Dear Mr. Deal:
On September 16'”, 2021, the Governor signed Session Law 2021-158. As of January 1,2022, Section 4(b)of
this law revokes all low density certifications and approvals issued prior to September 1, 1995 and considers the
built-upon area as existing development for the purposes of G.S. 143-214.7(al).
The Division has reviewed the file for this low density project, last approved on March 5, 1992 as a Certificate of
Compliance, and confirmed that this project meets the requirements to be revoked. Therefore, in accordance with
Session Law 2021-158, this permit has been revoked effective January 1, 2022 and the built-upon area associated
with this project will now be considered existing.development. Any future development on the project or site
shall comply with the requirements of G.S. 143-214.7 and any recorded deed restrictions.

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in our custody readily
available to the public for review and copying. We also have the responsibility to the public to safeguard these records and to carry
out our day-to-day program obligations. Please read carefully the following guidelines signing the form:
L Due to the large public demand for file access, we request that you call at least a day in advance to schedule an
appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm. Viewing time ends at
4:45pm. Anyone arriving without an appointment may view the files to the extent that time and staff supervision
is available.
2. You must specify files you want to review by facility name. The number of files that you may review at one time will
be limited to five.

5. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be taken from the office. To remove,
alter,deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can be fined up to
$500.00. No briefcases large totes etc are permitted in the file review area.

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater controls
conducted on April 25, 1994 to determine compliance with Stormwater Certification Number 920122
issued on March 5, 1992.
A summary of the findings and comments are noted under Section 6 of the report. Appropriate
action, if required, should be completed by May 29, 1994. Please inform this Office by letter when

4. Maintenance Problems:
1. Catch basins have been constructed at the pipe inlets that are not shown on the approved
plans. I have reported this to Carol Miller of the Land Quality Section.
5. PE Certification Received? N/A Deed Restrictions Received? NO
6. Comments:
1. The density option requires that piping be kept to a minimum and only under roads. Will
the piping and basins be removed when construction is complete? Are you planning to
create one more lot in the space the basin now occupies?
2. Since construction of the homes has begun, please provide this Office with a copy of the
recorded deed restrictions indicating the allowable built-upon area limitation of 2,300
square feet per lot.
