Mr. Turner,
Some low density permits/certificates of compliance that were issued before 9/1/1995 have been revoked by the
Legislature. I did a quick review of this one, and it appears that it may qualify. We are in the process of identifying
applicable projects and contacting them. Specifically, here is what the new law says:
Section 4(b)of SL 2021-158 says:
SECTION 4.(b) Low density stormwater certifications and approvals issued prior to September 1, 1995, are
revoked as of January 1, 2022, and the built-upon area shall be considered as existing development for
purposes of G.S. 143-214.7(al). Any future development on the project or site shall comply with the
requirements of G.S. 143-214.7 and any recorded deed restrictions.

On October 4, 1989, the Wilmington Regional Office issued a Certification of Compliance with Stormwater
Regulations to you for Joniquins Landing Subdivision. Per the requirements of the Certification, a copy of the recorded
deed restrictions must be forwarded within 30 days of the date of recording. A review of our files indicates that a copy
of the recorded deed restrictions has not been received by this Office. Additionally, this Office received a call from a
homeowner concerned about the lack of such restrictions in the covenants, and how it will affect him.
Failure to record and/or provide a copy of the recorded deed restrictions is a violation of your Certification, and
subject to enforcement action. Please forward a copy of the recorded deed restrictions to this Office at the address below
by December 7, 1996, or enforcement action may be initiated and may include recommendations for civil and criminal
penalties and revocation of the Certification. If you have any questions, please do not hesitate to call me at(910) 395-3900.
