Dear Mr. Andrews:
Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that DEMLR is now the Division responsible for issuance of the permit
On March 25, 2015, the Wilmington Regional Office received a request to transfer the ownership of the
permit from Andrews Mortuary, Inc. to Andrews Properties, Inc., for the subject state stormwater
project. The Name/Ownership Change form was submitted as part of the January 9, 2015 proposed
Plan of Action to address the deficiencies noted in the December 10, 2014 inspection report. This
Office is hereby acknowledging the ownership change and to remind you that until the permit is
modified, the existing November 28, 1994 permit remains in force and effect.
The two (2) items listed in the January 9, 2015, Plan of Action have not yet been addressed. A request
for a scoping meeting was submitted just today but has not been scheduled. No information regarding
the status of the required maintenance has been provided.
Please inform this Office in writing before June 8, 2015, of the specific actions that will be undertaken
and the time frame that will be required to maintain the system and to submit the required permit
modification. Failure to provide the requested information, or to respond to this letter by the due date,
may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If
an updated Plan of Action or a permit modification is not submitted to this office by June 8, 2015, then
DEMLR staff will re-inspect the site and issue a Notice of Violation if the listed deficiencies have not
been addressed.

III. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by botFi the
current permit holder and the new applicant if this is a change of ownership)
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

Dear Ms. Lewis:
On December 16, 2014, Richard C. Andrews, Jr. received a Notice of Inspection letter from the
North Carolina Department of Environment and Natural Resources (NCDENR) indicating that an
inspection of the Andrews Mortuary — Hampstead Chapel revealed the site was not in compliance
with the terms and conditions of State Stormwater Management Permit Number SW8 940805.
Included in the Notice of Violation were items specific to the maintenance of the pond system. The
owner has completed the required maintenance to the pond as noted in the items below.
Deficiencies identified by NCDENR's Notice of Inspection are listed below in bold text with the
owner's action following in italics.
1. Please maintain the pond system, check the sediment level, remove accumulated
sediment,clean out the trash, restore the sideslopes and repair the undercutting.
WK Dickson and the Owner have verified that the current pond depths are generally consistent with
the permitted pond depths and removal of sediment is not required at this time. The Owner has
removed the trash from in and around the ponds and has generally cleaned up the pond areas and
slopes.
This project was permitted in 1994 under the "innovative" system section of the 1988 stormwater
rules with treatment of collected runoff from a piped collection system achieved using a series of three

existing ponds as wet detention basins. The ponds were formed from three borrow pits that were
excavated by the previous owners in the 1980's and no modifications were required to the ponds as a
result of the permit submittal or approval. While the banks are relatively steep in comparison to wet
detention basins designed and permitted through the traditional permit process, the banks are
vegetated and have been stable since construction in the 1980's other than a few small areas of
undermining. WK Dickson and the Owner are concerned that modifying the pond banks at this time
to comply with the NOV will be in conflict with the issued permit and will create more erosion and
slope failure potential than the current stable pond bank conditions. For these reasons, no
modifications other than general cleanup and maintenance have been completed on the pond banks.

Dear Ms.Lewis:
On December 16, 2014, Richard C. Andrews, Jr. received a Notice of Inspection letter from the
North Carolina Department of Environment and Natural Resources (NCDENR) indicating that an
inspection of the Andrews Mortuary — Hampstead Chapel site was not in compliance with the

requested that Mr. Andrews provide a written response outlining the specific actions and.time
frame to correct the deficiencies noted in the Notice of Inspection letter.
Deficiencies identified by NCDENR's Notice of Inspection are listed below in bold text with the
planned action and timeframe following in italics.
1. Please submit the Designer's Certification.
WK Dickson will review the Dawson Engineering project archive files to locate the designer's
certification and submit the certification to NCDENR If the designer's certification is not located in
the project archive files, WK Dickson will review the existing permit conditions and the as-built
condition of the pond. Following confirmation that the pond was constructed in accordance with the
permit conditions and following completion of the pond maintenance to address the deficiencies
identified in the Notice of Inspection, WK Dickson will prepare and submit the designer's
certification.

If the designer's certification is located in the project archive files, it will be submitted to NCDENR
within 14 days. If the designer's certification is not located in the project archive files, it will be
prepared and submitted to NCDENR within 15 days of the completion of the pond maintenance.
2. Please submit a permit modification to address the BUA that was added without benefit
of approval from the Division,and which includes the proposed new storage building.
WK Dickson will compile an inventory of the current impervious surfaces at the site and will
compare the compiled impervious surface area with the permitted impervious surface area. Following
the evaluation of the impervious surface areas, WK Dickson will meet with NCDENR staff to
determine how to proceed with the permit modification.
WK Dickson anticipates that a meeting will be scheduled with NCDENR staff to discuss the permit
modification within 90 days.
3. Please maintain the pond system, check the sediment level, remove accumulated
sediment,clean out the trash,restore the sideslopes and repair the undercutting.
WK Dickson will work with the property owner to have the noted maintenance completed on the pond
system.
We anticipate that the pond maintenance will be complete within 60 days.
In addition to addressing the deficiencies itemized in the Notice of Inspection letter, the property
owner will prepare and submit a Name/Ownership change form to DEMLR.

Dear Mr. Andrews:
On December 9, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected Andrews Mortuary Hampstead Chapel at 17750 Hwy. 17 North, in
Fender County to determine the status of compliance with the State Stormwater Management Permit
Number SW8 940805 issued on November 28, 1994. DEMLR file review and site inspection revealed
that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the
findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Please submit the Designer's Certification.
2. Please submit a permit modification to address the BUA that was added without benefit of
approval from the Division, and which includes the proposed new storage building.
3. Please maintain the pond system, check the sediment level, remove accumulated sediment,
clean out the trash, restore the side slopes and repair the undercutting.
Please inform this Office in writing before January 10, 2015, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by January 10, 2015 then DEMLR staff will re-inspect the site and issue a Notice
of Violation if the listed deficiencies have not been addressed.
Please be advised that you are required to comply with the terms, conditions and limitations of the
Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and
North Carolina General Statute 143-214.7, including operation and maintenance of the permitted
stormwater system. Violations of the Stormwater Management Permit and/or the stormwater rules are
subject to the assessment of civil penalties of up to $25,000 per day per violation.
The Division notes that current owner of the property is Andrews Properties, Inc., however the 1994
permit was issued to Andrews Mortuary, Inc. Please note that it is your responsibility to notify the
Division of any mailing address, ownership or project name changes by submitting a completed and
signed Name/Ownership change form to DEMLR at least 30 calendar days prior to making the

The inspection was conducted after receiving a copy of the site development application that was submitted to Pander
County in preparation of building a new storage building. The file review and inspection revealed the following
deficiencies:
1.The project has not been certified by an appropriate designer. Please submit the designer's certification.
2.Additional built-upon area has been constructed without benefit of an approved plan. Please submit a permit
modification to address the past additions of built-upon area and the current proposed storage building.
3.The alternative design pond system needs to be checked for sediment accumulation,the trash needs of be removed
and the side slopes need to be repaired to address the steepness and the undercutting.

Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for issuance of the
permit.
On November 28, 1994, the former Division of Water Quality issued a stormwater management permit
to Andrews Mortuary for the construction of 1.65 acres of built-upon area. The permit allowed an overall
low density of 30% for the amount of BUA, however, due to the proposed piped collection system, the
permit also required treatment for the collected runoff. This treatment was permitted as a series of three
interconnected existing wet detention ponds, under the "innovative' system section of the 1988
stormwater rules.
On November 21, 2014, a minor site development application was submitted to Fender County for a
proposed 1650 square foot building located within Tract A-1. The addition of this building will require a
modification to the SW8 940805 permit. The overall density of the site must remain at or below the
originally permitted 30%. The 2008 stormwater rules allow you to claim your full BUA allocation of 30%
on the modified application, or 5.13 acres. After accounting for the parking lot expansion and the new
building, please designate the remaining BUA as "Future" on the application.
In addition, the Google map provided with the Pender County site development application appears to
show that the parking lot has been expanded. There is nothing in the stormwater file to indicate that this
expansion was ever submitted to or approved by the Division. Please note that per the second
paragraph of the November 28, 1994, permit, any modification of the plans submitted to and approved

The fifth paragraph of the permit requires the submission of an Engineer/Designer/Owner
Certification to verify that the permitted stormwater controls, project layout and the amount
of impervious area are in substantial compliance with the approved plan. To date, this
Certification has not been provided. Please include the required Certification with the
modified permit application request.
The original 1994 permit was issued to Andrews Mortuary, Inc. The Pender County site
development application lists the owner as Andrews Properties. The NC Secretary of State
has a listing for this corporation as Andrews Properties, Inc. Since the owner's company
name has changed, it is your responsibility as the permittee to submit a completed and
signed Name/Ownership change form to DEMLR at least 30 calendar days prior to making
the changes. These forms are available on our website at:

Please submit the modified permit application and the signed Name/Ownership Change
Form by January 2, 2015. You are required to obtain the modified state stormwater permit
