Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding Permit No. SW8 920903 dated February 13, 2012,for the construction, operation and maintenance of the BMP's and built-upon areas associated with the subject project. This permit shall be effective from the date of issuance until February 13, 2020,and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system,to record deed restrictions,to transfer the permit,or to renew the permit, will result in future compliance problems. A Designers Certification is required within 60 days of completion of construction of the stormwater treatment facility. Refer to Section 11.5 of the permit for all Designers Certification requirements. If any parts, requirements,or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by fling a written petition with the Office of Administrative Hearings(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30)days of receipt of this permit. This permit shall be effective from the date of issuance until February 13, 2020, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff a;; described in Section 1.8 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 248,902 square feet of impervious area. 3. A 50' wide vegetative buffer must be provided adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. 4. The tract will be limited to the amount of built-upon area indicated on page 3 of this permit, and per approved plans. The built-upon area for the future development is limited to 58,992 square feet. 5. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 6. The runoff from all built-upon area within the permitted drainage area(s) of this project must be directed into the permitted stormwater control system. Classification of Water Body: "SC;NSW' II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built-upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall, at all times, provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The signed and approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowiny and re-vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. Page 3 of 7 State Stormwater Management Systems Permit No. SW8 920903 6. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in this pond is 1/3 horsepower. 7. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities for inspection and maintenance shall be maintained via appropriate recorded easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built-upon area, details, etc. b. Redesign or addition to the approved amount of built-upon area or to the drainage area. C. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. Prior to the construction of any permitted future areas shown on the approved plans, the permittee shall submit final site layout and grading plans to the Division for approval. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. Page 4 of 7 State Stormwater Management Systems Permit No. SW8 920903 III. GENERAL CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the permittee or of the project, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change Form to the Division of Water Quality, accompanied by the supporting documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The; permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit remains in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re-issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The permittee shall submit a permit renewal request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Permit issued this the 13th day of February, 2012. The permitted amounts of surface area and/or volume have been provided. 12. Required drawdown devices are correctly sized and located per the approved plans. 13. All required design depths are provided. 14. All required parts of the system are provided, such as a vegetated shelf, and a forebay. 15. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The permanent pool elevation for a stormwater wet pond must be no more than 6 inches above the seasonal high groundwater elevation. If the permanent pool elevation exceeds the 6 inch maximum then the pond must be designed with a clay or synthetic liner from the bottom of the pond to the permanent pool elevation. Please note that this request for additional information is in response to a partial, preliminary review. The requested information should be received by this Office prior to February 15, 2012, or the application will be returned as incomplete. The return of a project will necessitate resubmlttal of all required items, including the application fee. If you need additional time to submit the information, please mail, email or fax your request for a time extension to the Division at the address and fax number at the bottom of this letter. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A. Please reference the State assigned project number on all correspondence. Any original documents that need to be revised have been sent to the engineer or agent. Meade, PhD on October 13, 2011 to evaluate potential suitability for onsite stormwater control modifying a previously permitted existing wet-detention pond. The soil series mapped for the location is GoA(Goldsboro) and Ra (Rains). METHODS: Two soil sample bore holes (#1 and #2) were performed for the detention pond. Locations are shown in Figure 1 with detailed information in Table 1. Soils are generally clay loam at upper depths to clay at deeper depths. CONCLUSIONS AND RECOMMENDATIONS: Soils in the proposed pond area were mainly GoA (Goldsboro) and Ra (Rains) series. Based on site contours, the existing ground elevations for the proposed pond expansion range between 41.3' to 41 X over the pond site. Soil layers were typically clay loam to clay and the estimated seasonal high water table (SHWT) was approximately 18" deep (Elevation approximately 39.8'-40.3'). The existing stormwater pond permanent pool elevation based on actual survey of the outlet pipe structure is 36.19' or approximately 41`1 below the SHWT elevation. The existing stormwater pond was permitted and constructed in 1992. The existing pond has been functioning properly for 19 years with no report of problems or issues. The current permit consists of a parking lot (Parking Lot#4) that utilizes a detention pond to treat runoff. Proposed modifications consist of addition of a new maintenance building and associated drive and parking that will utilize the existing detention pond with modifications as the BDfP. The, stormwater detention pond is designed to capture runoff generated by 1.5 inches of rainfall from all currently permitted and proposed impervious surfaces (including future parking lot) except one entrance drive to the site that is replacing an existing entrance drive that will be removed. The detention pond is designed to treat at 90% TSS removal without vegetated filter. The drainage area is approximately 340,640 SF with impervious area approximately 248,902 SF yielding a BUA/DA of 0.73. The SA/DA ratio value chosen was 7.5 from the Coastal (90%TSS Removal) SA/DA Table 10-4 based on an average pond depth of 3.5ft deep and 75%impervious area. Stormwater will be conveyed by sheet flow and piping to the modified stormwater detention pond before discharging the site into an existing drainage ditch. The ditch was evaluated by NCDENR Wilmington office (approximately end of November 2011)and determined it was not a stream feature near the point of discharge. The current permit consists of a parking lot (Parking Lot#4) that utilizes a detention pond to treat runoff. Proposed modifications consist of addition of a new maintenance building and associated drive and parking that will utilize the existing detention pond with modifications as the BMp.. The stormw^ater detention pond is designed to capture runoff from all currently permitted and proposed impervious surfaces (including future parking lot) generated by 1.5 inches of rainfall (drainage area is approximately 340,640 SF). Developer, or any subsequent successors and assigns are herein referred to collectively as the "Owners" and individually as "Owner". Operation and Maintenance Agreement—Non-Association Page 10 of 49 March 1,2:009 WITNESSETH WHEREAS, the City, under various state and federal laws, is required to regulate the maintenance of Structural BMPs (as defined herein) constructed to serve new or re-development within the City's planning jurisdiction to ensure that, following initial construction, the Structural BMPs are operated, maintained, and to the extent necessary, repaired in accordance with applicable state and federal laws; and WHEREAS, the City may be subject to substantial regulatory and financial penalties from the State of North Carolina and the federal government if the above-referenced rules and regulations are not applied to new or re-developments occurring within the planning jurisdiction of the City; and WHEREAS, the City Council of the City of Jacksonville has determined that, to maintain the City of Jacksonville's compliance under applicable state and federal regulations, certain obligations are to be met by Developers and subsequent owners of Structural BMPs; and WHEREAS, Developer is the owner in fee simple of that certain "Property" situated in Onslow County, North Carolina and more particularly described on Exhibit A; and WHEREAS, the Property is located within the planning jurisdiction of the City and subject to certain stormwater standards set forth in Jacksonville City Ordinance 2009-07 (the "Ordinance"), as may be amended from time to time; and WHEREAS, the Developer has submitted construction drawings depicting the Stormwater Area and Structural BMPs (both herein defined), for the purpose of establishing a stormwater management system for the Property, and WHEREAS, these Structural BMPs are required to comply with the Ordinance and that failure to maintain the Structural BMPs is a violation of the Ordinance potentially subjecting each lot owner of the Property to significant daily civil penalties and other enforcement actions; and WHEREAS, the City also requires that the Developer grant or dedicate to the City an access and maintenance easement over and across the Property and Stormwater Areas for the purpose of inspecting, maintaining, repairing, reconstructing and replacing the Structural BMPs set forth in the Ordinance and this Agreement; and WHEREAS, this Agreement has been procured in accordance with the requirements of N.C. General Statutes Chapter 143, Article 21, Part 1 and Jacksonville City Ordinance 2009-07. NOW, THEREFORE, for a valuable consideration, including benefits Developer may derive there from,the receipt of which is hereby acknowledged, the Owner and City hereby agree as follows: I. RECITALS. The foregoing recitals shall constitute an integral part of this Agreement, and this Agreement shall be incorporated herein and made a part thereof. 2. PROPERTY. As required by the City in connection with the development of this Property, the Developer shall install engineered stormwater control structures and other stormwater Operation and Maintenance Agreement—Non-Association page 11 of 49 March 1,2009 structural Best Management Practices (BMPs) and associated appurtenances and vegetation (collectively, the "Structural BMPs") as shown on the construction drawings prepared by Parker & Associates, Inc. entitled C.C-C.C. addrg Lot H5 Fqm� and dated 04 06 09 —on portion of Property as described in Exhibit B (the"Stormwater Areas"), for purposed of establishing a stormwater management system for the Property, and that Developer assumes specific maintenance, replacement, reconstruction and repair, responsibilities set forth in the Ordinance and with respect to the Structural BMPs; and 3. GRANT OF EASEMENT. Developer hereby dedicate, bargain, sell, grant, and convey unto the City, its successors and assigns, a perpetual, non-exclusive and irrevocable right and easement over, under, through, and across the Stormwater Areas and access through the Property to and from the Stormwater Areas for the purpose of permitting City inspection and, if deemed necessary, as determined by the City; maintenance, replacement, reconstruction, and repair of the Structural BMPs, as more fully set forth herein and in the Ordinance (the "Protection Easement"). Said easement shall be clearly identified and labeled on the approved final plat for Property. Said easements shall be permanent and shall run with the land. 4. CONSTRUCTION AND MAINTENANCE STORMWATER MANAGEMENT FACILITIES. The Developer shall be responsible for the construction of the Stormwater BMPs; and prior to conveying control of the Stormwater Area, their appurtenances and vegetation to another Owner by deed or easement, the Developer will be responsible for maintenance, repair, reconstruction, and replacement thereof in the manner specified herein and in strict compliance with the Stormwater Ordinance 2009-07 which is incorporated herein by reference and made a part thereof (the "Ordinance"). At all times, the Stormwater BMPs shall perform as designed and shall at all times comply with all applicable laws, ordinances, regulations, rules and directives of governmental authorities. 5. OWNERSHIP AND/OR TRANSFER OF PROPERTY AND STORMWATER AREAS. Developer agrees that it shall not transfer ownership and/or control of the Structural BMPs until construction has been completed in accordance with the Stormwater Permit, as defined in the Ordinance, approved Stormwater Areas and Structural BMPs plans, and the City has inspected and approved the same. In addition, the Developer and any new Owner must request that the Permit for the Structural BMPs be reissued to any subsequent Owner. The Developer agrees that it shall not transfer, convey, assign or otherwise relinquish or release its responsibility for the operation and maintenance of its Structural BMPs until a Permit has been issued to Developer's successor, or new owner at which time Developer shall be released from any obligations hereunder arising from events or circumstances occurring after the date the Structural BMPs is transfen-ed and the Permit is reissued to the new Owner of the Property; and 15. INSPECTION. The Developer, its successors and assigns, shall ensure that the Structural BMPs are inspected by one of the following professional services: Qualified Registered North Carolina Professional engineer, surveyor, landscape architect, soil scientist, aquatic biologist, or person certified by the North Carolina Cooperative Extension Service for Stormwater treatment practice inspection and maintenance (the "Professional"). The Professional shall submit an annual inspection report, a copy attached hereto as Exhibit C, which may be amended from time to time, to the City. The inspection report shall be due annually 30 days from the date of the final structural stormwater BMP construction Operation and Maintenance Agreement—Non-Association Page 12 of 49 March 1,2009 inspection approval by the City. The inspection shall cover the entire Stormwater Area as well as any Structural BMPs. 7. USE OF PROTECTION EASEMENT. The City, its officers, employees, contractors and agents may access the Property and enter the Stormwater Areas for purposes of exercising City's rights hereunder. This Agreement shall in no way obligate the City to maintain, replace, reconstruct and repair the Structural BMPs, and the City shall not be liable to any person, firm, partnership, company, corporation, governmental agency, or entity for the condition or operation of the Structural BMPs. Further, this Agreement shall in no way diminish, limit, or restrict the right of the City to enforce any of its ordinances as permitted by law. 8. DEFAULT. If the Developer, or subsequent Owners shall fail to comply with the foregoing requirements or any other obligations imposed herein, in the Ordinance as the same may be amended from time to time, the City, in its sole discretion, may perform such work and recover the costs thereof from the person who is then responsible for the performance of such requirements and obligations provided, however, that, except in cases of emergencies, the City will give the Owner written notification of deadline for correcting the violation and an opportunity to cure the Owner's default hereunder. If the City exercises its right hereunder and maintains, repairs, reconstructs or replaces all or a portion of the Structural BMPs, then following acceptance and payment of the work, the City shall deliver to the Owner written notice of the costs of such work, and the Owner shall pay all such costs within forty-five (45) days after receipt of such notice. Any costs not paid by the Owner to the City within the forty-five (45) day period shall be delinquent, and the Owner shall be considered in default of this Agreement. In the event of such default, the City may either bring an action at law against the Owner for the cost of the work, plus interest at the rate of eight percent (8%) per annum, collection costs, and reasonable attorney fees, or foreclose a lien against the Property, or both. Any payment required by this Agreement which is not paid to the City within thirty (30) days after its due date shall be delinquent. In the event of such default, the City may bring an action against the Owner for nonpayment plus interest at a rate of eight percent (8%) per year, collection costs, a late payment charge of three hundred dollars ($300) during the first forty five (45) days of default and five hundred dollars ($500) thereafter and reasonable attorneys' fees. The remedies set forth herein are cumulative; the City may, for example, bring an action for collection and foreclose its lien claim. 9. RESERVATION BY RECORD OWNER. The Developer and its successors and assigns shall in all other respects remain the owner of the Property, subject to the Protection Easement, and may make al I lawful uses of the Property not inconsistent therewith. 10. NO WAIVER OF RIGHT. The City does not waive or forfeit the right to take action to ensure compliance with the terms, conditions and purposes of this Agreement by a prior failure to act. 11. NOTICE. Written notice as required hereunder shall be provided to the City Manager of the City of Jacksonville at PO Box 128, Jacksonville, NC 28541, and to the Owner at Coastal Carolina Cortunur ty Collecte at 444 Western Blvd. , Jacksonville NC 28546 Written notice shall be deemed received four (4) days following its deposit, first class mail, with the United States postal system. In the event notice to the Owner is returned, the City may notify the Owner at the mailing address provided by the Onslow County Tax Assessor. The designation of Developer and Owner shall include the heirs, assigns, and successors to the Developer and Owner. The designation of City shall include the assigns and successors to the City. 13. TERM. This Agreement shall continue as a servitude running in perpetuity with the Property. 14. CONTROLLING LAW. This Agreement is to be governed by the laws of the State of North Carolina. Any and all applicable laws, rules, and regulations, ordinances, codes, and orders of any and all governmental bodies, agencies, authorities, and courts will be construed pursuant to the laws of the State of North Carolina. All claims and disputes arising from any contract shall be construed pursuant to the laws of the State of North Carolina. The State of North Carolina is the proper jurisdiction for all claims and disputes arising under any contract and the proper venue is the Onslow County Superior Court. 15. INDEMNIFICATION. Developer and successors and assigns agree to protect, defend, indemnify and hold the City, its officers, employees and agents free and harmless from and against any losses, penalties, damages, settlements, costs, charges, professional fees or other expenses or liabilities in connection with or arising out of this Agreement and/or the performance hereof that are due to the negligent:acts of the Developer, its officers, employees, or agents. TO HAVE AND TO HOLD the aforesaid rights, privileges and easements herein to the City, its successors and assigns forever, and Developer does covenant that Developer are seized of said premises in fee or by easement and have the right to convey the same, the Developer will warrant and defend such title to the same against claims of all persons whosoever. Coastal Carolina Community College, as OWNER, will be responsible for proper maintenance of the pond. The following list is a guideline to help the OWNER properly maintain this system. 1. To assure that the pond will not fill with sediment during the construction period of Parking Lot #4, it is imperative that the erosion and sediment control measures designed be installed and maintained properly to prohibit any sediment from entering the pond until stabilization of the entire site has occurred. Grassing requirements should he followed strictly and a stand of grass shall be provided within 30 days to stabilize the dike and embankments and assure minimal erosion. Rip rap structures should be installed and maintained as shown and described in the plans and the erosion and sedimentation control "Narrative Report" to help reduce erosive velocities of stormwater encountered. Once stabilization has occurred these items should be checked on a monthly basis and properly repaired should any damage occur. 2. A pumping system will be required to completely drain the pond for maintenance. Bottom of pond elevations should be checked every year to determine the amount of sediment build-up. If sediment build-up is greater than one foot, the pond should be drained and excavated to the original pond bottom elevation.
