Dave Adkins has asked me to respond to the concerns raised in your letter. CAMA is the umbrella agency for this project. The concerns in your letter: erosion control, stormwater runoff, and Primary Nursery Area issue, must be addressed prior to the issuance of the CAMA permit. No work should begin until the CAMA permit is issued. Individual permits, such as Erosion Control and Stormwater, however, may be issued separately from the CAMA permit. My job within the Water Quality Section of DEM is restricted to implementation of the State's Coastal Stormwater program in New Hanover, Brunswick, Pender, Onslow and Carteret Counties. The regulations were developed as a way to minimize the impacts of development on our coastal waters. They do not prohibit development. Currently, a development can be issued a Certification of Compliance if it proposes construction of less than one acre of impervious surface, ie., asphalt, concrete, rooftop, etc.; constructs only 25-30% of available site area above mean high water as impervious area; or provides an engineered system which retains the first 1" or 1-1/2" of runoff from all impervious areas. The classification of the water body will determine the low density percentage allowed and the amount of runoff to collect. Dick's Creek is Class SA waters, which means the allowable density limit is 25% impervious, and if an engineered system is designed, it must collect the first 1-1/2" of runoff. The stornwater application for this project, received on March 27, 1995, is requesting approval under the 25% low density option. As of this date, however, we have not received a Stormwater Submittal regarding stormwater management for the subject project. Please be aware that any site which requires either a Sedimentation and Erosion Control Plan permit and/or a CAMA major permit will also require a Certification of Compliance with Stormwater Regulations by the Division of Environmental Management. Any construction on the subject site, prior to receipt of the required Certification, will constitute a violation of 15A NCAC 2H.1003 and will result in appropriate enforcement action by this Office. A Stormwater Submittal or information regarding the status of this project and expected submittal date must be received by this Office no later than April 9, 1995, or the subject project file will be closed and construction may experience a subsequent delay. The activities in question are taking place on a 1. 39 acre property located northwest of Lot 37 on Peninsula Manor Road adjacent to Dick's Creek and Shallow Bay off Queen's Creek in Hubert, N.C. The public record shows that the owner and "developer" is Mr. Bobby Provost, the proprietor of the Red Barn, a local seafood wholesaler. According to various appointed and elected officials, the developer plans to construct a private recreational vehicle park with 12 to 14 spaces, a bulkhead, a boat ramp and a dock large enough to accommodate at least 12 sport fishing boats - in effect, a mini-marina. So far, the activity includes cutting down virtually all of the trees on the property, covering up marsh grass with fill dirt, erecting a large three-legged bollard, "blowing out" a channel through the marsh grass (destroying it in the process) for the dock and ramp, and doing what appears to be preparatory work for a sea wall or bulkhead. I am concerned that a development of this kind will have a seriously damaging effect on the local environment. Dick's Creek is a primary nursery area for clams, oysters, shrimp, crab and other wildlife. It, and the adjacent Shallow Bay, have already suffered considerable damage and their waters are unable to tolerate any additional pollution. It seems obvious to me that the construction of a septic system to enable 12 to 14 recreational vehicles to dispose of their waste on less than an acre and a half of land cannot help but further pollute this already fragile area. Furthermore, the fishing boats associated with the recreational vehicles as well as others willing to pay a fee for use of the launching ramp are likely to overwhelm the capacity of Dick's Creek and Shallow Bay with oil/gasoline pollution and underwater erosion. Underwater vegetation will be irreparably I damaged in this primary nursery area. In short, I see a cumulative negative effect on the aquatic wildlife in this area which will inevitably lead to destruction of what has been a productive and beautiful natural habitat. The residents of Peninsula Manor Road, Leslie Drive, Leslie Court and Oyster Lane are, in the main, older and live on fixed incomes. A development of the kind being planned by Mr. Provost will certainly have a negative impact on the quality of our lives. Clearly, the pollution, destruction of the environment, noise, additional road and water traffic and the security impact of a transient recreational vehicle park in the midst of a residential area will have a devastating effect on the value of our properties as well. Many of my neighbors have been in contact with local officials concerning this problem and have received mixed reactions. Some officials appear to be concerned only with the regulations rather than the public interest. Others have been more helpful, but the residents of this area, seeing the daily progress of activity on the 1. 39 acre site, are fearful that we will be faced with a "fait accompli" before the individual regulatory bodies can sort themselves out. I am, therefore, writing to share my concerns with you in the hope that you will take action on behalf of my neighbors and myself. Provost' s property on the right viewing said Property from NCSR 1546. with Mr . Royce Floyd / of 170 Leslie Drive of said area being the Riparian Property Owner whose property abuts at the waterline . We also own the two lots on NCSR 1546 to the right and left of the ingress/egress road and directly in front to the property for which Mr . Provost is asking a permit to develop a thirteen space RV park and boat ramp Although we, along with other area property owners' have a strong objection based upon the assured adverse impact upon our quality of life and negative impact on our property values/ we intend to address only the impact of such a development on environmental issues and laws . Background The area impacted is actually a peninsula, bounded by Dick ' s Creek on the west which feeds into Queen' s Creek and by the Inland Waterway on the east' into which Queen' s Creek feeds The eastern land is shielded From the Inland Waterway traffic by barrier water , while the land on the west has no buffer zone . In actuality, the Dick ' s Creek channel runs within approximately 20 feet of the land and, in some instances` even closer . The land bordering Dick ' s Creek on both sides is residential consisting of only one-family homes as far as we know . Mr . Provost plans to build 13 RV sites (8' x 34' ) . one 15' x 2()' boat ramp with 15' x 20' apron/ a 223 ' bulkhead, gravel a 72/ x 365' roadway/ and renovate an existing pier . No size is given for the pier / although the measurements on the plat submitted to CAMA read 54 feet out from the land . There is already a small frame house on the property which has been a rental house for at least the past several years REGULATORY FACTS . North Carolina Fisheries Rules for Coastal Waters 1994- 1995. Subchapter 3N 0001 (page 51 ) Nursery Areas , states the scope and purpose of cited subchapter is : To establish and protect those fragile estuarine areas which support juvenile populations of economically important seafood species and to set forth permanent nursery areas in all coastal fishing waters . The Nursery Areas subchapter ' 0002 further states that : Primary nursery areas are defined as those areas / in which for reasons such asfo2J�- �����I�/- L��t�t���� t�I;��/ sal�iI�;���L�/� t��������l��t����� an/�| other factors, young fin fish and crustaceans spend the major portion of their initial growing season . North Carolina Fisheries Rules for Coastal Waters 1994-1995, Subchapter 3R 0003 (page 92) ' Primary Nursery Areas lists the primary nursery areas and on page 114 cites Dick ' s Creek as one of those areas . The water of Dick ' s Creek is -known as SA which, according to the Clean Water Act/ is about as good as you can get in public waters . ARGUMENT . l The property as of this date has been cleared of all vegetation' with the exception of whatever grass is left and a very limited number of trees near property lines This removal of vegetation and the decided slope of ^ ^ th^ front of the property would certainly increase the runoff from said property into Dick / s Creek compared to what it has been in the past when vegetation was available on the lot and on the shore line to help stabilize the soil Even with wooden bulkhead in place / as is cited in application, the fill placed behind the bulkhead would provide further material to wash from under and around the ends of the bulkhead . Furthermore/ as the gravel road would extend from the gate to the top of the boatramp/ there would be nothing to prevent such gravel , dirt , and runoff water from taking this path of easiest flow creating excessive runoff into the creek This would be intensified by the number of vehicles and boats using the ramp, which might not be just thirteen (see next paragraph . ) 2 The plat submitted with CAMA application is labeled Revision #l . It appears that the original version planned to have 25 spaces versus the 13 spaces now requested . The purported reason for the development is to allow Mr . Provost and 12-13 of his friends to have * place to park their personal RV/ s and launch their personal boats . If our interpretation of the original plat is correct . Mr . Provost apparently has 12 other friends who also want this same privilege Once the permit is granted` there is nothing that would preclude these other / 2 friends` or any other number , from using the ramp or parking their RYs on the strip of land that runs between our properties and the property for which the permit is being requested . See Book 776 page 187 on file at the Onslow County Courthouse . 3 . Therefore' no absolute or surety exists as to the amount runoff into Dick / s Creek Nursery Area may be increased over previous amount due to loss of vegetation , 13-fold increase in usage of land , installation of a bulkhead, and direct access of runoff to creek created by road and boat ramp 4 Dick / s Creek is designated a Nursery Area and has the highest classification available under clean Water Act simply because it is a pristine creek due to limited amount of boat traffic ' among other reasons It must be assumed from the application that there will be at a minimum 13 additional boats running in and out of the creek ' with the maximum unknown It is understood that we are not talking about just recreational weekend use here as a number of these people make their living by fishing, clamming/ etc . Again/ once a permit has been granted, there is nothing to prelude Mr . Provost allowing who ever he wishes to use his ramp or how many additional may be allowed to tie up at the renovated pier which/ on the plat , appears to be 54' long . S . Therefore` even the increase of the boat usage of the creek by a minimum of 13 additional boats/ but an actual unlimited increase/ must have an impact far in excess of what is present . 6 . There are two established cement boat ramps within l to 1 . 5 miles of the cite for which the permit is requested One being at the Red Barn, owned by Mr . Provost / approximately one mile distance/ on the Intercoastal Waterway/ which is in a commercial area There is another approximately 1 . 5 miles at Matthews Landing which is on Queen ' s Creek Both of these allow launching of boats for a small fee and, since these people are friends of Mr . Approximately two weeks ago Mr . The bottom was disturbed to such a massive extent: that .a large _iat which is docked above this area could not get out: the channel where he previously usl.y had no difficulty, grounded, and had to be pulled off . It is our opinion that this recreational vehicle park will be a commercial venture, not private, and will provide an opportunity for commercial fishermen to have access to our coastal waters (boat ramp) and a place to live (recreational vehicles) . Let us outline some of our concerns : SEPTIC SYSTEMS Dick ' s Creek and Queen ' s Creek waters are very fragile and play a vital role with the wildlife that habitat this beautiful coastal area . To construct a single septic system for recreational vehicles to "dump" their holding tanks or to construct 12-14 separate systems , on one and a half acres of land , will do little to help our waters and wildlife . It amounts to 12-14 families , living on one and a half acres of land, adding to our environmental/pollution problems . Common sense should prevail . In the last several months, beautiful old live oak trees have been clear cut and a sedimentation fence erected. I have learned from the public record that the owner of the property, Mr. Bobby Provost plans to construct a private recreational vehicle park with 13 spaces, construct a bulkhead, and construct a boat ramp. There is clear evidence of destruction of marsh grass and wetlands, and fill dirt being dumped in preparation of the site, prior to any approval by the coastal management authority. Currently a small number of commercial watermen use the property to dock their boats and sell their catch to Mr. Provost who runs a nearby seafood wholesale business. They transit a quiet residential waterfront area through a narrow channel to their fishing grounds, with little regard to their speed and damage caused by the wake from their boats. My fear is that this recreational vehicle park will be a commercial venture, not private, and will be used by an even larger number of commercial watermen to have access to coastal waters and a cheap place to live. The following are some of my concerns regardless of who uses the site: - Septic systems -- Shallow Bay between Dick's Creek and Queen's Creek is a very fragile eco-system which plays a vital role in the development of marine life in this area. To construct a single septic system for 10 to 13 recreational vehicles on an acre and one half of very low land, with drain fields so close to the water will do irreparable damage to Shallow Bay and adjacent waters and wildlife. - Boat ramp -- In my opinion, the boat ramp will be used, on a daily basis by 12-14 or more commercial fishermen, rather than RV park residents, and that the carrying capacity of Dick's Creek, Shallow Bay, and Queen's Creek will be overwhelmed. -- Dick's Creek and Shallow Bay are primary nursery areas and should be protected. Both are currently temporarily closed to shrimping and shell fishing because of pollution. (This temporary closing has been in effect for several years! ) - Quality of life -- In the main, the residents of Peninsula Manor Road, Leslie Drive, Leslie Court, and Oyster Lane, the areas surrounding the project site, are older and on fixed incomes. A recreational vehicle park in this area would be devastating to their quality of life. Noise pollution, anxiety of having transients living in the park, and the negative effect on property values are just a few of their concerns. While I understand the rights and needs of the watermen, and applaud Mr. Provost for his desire to construct an RV park, I must say that Shallow Bay is just not the place for it. I hope that you can understand our concerns and will support the public interest expressed by the citizens of these neighborhoods by helping us stop such a venture, as we try to clean up Shallow Bay. It is our opinion that this recreational vehicle park will be a commercial venture, not private, and will provide an opportunity for commercial fishermen to have access to our coastal waters (boat ramp) and a place to live (recreational vehicles). Here are some of our concerns: -Septic system --Dick's Creek and Queen's Creek waters are very fragile and play a vital role with the wildlife that habitat this beautiful coastal area. --A small home is on the property so we assume a septic system exists. --To construct a single septic system for recreational vehicles to "dump" their holding tanks or to construct 12-14 separate systems, on less than an acre and a half (1.39 acres) of land, will do little to help our waters and wildlife. It amounts to 12-14 families adding to our environmental/pollution problems. --Common sense should prevail. -Boat ramp --This boat ramp could be used, on a daily basis, by 12-14 commercial fishermen. ---In our opinion, the carrying capacity of Dick's Creek and Queen's Creek will be overwhelmed. Oil/gasoline pollution and erosion are but two of the negative results. ---Damage to submerged underwater vegetation would have a negative impact on our wildlife. ---Dick's Creek is a primary nursery area and should be protected at all costs. The creek is already closed to shellfishing and the increase in boat/watercraft activity will not allow the creek to recover. ---Noise pollution would increase. --In our opinion, this boat ramp could be used by anyone willing to pay a fee.....thus the above mentioned problems will increase. --In our opinion, if not boats, this beautiful creek could face destruction by 12-14 families with Jet-ski watercraft darting all over the place. --Again, common sense should prevail. -Quality of life --In the main, the residents of Peninsula Manor Road, Leslie Drive, Leslie Court, and Oyster Lane are older and on fixed income. Without laws, such as zoning laws, there is very little anyone can do to protect someone's quality of life. We must depend on common sense and the values of people in authority positions. A recreational vehicle park "stuck " in this beautiful area would be devastating to their quality of life. More important to us is that this project (12-14 families, 12-14 boats at one location) will destroy Dick's Creek and the quality of life in and around the creek. -Attitude --Many of us feel that those in authority are only concerned about regulations. This project meets state/county regulations is a comment we have heard from more than one official. We have many questions. For example: Is it the role of CAMA to help developers get what they are after or to protect the Public Interest? Are the regulations written to describe the Public Interest? As neighbors, taxpayers and coastal residents are these regulations not written to protect our interests? Our concerns may appear minor; however, they are monumental and catastrophic to us. People in positions of authority must stand up and take responsibility for all their actions. On March 31, 1995, Governor Hunt unveiled his plan for dealing with pollution along the NC coast. It is our opinion, this project will destroy Dick's Creek and to permit construction violates the spirit and intent of our Govemor's public remarks about his plan. The removal of vegetation within any existing ditch or channer is prohibited unless the ditch or channel is to be regraded with side slopes of 2 horizontal to 1 vertical or less steep. If that relocation presents a problem or contradicts any requirements of the Corps of Engineers, it is the responsibility of the developer to inform the Land Quality Section Regional Office so that an adequate contingency plan can be made to assure sufficient erosion control on site. Failure to do so will be considered a violation of this approval. 5. Any borrow material brought onto this site must be from a legally operated mine or other approved source. A single use borrow site or an area to waste material is only permissible if it is operated under total control of the Financially Responsible person or firm who is developing this site and a plan modification is submitted to this office that includes the area in question. 6. As of this date, however, we have not received a Stormwater Submittal regarding stormwater management for the subject project. Please be aware that any site which requires either a Sedimentation and Erosion Control Plan permit and/or a CAMA major permit will also require a Certification of Compliance with Stormwater Regulations by the Division of Environmental Management. Any construction on the subject site, prior to receipt of the required Certification, will constitute a violation of 15A NCAC 2H.1003 and will result in,appropriate enforcement action by this Office. A Stormwater Submittal or information regarding the status of this project and expected submittal date must be received by this Office no later than April 9, 1995, or the subject project file will be closed and construction may experience a subsequent delay.
