Mr. Beck,
I am in receipt of this notice and wish to notify you of my intent to fully comply
with the installation of the required Stormwater System (Infiltration Pond). I have
contacted a contractor who will install this pond in full compliance with our permit.
Due to the backlog of work in our area due to growth, this work is scheduled to be
complete no later than December 31, 2005. However, we will make every effort to
complete this work sooner if at all possible.
Please notify me if this is not acceptable so we can do whatever is necessary to
work within your guidelines.

Dear Mr. Harrison:
On July 28, 2005, Wilmington Regional Office personnel performed a Compliance Inspection of the
subject project, located on Highway 179 in Ocean Isle Beach Township, Brunswick County,North
Carolina. The inspection was performed to determine the status of compliance with Stormwater Permit
Number SW8 960415, issued to you on July 15, 1996.
The project has been found in violation of Stormwater Permit Number SW8 960415, issued
pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section II.1a- The stormwater management system shall be constructed in its entirety, vegetated and
operational for it's intended use prior to the construction of any built-upon surface
except roads.
1. The stormwater system (Infiltration Pond) has not been built or installed for this site. The parking lot
has gravel (Marl) on it and the building has been constructed.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s)
and a time frame for completion of those actions, on or before September 3, 2005.
2. The permitted stormwater system for this site must be installed or built according to the permitted
plans. Or a permit modification may be submitted with the S 420 application fee.
3. This is to remind you that your permit for this site must be renewed by July 15, 2006. I have enclosed
a copy of your permit and a copy of your original application. High Density permits are effective for
10 years after which they must be renewed.

Failure to provide the 'Plan of Action" by September 3, 2005, or to correct the violations by the
date designated in the 'Plan of Action", are considered violations of 15A NCAC 2H.1000, and
may result in the initiation of enforcement action which may include recommendations for the
assessment of civil and criminal penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Brunswick County Building Inspector, this Office is requesting that
the Building Inspector consider withholding building permits and Certificates of Occupancy for
this project until this matter is satisfactorily resolved.
