Dear Mr. Evans:
The Wilmington Regional Office received a complete, modified State Stormwater Management Permit
Application for the Long Beach Crossing—Outparcel 1 and portion of Outparcel 5 on December 22,
2016. Staff review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 2I L 1000 and Session Law 2008-
211. We are forwarding modified Permit No. SW8 160907 dated February 24, 2017, for the construction,
operation and maintenance of the stormwater control measures(SCMs) and built-upon area associated
with the subject project.
This permit shall be effective from the date of issuance until August 21, 2022, and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the conditions listed in this
permit regarding the Operation and Maintenance of the SCMs, recordation of deed restrictions,
certification of the SCMs, procedures for changing ownership, transferring the permit, and renewing the
permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to certify the SCMs, to transfer the permit, or to renew
the permit, will result in future compliance problems.
The following modifications are included and covered by this permit:
•1. The subdivision from the area originally approved under SW8 140614.
2. Since project is being split in two and the stormwater control measures associated will) this
portion are not changing, the expiration date is retraining consistent with the original permit.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty(30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process

Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of one (1) Contech Stormfilter, one (1) area of
excluded redevelopment, and the construction of impervious areas with runoff to be treated in
an offsite permitted stormwater facility in compliance with the provisions of 15A NCAC 2H
.1000 and Session Law 2008-211 (hereafter referred to as the "stormwater rules') the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land
Resources (hereafter referred to as the Division or DEMLR) and considered a part of this
permit. The stormwater runoff from the areas to be treated in an offsite permitted stormwater
facility will be routed to a wet detention pond operated and maintained by VNC — Southport,
LLC under the terms and conditions set forth in the latest version of Permit No. SW8 140614.
This permit shall be effective from the date of issuance until August 21 , 2022 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. The onsite stormwater system has been approved for the management of stormwater
runoff as described in Section 1.9 of this permit. The runoff associated with the offsite
portions of this project has been approved to be discharged into the offsite stormwater
system permitted under the latest version of SW8 140614.
3. The runoff from all built-upon area within the permitted drainage areas of this project
must be directed into the permitted stormwater control measures, either onsite or
offsite. The drainage areas associated with the onsite stormwater control measure
labeled West Pond, the area of excluded redevelopment, and the area being treated in
an offsite stormwater facility have been approved for 202,976, 50,855, and 18,425
square feet of built-upon area, respectively. The amount of built-upon area allocated
to the offsite portion by Stormwater Management Permit No. SW8 140614 is limited to
18,425 square feet and therefore no additional built-upon area is available for future
development within the offsite portion.

4. The maximum built-upon area allowed for the entire subdivision is 272,256 square
feet.
5. The drainage areas will be limited to the amounts of built-upon area indicated in
Sections 1.3, 1.4, 1.10, and 1.11 of this permit, and per approved plans. This permit does
not provide any allocation of built-upon area for future development.
6. A 30' wide vegetative buffer must be provided and maintained adjacent surface
waters, measured horizontally from and perpendicular to the normal pool of
impounded structures, the top of bank of both sides of streams and rivers and the
mean high water line of tidal waters.
7. A vegetated filter strip is not required for the Contech Stormfilter; however, all
discharges into and through the vegetated buffer must provide diffuse flow. A level
spreader is being provided to achieve the diffuse flow requirement.
8. All runoff being directed into wetlands shall flow into and through those wetlands at a
non-erosive velocity.
9. Prior to the discharge of stormwater runoff from any lot into the approved stormwater
system, the permittee shall ensure that the owner of the lot has obtained a separate
Offsite Stormwater Management Permit.
10. The following design elements have been permitted for the pond storage and Contech
Stormfilter stormwater facility. These design elements must be provided in the system
at all times.

11 . The redevelopment portion of this project, Drainage Area 3, is excluded from State
Stormwater permitting requirements under the following conditions: 1) The project
must be constructed as shown on the plans submitted to this Office; 2) the proposed
impervious area of 50,855 square feet does not exceed the existing impervious area of
126,061square feet; and 3) The proposed stormwater control, directing the roof runoff
to a proposed level spreader and forested filter strip, provides equal protection of
surface waters as the existing stormwater control, which is the piped collection and
discharges directly into Jump and Run Creek.

II. SCHEDULE OF COMPLIANCE
1. Per S.L. 2012-200, Part VI. NCDENR shall not require the use of stormwater retention
ponds, stormwater detention ponds, or any other stormwater control measure that
promotes standing water in order to comply with the FAA Advisory Circular No.
150/5200-33B at public airports that support commercial air carriers or general aviation
services, and at development projects within 5 miles of those airports. This project is
being permitted consistent with S.L. 2012-200 and a copy of the permit is being
forwarded to the Brunswick County Airport Commission who may elect to adjudicate
the permit.
2. This permit, as well as the location of the vegetated buffer and the built-upon areas
shown on the approved plans, is contingent upon the permittee obtaining the
necessary approvals and permits from US Army Corps of Engineers and/or the
Division of Water Resources to pipe a portion of Jump and Run Creek as shown on
the plans. If the other approvals and permits are not obtained this may impact the
location of the vegetated buffer and the extent of the built-upon areas shown on the
state stormwater approved plans. Any changes made to the plans in order to obtain
these other permits will require a plan revision or modification to this state stormwater
permit. This permit is effective only with respect to the nature and volume of
stormwater described in the application and other supporting data.
3. The offsite portion of this permit is issued contingent on the construction of the
permitted offsite stormwater system being complete and in compliance with the
conditions of permit number SW8 140614, issued to VNC — Southport, LLC on
February 24, 2017, as subsequently revised, modified, transferred, or renewed. Prior
to the construction of any built-upon area associated with this permit, the offsite
permittee shall have constructed, operated, maintained, and certified the offsite
stormwater management system in compliance with SW8 140614.
4. This lot is limited to the amount of built-upon area specified in Section 1.3 of this
permit, and as reported on the application, the supporting calculations and as shown
on the approved plans. The project must maintain a built-upon area less than or equal
to the amount permitted under Stormwater Permit No. SW8 1040614. A total built-
upon area in excess of the maximum allowed amount will require a modification to
SW8 140614 prior to construction.
5. No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has
approved of the revised plan.
6. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built-upon surface.
7. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately. If the stormwater system is used as an Erosion
Control device, it must be restored to design condition prior to operation as a
stormwater treatment device, and prior to occupancy of the facility.
8. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 160907, as issued by the
Division of Energy, Mineral and Land Resources under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.

d. The covenants pertaining to stormwater may not be altered or rescinded without
the express written consent of the State of North Carolina, Division of Energy,
Mineral and Land Resources.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division of Energy, Mineral and Land Resources.
f. The maximum imperious area per lot is as follows:

This allotted amount includes any impervious area constructed within the lot
property boundaries, and that portion of the right-of-way between the front lot
line and the edge of the pavement. Impervious area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking
areas, but does not include raised, open wood decking, or the water surface of
swimming pools.
g. All runoff from the impervious areas on the lot must drain into the permitted
system. This may be accomplished through providing roof drain gutters, which
drain to the pond or street, grading the lot to drain toward the street or directly
into the pond, or grading perimeter swales and directing them into the pond or
street.
h. Impervious area in excess of the permitted amount will require a permit
modification.
i. All affected lots shall maintain a 50' wide vegetative buffer adjacent to surface
waters, measured horizontally from and perpendicular to the normal pool of
impounded structures, the top of bank of each side of streams and rivers and
the mean high water line of tidal waters.
j. Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the requirements of the Stormwater Rules is
subject to enforcement procedures as set forth in G.S. 143, Article 21.
k. Each lot within the subdivision whose ownership is not retained by the
permittee, must submit a separate Offsite Stormwater Management Permit
application package to the Division of Energy, Mineral and Land Resources and
receive a permit prior to any construction on the lot.
9. A copy of the recorded deed restrictions must be submitted to the Division within 30
days of the date of recording the plat, and prior to selling lots. The recorded copy must
contain all of the statements above, the signature of the Permittee, the deed book
number and page, and the stamp/signature of the Register of Deeds.
10. If permeable pavement BUA credit is desired, the permittee must submit a request to
modify this permit to incorporate such language as required by the Division. The
request to modify must include a proposed amendment to the deed restrictions and
protective covenants for the subdivision, and a soils report identifying the type of soil,
the Seasonal High Water Table elevation and the infiltration rate. Upon the successful
completion of a permit modification, the individual lot owners that request to utilize
permeable pavements shall submit the necessary forms and documentation to the
permittee, or a designated agent, and receive approval prior to construction of the
permeable pavement.
11. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at design
condition. The approved Operation and Maintenance Agreement is incorporated by
reference into this permit and must be followed in its entirety and maintenance must
occur at the scheduled intervals.

12. The permittee is responsible for keeping the stormwater collection system within
the lot property boundaries clear of trash debris and sediment, and must control
the sediment on the lot in accordance with the requirements of the NC Erosion and
Sediment Control Design Manual. The permittee shall follow the minimum
maintenance procedures and intervals for the lot's built-upon areas and its
stormwater collection / conveyance system as indicated in the Operation and
Maintenance agreement.
13. The permittee shall maintain and repair or replace any of the components of the
lot's stormwater collection and conveyance system such that the lot's runoff is
captured and adequately conveyed to the stormwater system.
14. Records of maintenance activities must be kept and made available upon request to
authorized personnel of the Division. The records will indicate the date, activity, name
of person performing the work and what actions were taken.
15. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.
16. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, the permittee shall cause a certification from
an appropriate designer for the system installed to be submitted, certifying that the
permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A modification
may be required for those deviations.
17. All stormwater collection and treatment systems must be located in either public rights-
of-way, dedicated common areas or recorded easements. The final plats for the
project will be recorded showing all such rights-of-way, common areas and
easements, in accordance with the approved plans. Access to the stormwater
facilities for inspection and maintenance shall be maintained via appropriate recorded
easements at all times.
18. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built-upon area, details, etc.
b. Redesign or addition to the approved amount of built-upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The construction of any future BUA listed on the application.
19. Prior to transfer of the permit, the stormwater facilities will be inspected by Division
personnel. The project and the stormwater facility must be in substantial compliance
with all permit conditions. Any items not in substantial compliance must be repaired,
replaced or restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.
20. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.

Ill. GENERAL CONDITIONS
1. Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the Stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.
2. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
3. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
Additional or replacement stormwater management systems shall receive a permit
from the Division prior to construction.
4. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least 60
days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made subject
to the recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256,
C. Bankruptcy;
d. Foreclosure, subject to the requirements of Session Law 2013-121;
e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e)
and NCGS 57D-6-07;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
5. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.
6. The permittee grants DEMLR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until modified, revoked, terminated
or renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re-issuance or
termination does not stay any permit condition.
8. Approved plans, calculations, supplement forms, operation and maintenance
agreements and specifications for this project are incorporated by reference and are
enforceable parts of the permit. A copy of the approved plans and specifications shall
be maintained on file by the Permittee at all times.
9. Unless specified elsewhere, permanent seeding requirements for the stormwater
control measure must follow the guidelines established in the North Carolina Erosion
and Sediment Control Planning and Design Manual.

10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules and regulations contained in Session Law 2006-246, Title
15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11 . The permittee shall submit a permit renewal application request at least 180 days prior
to the expiration date of this permit. The renewal request must include the appropriate
application, documentation and the processing fee.

12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, a
forebay, and the vegetated filter.

Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and
Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application

submitted to the appropriate DEMLR Office. (The appropriate office may be found by locating project on the

Sections IV.4 and 7 of the application should be the sum of the onsite drainage areas listed in the two drainage area
columns and should be representative of the actual property area owned by the applicant.
Also, do not delete the second column from Section IV.10. This is necessary to describe that there are two separate

I'm trying to work through item 1 in your add-info letter- happy to discuss this with you on the phone but wanted to let
you know what I'm looking at and let you get your head back in it rather than catching you cold.
I talked this over with Nick Lauretta trying to make sure I understood what you are looking for. Speaking specifically to
your example in item 1A of your add-info request, his interpretation was that I should not have included the drainage
area/BUA that is in the area owned by VNC Southport and flowing towards the Food Lion site on this application since it
is covered in an offsite supplement in a separate permit. See attached SWU-101 sheet marked up for what I'm trying to
say here. It just felt odd to me not to include this area in the submittal for VNC Southport in some fashion. But
admittedly, I have only done a couple of offsite supplements and it has been quite a while.

And FYI - not sure if you recall the project we were working on just south of the Visconsi project. It was for a proposed
hotel with a bridge crossing that would tie to the Visconsi site. We did an express scoping on it with you a few months
ago. One stipulation was that the Visconsi mess be straightened out prior to submittal. Well since that time, the
developed decided not to do the bridge crossing so we are about to submit our express submittal request without it-

hopefully I will get that submittal to Cameron tomorrow. I just didn't want it to catch anyone off guard since we had
discussed that stipulation previously that is no longer applicable.

Dear Mr. Visconsi and Mr. Rufty:
The Wilmington Regional Office received and accepted State Stormwater Management Permit
Applications for the subject projects on September 1, 2016. A preliminary in-depth review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. 15A NCAC 02FI.1003(g)(7):
iv a. Please confirm that the property area presented in Sections IVA and 7 of the application
(vJ are consistent with the onsite property or drainage area to be covered under the permit.
c t,h For instance, in the application to modify SW8 140614, Sections IVA and 7 of the
l ,roI`1A o^ application indicate that the property area is 4.64 acres: however, this appears to correlate
with the drainage area to the pond, which includes offsite area, and excludes the second
drainage area being treated in an offsitc system.
✓b. Please confirm that the onsite and offsite impervious areas presented on each application
are consistent with the recorded deed restrictions. For instance, the second drainage area
associated with the application to SW8 140614 lists the offsite impervious area as being
46,294 for lot 5. However, the deed restrictions allocate 47,180 square feet.
2. Recommendation: Please double check that all the information reported on the application form,
the supplement form(s) and the calculations is accurate and consistent.
Please remember that a change to one number may have a domino effect on other numbers. Please check
all plans, calculations and forms to ensure that the numbers are consistent throughout.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to December 29, 2016, or the application
will be returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee.

If you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information, which shall be no later than 30
days past the original due date. 'file Division is allowed 90 days from the receipt of a completed
application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation ofNCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.
