Dear Mr. Harrison:
The Wilmington Regional Office received the Stormwater Management Permit Application for Tarheel Plaza on April
17, 1996, with final information on June 21, 1996. Staff review of the plans and specifications has determined that the
project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 960415 dated July 15, 1996, to you.
This permit shall be effective from the date of issuance until July 15, 2006, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
ajudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 276 1 1-7447. Unless such demands are made this
permit shall be final and binding.

and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of an Infiltration Pond in compliance with the provisions of 15A
NCAC 2H A000 (hereafter referred to as the "stormwater rules') and the approved stormwater management
plans and specifications and other supporting data as attached and on file with and approved by the Division
of Environmental Management and considered a part of this permit.
This permit shall be effective from the date of issuance until July 15, 2006 and shall be subject to the following
specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on
page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the
runoff from 50,965 square feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.

4. The tract will be limited to the amount of built-upon area indicated on page 3 of this permit, and per
approved plans.
5. Deed restrictions must be recorded prior to construction of the future area shown on the approved plans
to ensure that the built-upon area limitations are known. The following statement must be recorded:
"To ensure continued compliance with the NCDEM Stormwater Management Permit
Regulations, 15A NCAC 2H.1000, future areas as shown on the July 15, 1996 DEM approved
plans are limited to 22,650 square feet of built-upon area, inclusive of that portion of the
right-of-way between the front lot line and the edge of the pavement, structures, pavement,
walkways of brick, stone, slate, but not including wood decking or the water surface of
swimming pools."
"All built-upon area from the future area must be directed into the permitted stormwater control
system."
"Built-upon area in addition to the permitted amount will require a permit modification."
6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the
allowable built-upon area.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
8. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specked in the notice, the permittee shall
submit a written time schedule to the Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and certification in writing to the Director that the
changes have been made.

H. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the
stormwater management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and
operational for it's intended use prior to the construction of any built-upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will
be repaired immediately.
C. All connections into the stormwater system from future areas/outparcels shall be made such that
short-circuiting of the system does not occur.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in it's entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DEM. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions
of this permit, the approved plans and specifications, and other supporting data.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior.to operation
of this permitted facility, a certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
6. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date
of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed
book number and page, and bear the stamp of the Register of Deeds.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.

III. GENERAL CONDITIONS

1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or
there is a name change of the Permittee, a formal permit request must be submitted to the Division of
Environmental Management accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Environmental Management, in accordance with North Carolina
General Statute 143-215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as.the construction of additional or replacement stormwater management systems.
5. The permittee grants Regional Office Staff permission to enter the property for the purpose of inspecting
all components of the permitted stormwater management facility.

6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and reissuance or termination does not stay any permit condition.

Dear Ms. Lewis:
Enclosed are two sets each of revised plans and calculations, and one
copy of the revised application in response to your letter dated June 11, 1996.
Corresponding to your numbered comments, we oiler the following:
1. Page 5 of the revised calculations illustrates that the 25-Year 24-Hour
Storm, producing 8" of rain, will totally infiltrate during the 24 hour
period in which it occurs. The application has also been revised for 85%
impervious coverage.
2. The revised calculations have been sealed.
3. The application and calculations have been revised to reflect a total
impervious area of 85%.
4. The application and calculations have been revised to show the total site
area as 1.377 acres.

Dear Mr. Houston:
The Wilmington Regional Office received a Stormwater Management Permit Application for
Tarheel Plaza on May 17, 1996. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
1. The 25 year, 24 hour storm produces 8" of rain. In response to recent challenges to the
State's Rational Method, we have switched to a less conservative method introduced by Tom
Schuler, known as the "Simple Method" for determining runoff volume. According to that
method, for an 85% impervious site, the volume provided by the proposed design is
deficient by 400 cubic feet. However, for the proposed 48.2% impervious site, (see
comments #3 and #4 below) the system can infiltrate more volume in 24 hours than is
produced as runoff. Since the permit application does not show any future built-upon area,
the permit can be issued for the 48.2% impervious site, however, additional storage must
be provided and the permit application revised, if the permit is to be issued for 85%
impervious.
2. The revised calculations were not sealed.
3• My calculation of impervious area, based on the dimensions provided, is approximately 717
ft2 more than yours. Please verify and revise the application/calculations. From the amount
that it is off by, perhaps the 36' x 20' drive was left off your total?
4. Sixty thousand square feet of site area is 1.377 acres, not 1.34 acres as shown on the
application. Please revise.

Maintenance of the stormwater structures and facilities shall be the responsibility of John Harrison.
The stormwater structures and facilities shall be maintained in a condition which makes them
functional for the intended purpose. In the process of meeting the overall requirement of insuring
proper system function, the following specific tasks, at a minimum, shall be performed.
1. During construction, and until such time as all grounds are stabilized with a suitable
vegetative cover, all erosion and sediment control practices shall be checked for stability and
proper operation following every runoff-producing rainfall event. Sediment shall be
removed from behind the silt fence when it approaches 0.5 feet in depth. Any needed repairs
will be made immediately to maintain all practices as designed.
2. Sediment shall be removed from infiltration basin following each rainfall event exceeding
one-half inch, and at least on a monthly basis. The basin bottoms and banks shall be
restored to their design elevations and/or grades. Any condition of ground surface instability
shall be immediately corrected.
3. A vigorous stand of low profile grass shall be maintained in the open channel areas at all
times. Artificial erosion control fabrics shall be used if necessary to accomplish this end.
4. Following every runoff-producing rainfall event, all debris shall be removed from the open
channel areas to facilitate unobstructed flow.
5. Following a rainfall event, ponding of water in the infiltration basin extending beyond 5
"dry" days shall be considered system failure. In such an event, the basin bottom shall be
tilled to a depth of at least 12 inches, graded by hand to its design elevation, and restabilized
with a vigorous growth of low profile grass.
6. All grassed surfaces shall be mowed on a regular basis to maintain a maximum grass height
of 2".
7. Any areas exhibiting soil erosion during the course of project construction shall be stabilized
with a suitable vegetative cover, erosion blanket, and/or rip rap as necessary to eliminate the
potential for erosion.

Dear Ms. Lewis:
Enclosed are two sets of revised plans and supplemental calculations in
response to your letter dated May 8, 1996. Corresponding to your numbered
comments, we offer the following:
1. Dimensions of the building, parking lot, and infiltration basin have been
provided.
2. A signed Operation and Maintenance plan has been enclosed.
3. The drawdown calculations for the infiltration basin has been provided
in the supplemental calculations.
4. Runoff will be directed into the infiltration basin primarily by sheet flow.
Flow arrows have been shown on the revised plans.
5. Soil type, expected infiltration rate, and the approximate depth of the
seasonal high water table have been added to the Auger Boring Data
Table.
6. Calculations based on both 25-year, 24-hour rainfall, and 25-year 'Peak
Flow" rainfall are included in the supplemental calculations. The 'Peak
Flow" scenario actually requires more storage than the state accepted 24-
hour scenario, therefore explanation of the underlying 'Peak Flow"
methodology is not necessary.
7. The 3:1 slope description for the infiltration basin has been removed and
dimensions have been provided for the spacing between the contours.
The provided dimensions now reflect a 3:1 slope between the 46 and 47
contours and a 6:1 slope between the 47 and the 47.5 contours. The
provided storage volume has been adjusted in the Infiltration Basin Data
Table.

Tarheel Plaza on April 17, 1996. A preliminary review of that information has determined that the
application is not complete. The following information is needed t i continue the stotmwater review:
1. Please dimension the building, parking, and infiltration area.
2. A signed Operation and Maintenance plan.
3. Drawdown calculations using the expected infiltration rate of the soil.
4. The method by which runoff will be directed to the basin. No'swales or piping are shown.
We must have specks on the routing of the runoff in order to issue the permit. Please
show all pertinent elevations, flow arrows, details for pavement to swale transitions, etc.
5. Please report the results of your field investigation. Include the soil type, expected
infiltration rate, and the depth to the seasonal high water table.
6. The 25 year, 24 hour storm produces 8" of rain. If 8" of rain is allowed to fall on this site,
the expected volume is approximately 18,500 cubic feet, not 4,760. If this cannot be
provided, then a bypass for the excess 1.5" storm must be provided. This may be achieved
by providing a single inlet to the infiltration area where a "smart weir" can be placed.

7. The 47.5 contour around the pond is somewhat misleading. It is spaced at the same distance
from the 47 contour as the 46 contour is from the 47. It is supposed to be only 1.5' away,
according to the plans, ie., with a 3:1 slope. This may explain why my calculation of
volume provided in the pond is smaller than yours.
