Bowling: on December 21 , 1990 , the Wilmington Regional Office received a request for modification of the restrictive covenants for Island Quay Subdivision . Based on our review of the revised restrictive covenants which limit the built-upon area on each of the 50 lots identified as follows : A. 2 , 500 square feet for Lots 32 & 35 ( 2 ) B. 2 , 000 square feet for lots 33 & 34 ( 2 ) C . 2 , 152 square feet for lot 30 ( 1 ) D . 1 , 482 square feet for lot 31 ( 1) E . 1 , 817 square feet for the remaining 44 lots ( 44 ) we have determined that the project complies with the Stormwater Regulations set forth in Title 15A NCAC 2H . ( a) ( 2 ) . This Certification shall be effective from the date of issuance until rescinded and the project shall be constructed in accordance with the plans and specifications as filed with the Wilmington Regional Office . Any modification of the plans submitted to this Office or further development of this site will require an additional Stormwater submittal/modification and approval prior to initiation of construction . Lot 30 is presently in non-compliance with stormwater regulations as stated in the restrictive covenants . As President of Island Quay Homeowners Association, I am requesting a modification to the restrictive covenants to modify Lot 30 from 1817 square feet to 2152 square feet, and to modify Lot 31from 1817 square feet to 1482 square feet. I am enclosing an addendum to the restrictive covenant portion of the stormwater certification 880622 to reflect these changes . This addendum will be recorded at the Carteret County Register of Deeds . Please accept this letter with Notary Seal as my acknowledgment of changes to Lots 31 and 30. Bowling, the owner of Island Quay Subdivision, in Atlantic Beach, Carteret County, North Carolina, do hereby state that the restrictive covenants for said subdivision will contain a statement of restriction limiting the residents to no more than: A. 2 , 500 sf built upon for Lots 32 & 35 ( 2 ) B. 2 , 000 sf built upon for Lots 33 & 34 ( 2 ) C. 2 , 152 sf built upon for Lot 30 ( 1 ) D. 1, 482 sf built upon for Lot 31 ( 1) E. 1, 817 sf built upon for remaining lots ( 44 ) This shall apply to lots covered by structures and/or paved surfaces, including walkways or patios of brick, stone, slate or similar materials .
