to the permit.
14. The Directc: may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the Division of Water
Quality accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
1 may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,rules,

4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
Wal-Mart Stores, Inc., shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement stormwater management systems.
The penninee grants pe;mission for DENR Staff to enter the property for the purpose of inspecting ail
components of the permitted stormwater management facility.
6. The permit may be modified; revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuanee or termination does not stay any permit condition.

Impervious materials include asphalt,gravel,concrete,brick,stone,slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in,piped,or altered except as necessary to provide driveway crossings.
4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.

IV. STORMWATER COLLECTION SYSTEM MAINTENANCE REQUIREMENTS
1. Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time.
2. Accumulated sediment and trash will be removed from the collection system as necessary. Swales and
ditches will be reseeded or sodded following sediment removal.
3. Eroded areas of swales and ditches will be repaired and reseeded. Swales and ditches will be revegetated
as needed based on monthly inspections.
4. The collection system, including catch basins, curb cuts, velocity reduction devices, and piping, will be
inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be
cleared away from grates, curb cuts, velocity reduction devices, and piping.
5. The collection system may not be altered in any way without prior approval from NCDENR Division of
Water Quality.

Dear Mr. King:
The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for Bob King VW /GMC Truck Center on April 19, 2000. A preliminary
review of that information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
l. The original Wal-Mart permit allotted a total of 74,000 square feet for Bob King Boulevard,
which included the entire road, both on the Wal-Mart tract and on this tract, and sidewalks.
Originally, this road was fairly straight and was proposed to be located down the south side of the
King tract, but has since been curved around to run down the north side of the tract, adding street
length. After scaling both street parts on this plan and the original approved Wal-Mart plan, a
total of 76.551 ft2 is proposed for the street, which exceeds the permitted amount. The 201,700 ft2
proposed for the actual tract development is about 46,400 ft2 less than the permitted amount. Are
you willing to transfer BUA from the tract allotment of 248,100 to cover the 2,551 ft2 overage in
the street in order to expedite this permit?
2. Prior to putting down any impervious surface, please follow the Sedimentation Erosion Control
permit conditions and approved plans.

the date by which you expect to submit the required information. The Division is allowed 90 days from the
receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original documents that
need to be revised have been sent to the engineer or agent. All original documents must be returned or new

Dear Linda:
Attached for your review are three copies of revised plan sheet C-1 for this project. The
revisions address your comments of February 9, 2000.
We were not clear in the project delineation on the previous submittal. Work within the
public rights-of-way is being permitted and constructed as a part of the Wal-Mart project.
We have revised our plans to show the hardstand area to remain "as is" and the removal
of the 15"outlet structure and piping.
The owner desires to begin clearing and grading in the near future. He understands that
no new impervious area or modifications to the existing pond will be allowed until the
new Wa1Mart pond is completed and certified.

The Wilmington Regional Office received a Stormwater Management Permit Application for Bob King
Volkswagon/GMC Truck Center on January 7,2000. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater review:
1. Is Bob King Boulevard included in the proposed 201,700 square feet ofBUA?Since it is shown
on the plans,and the collection system within the right-of-way is critical to this project,I would
assume that it was.
2. Please note on the plans what is to be done with the existing 15" outlet structure piping,shown
draining toward the Cook property.
3. Please add a road detail to the plans.
4. Please indicate what is going on in the southern corner of the project. The previously approved
plans indicated that there was some "hardstand" areas and some paved accesses,but nothing is
shown in that area at all now. The lines from the project just stop.
5. Please be aware that the permit to be issued will not allow construction to occur on this project
until the Wa1Mart pond is finished and certified. The existing pond cannot be closed down,
either.

STORMWATER MANAGEMENT NARRATIVE
BOB KING VOLKSWAGON/GMC TRUCK CENTER
DESCRIPTION
The site is located on a 6.0-acre tract located in the southeast quadrant of the intersection
of New Centre Drive and the proposed Bob King Boulevard at Dapple Court. The tract is
bounded by road rights-of-way to the north and west, office uses to the south, and commercial
properties to the east. The tract is essentially flat with medium sized pine trees and small oaks.
The project is primarily new development consisting of clearing, grading, and
construction of a 14,000 square foot car sales and repair building and a 9,400 square foot truck
facility with associated parking areas. Total impervious area for the site is 201, 700 square feet,
or 78%. Six acres will be disturbed by the construction work. Approximately 2.2 acres is
existing impervious surface draining to an existing pond permitted under SW8 960701.
STORMWATER MANAGEMENT MEASURES
Runoff will be collected in curb inlets and roof drains and piped to an proposed regional
detention pond serving the Wal-Mart development (SW8 990423). That pond is designed for
90% TSS removal in accordance with state regulations. Allowable impervious coverage for this
site is 85%. The existing pond will not be removed from service until the new off-site pond is
completed.
The grading contractor and developer will provide maintenance during construction. The
Owner will provide maintenance after occupancy.
