It has been determined that the nature of the proposed change meets the definition of a minor modification in that it does not result in an increase in the size of the permitted Stormwater control measure(SCM) and does not increase the amount of built-upon area. Please refer to Attachment 1 for a detailed description of the current proposed minor modification and a list of at I the past minor modifications approved during the current effective period of the permit. We are forwarding you an approved copy of the modified plans for your files. Please add the attached plans to the previously approved plan set Also, please replace the previously issued permit with the updated, revised permit, dated May 26, 2017, attached. Please be aware that all terns and conditions of this updated, revised pennit issued on May 26,2017, shall remain in full force and effect. Please also understand that the approval of this minor modification to the subject State Stormwater Permit is done on a case-by-case basis. Any other changes to this project must be approved through this Office prior to construction. The approval of this minor modification does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The runoff associated with this project has been approved to be discharged into a stormwater management system permitted under SW8 990423, as described on page 3 of this permit, the Project Data Sheet. 3. The built-upon area allotted to this development by Stormwater Management Permit 9SW8 990423 is 245,550 ft' for the tract and 76,550 ft2 for Bob King Boulevard. This project proposes 200,752 ft2 for the tract and 76,550 ft2 for Bob King Boulevard. 4. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 5. Unless specified elsewhere, permanent seeding requirements for the project must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. The offsite stormwater management system shall be constructed in its entirely, vegetated and operational for its intended use prior to the construction of any built-upon surface associated with this project. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. Wal-Mart Stores, Inc., shall at all times provide the operation and maintenance necessary to assure the permitted stormwater management system functions at optimum efficiency. The approved Operation and -Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Nlowing and revegetation of side slopes. d. Immediate repair of eroded areas. C. Maintenance of side slopes in accordance with approved plans and specifications. F. Debris removal and unclogging of outlet structure, drawdown device, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. The permittee is responsible for keeping the collection system on the lot clear of debris, and keeping the site stabilized. 5. Wal-Mart Stores, Inc., must keep records of maintenance activities make them available upon request to authorized personnel of DEMLR. The records will indicate the date, activity, name of person performing the work and what actions were taken. 6. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 7. AVal-Mart Stores, Inc., is responsible for providing, prior to issuance of a Certificate of Occupancy, and prior to operation of the permitted stormwater management facility, a certification from an appropriate designer for the system installed, certifying that the permitted facility has been installed in accordance with Stormwater Permit 4S`wV8 990423, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. A copy of the approved plans and specifications shall be maintained on file by the Permittce for a minimum of ten vears from the date of the completion of construction. 9. This lot is limited to the amount of built-upon area indicated in the supporting calculations and per approved plans. The project must have a built-upon area less than or equal to the amount permitted under Stormwater Permit #SW8 990423. Additional built-upon area will require a modification to the overall Permit. 10. Wal-Mart Stores, Inc., must record any deed restrictions as required by their permit, and they must verify that the proposed built-upon area does not exceed the allowable built-upon area. Once the lot transfer is complete, the built-upon area may not be revised without approval from the permittee, and responsibility for meeting the built-upon area limit is transferred to the individual property owner. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 12. The drainage features shown as a part of the stormwater management system on the approved plan shall not be filled in, altered, or piped by any party without first submitting a revision to the permit and receiving approval from the Division. 13. The following items will require a modification to this permit: a. Any revision to the approved plans, regardless of size. b. Project name change G. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area. C. Further subdivision, acquisition or selling of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA D4ajor permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shotim on the approved plan. g. The construction of permeable pavement for BUA credit. 14. The Director may determine that other revisions to the project should require a modification to the permit. 15. If the use of permeable pavement for BUA credit within the lot is desired, the permittee shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. 16. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 17. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Page 5 of 9 Slate Stormwater Management Systems Permit No. SW8 960701 III. GENLIUM CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. ']'he permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supposing documentation as listed on the forni, to the Division of Energy; Nlineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions: b. The sale or conveyance of the common areas to a Homeowner`s or Property Owner`s Association, subject to the requirements of Session Law 2011-256; c. Bar1kruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; c. Dissolution of the partnership or corporate entity, subject to NCGS 571)-2-01(c) and NCGS 57D-6-07: f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the penuiuce; 2. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 3. The issuance of this permit does not preclude the Permittec from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, NVal-Mart Stores, Inc., shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants permission for DLQ Staff to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The tiling of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit updated, revised, and re-issued this the 26th day of May, 2017.
