I understand that you have a State Stormwater permit originally issued in 1996 (most recently renewed in 2008). And,
you also have a permit through the City of Wilmington covering 2017 updates. However,the city's permit does not
cover all of the land that the State's permit covers and the State's permit does not cover the 2017 updates. Please
choose one of the following three options:
1.) Get fully permitted through the State. To do that,you need to apply for a permit modification. If you are
increasing the impervious area or if you are increasing the size of your pond, it will be a major modification. If
not, it will be a minor modification.
2.) Get fully permitted through the city. The process is that you obtain a stormwater permit through the city and
ensure that the permit covers all the land that is covered by the State's permit. For instance, if the State's
permit is 5.0 acres, you would have to get a permit for the full 5.0 acres rather than a portion of that amount
through the city. Once you have the city's permit you can apply to rescind the State's permit using the form on
our website. Please include a copy of the city's permit with that request with enough documentation to
demonstrate that the full acreage is covered.
3.) Divide the project to be partially covered by the State and partially covered by the City. (This is probably the
most difficult option as it may require modifications to one or both existing permits.)

Logan, trying to figure out a renewal for this permit.
• Original DEQ permit 1996, last renewal 2008
• in 2017, we added on to one of two buildings on this permitted site, reducing the impervious area for
the site. Underground storm drainage connected to the city system was revised. Phil Norris was the
civil engineer and he submitted a drainage permit application to the City of Wilmington referencing
"N/A" for prior permitting. COW issued the drainage permit and we constructed the project. Rob
Gordon, COW storm water, advised they would not have permitted drainage only if they were aware of
the prior State permit. They would have required a new COW permit for the entire site, or for us to go
to the State for a modification. Our site plan for that project only included the affected areas, not the
entire site.
• I want to reflect the proper information that we have made changes to the site on the renewal app.
The division of responsibility between the State and the city is hard to navigate here. We will correct any
mistake our consultants may have made. Please call to discuss how we should proceed. Thanks.

On August 5, 2009, the Governor signed Session Law 2009-406.This law impacted any development approval issued by
the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and
valid at any point between January 1, 2008, and December 31, 2010.The law extended the effective period of any
permit that was set to expire during this time frame to three (3)years from its current expiration date. On August 2,
2010,the Governor signed Session Law 2010-177,which granted an extra year for a total of four(4)years extension.
This is why the expiration dates you see in the letter that was sent are four years apart from the physical permit's
expiration dates.
If there is a State Stormwater permit issued through DEMLR and you would like to instead become permitted through
the City of Wilmington,then we can do that. The process is that you all would obtain a stormwater permit through the
city and ensure that the permit covers all the land that is covered by the State's permit. For instance, if the State's
permit is 5.0 acres,you would have to get a permit for the full 5.0 acres rather than a portion of that amount through

request that CFCC received. It shows the last issued dates and expiration dates.
There are two Permits within Wilmington City Limits where the Expiration Date noted on the renewal
request is 4 years past the expiration date noted on the latest permit copies.

"CFCC completed a Renovation and Addition Project to the (Schwartz Center) Student
Activity Center on 211112019. In the project file I found a Stormwater Management Permit
Application Form to the City of Wilmington for the drainage plan only. I've also found the
following information on the City of Wilmington's Stormwater Permit Website:
The City of Wilmington's Stormwater Ordinance that includes the NPDES Phase I1 Post Construction Controls
was adopted by the Wilmington City Council effective on November 1, 2009. The City's Comprehensive
Stormwater Ordinance applies to all new development, redevelopment and expansion or modification of
existing development. It regulates both water quality (pollution) and water quantity (volume) with regards to
run-off generated by development activities. For many projects, it will replace the State Stormwater Permit
process currently administered by the NCDEQ- Division of Energy, Mineral& Land Resources. There are
two tiers of Stormwater Review that may apply — Full Stormwater Review and Drainage Plan Review.
Does the City of Wilmington's Stormwater Ordinance replace the State Stormwater Permit administered by
NCDEQ? Thank you for any help you can provide.

If you need further information, our paper files are also considered public record and would include things like the
application documents, approved site plans, and other supporting documentation. The two options for accessing the
file include scheduling a time to make the file available for review here in the office and/or arranging to have the file
scanned at your or your client's expense.The cost to scan depends on how large the scanned documents are
($35/inch of file thickness). Please let me know if you want to take advantage of these options.

In the scope meeting on May 21, 2009 we discussed the following 2 redevelopment projects for state stormwater:
SW8 960120—Permitted as Workforce Training Center [Schwartz center and parking deck]
The original permit was issued as a redevelopment permit requiring treatment for new built-upon area [bua] in
September 1996 with renewal November 18, 2008. This redevelopment basis may be continued with stormwater
treatment for additional bua. If the treatment system is changed [bmp] then the previously treated bua and the
additional proposed bua will be incorporated for treatment. The non-treated bua was issued under the 1995
redevelopment rules since it had been developed prior to stormwater rules in 1988. The treatment for the amount of
bua issued in 1996 will be at the 1995 stormwater rule and the additional proposed bua is at the 1.5 Inch under the
current 2008 rules. If the modification is requested in the express program the fee is$4000.
The Union Station site may request exclusion for redevelopment under the Session Law 2008-2112(d)(3)for activities
that result in no net increase in built-upon area and provide stormwater control equal to the previous development.
The existing RR property may be included in this project. Further definitive information may be provided for the
exclusion project when DWQ receives the request for exclusion. Documentation for the request for exclusion should
include: narrative describing existing and proposed stormwater controls, existing and proposed bua, plans delineating
property area, bua and demonstrating that the proposed stormwater control provides equal or better protection of
surface waters as the existing controls. If the.exclusion is requested in the express program the fee is$500.
Below is Linda's verbiage for exclusion request:
Send us a letter asking for review and verification that the redevelopment project is excluded from the state stormwater
permit requirements. The letter should contain:
1)The reasons why you think the project qualifies for the redevelopment exclusion.
2)Two sets of plans showing the existing BUA, existing drainage and stormwater treatment features, proposed grading
and proposed BUA.
3)A calculation of the existing and proposed BUA to demonstrate that the proposed BUA does not exceed the existing
amount.
4)A narrative statement describing the existing and proposed stormwater treatment features, if any. Include any pipes,
swales, ponds, infiltration areas, grassed buffer areas, etc.
If we determine that the project meets the redevelopment exclusion criteria,the applicant will receive a formal letter
from the Division to that effect.

These two were the last emails I have. I have no problem with the permitting plan you described in your second email
(the one titled "CFCC"). .Really, that email contains most of the language the City of Wilmington will want to see.
This is how I remember, If you remember differently, please let me know(not trying to influence your position, just to make
sure we are on the same page since it's been a few weeks since we met):
• On the Parking Deck site, we are to provide treatment for any BUA above what existed prior to the permit being
issued (originally)in 1996 permit. We are to provide 1"treatment for this area (not 1.5") because that is what was
required at the time the permit was issued (in 1996). We will be limited to the amount of BUA permitted in the
1996 permit in order to continue to qualify for redevelopment on this parcel.
• On the Union Station site-as long as we are proposing less BUA than exists now, we would qualify for a
redevelopment exemption under the 2008 rule. No permit required,just an exemption.
• These two parcels should be permitted separately(as described in your email)
What I am unclear about is the r/w BUA. There is existing BUA within the 2nd St r/w adjacent to the Union Station parcel.
We will be reconfiguring this street to extend over the pedestrian access to the parking deck. Not sure whether there will
be more or less BUA after we are done. How do we account for this BUA within an existing r/w? Do we lump it in with the
Union Station parcel? I have written down that we should calculate it separately; which would have been fine if we were
applying for a "hybrid" permit(as we were talking about doing at the scoping mtg). But now that we are doing separate
permits, I'm not sure where to put that BUA(if at all??).

I am thinking about the permits. I am thinking out loud here-the union station bldg area should probably be just an
exclusion on its own and not really put into the permit for the Schwartz center and parking; because the 2008
redevelopment rule allows'exclusion' if redevelopment is equal or less bua and equal or better stormwater control.
That 2008 exclusion is not a permit.
Is that a problem if I change my mind from yesterday?
It would mean a typical mod to the existing permit at$4000 to change the bmp, narrative describing pre/post for
continuation of redevelopment under 1995 rule and reconcile to existing permit for original basis...
and then a separate package with 2 sets of plans, letter for narrative describing what you are doing with discussion of
the equal or better controls and equal or less bua for redevelopment exclusion for 2008 rule,table of bua accounting for
pre and post bua, and a $500 check in express for exclusion.
Please let me know if this would work for you. I think this would be better for the applicant because once the exclusion
is given on the union center-they just have to keep the exclusion letter-not a permit to track or deal with compliance
on.

Cape Fear Community College is proposing the construction of an overall high density
development known as Cape Fear Community College-Union Station and Parking Deck, which
is located in downtown Wilmington, NC. The project is bounded by Front Street to the west,
Hanover Street to the north, Third Street to the east and Red Cross street to the South. This
project proposes approximately res of previously developed Pee JE5()R _

The basic un rovements proposed at this time consist of the construction of 5-story institutional
buildin (43g` ,452 sf) nd 5-story parking deck 73\ 556 sf) with drainage collection and treatment
system consisting of proposed bio-retention areas.

Soil Information
Based on the New Hanover County soils maps, the underlying soils within the project area are
predominantly Kureb-Urban land complex (Ku), which is classified as an A type soil group and
consists of areas of Kureb soils and Urban land that are too small and too intermingled to be
mapped separately. Very low available water capacity and rapid permeability are the main
limitations of this soil.

Urban waterfront has flexible options, but the off-line bypass prior to the bmp for the excess storm is required to
protect the bmp based on its sizing=you can't size a bmp for 1%: inch storm and then send the 10 yr storm through it
and expect it to function very long. The vegetated strip on bioretention has been modified by a policy and is not needed
if not in SA waters. These policy updates are on the forms website at the top of the page.

I looked through your narrative and noticed that you said attenuate the peak flow for 1 yr 24 hour... I am not sure how
you interpret that, but you might want to note the rule says :
• control, treat, and store the 1%: inch [2008-211 2.b.3.b.3] and
• discharge the volume at a rate equal to or less than the pre discharge rate for the 1 yr, 24-hr'. this means the
orifice disch rate is less than pre development rate and this is often much less than the attenuating 3.8 inches
[2.b.4.c], especially for sites with existing bua.
I also noticed you mentioned "rapid permeability' and "low available water capacity"for the soils—is that conducive to

Be sure to bring your before and after bua and its location. The new bua needs to be up and away from drainage ways,
streams, wetlands, etc... better than the pre.
