sketches from tax records used as a sample for the calculations.

located upon the Common Elements, platted conservation, and buffer areas, and areas with similar
descriptions, landscaped areas within road rights-of-way, the stormwater runoff and treatment systems,
excluding driveway pipes and swales adjacent to lots, stormwater ponds,sign easement areas,and fences or
other property designated to be maintained by the Association
ARTICLE 9
Restrictions on Use and Occuoancv
Section I No Lot shall be used except for single-family residential purposes No commercial
use shall be permitted on any Lot. No structure shall be erected, placed or permitted to remain on any Lot
other than one(1)detached,single family residence dwelling not to exceed two and one-half stones in height
above floor or piling level and such outbuildings as are usually accessory to a single family residence
dwelling, including a pnvate enclosed garage
Section 2 Any dwelling constructed on a Lots subject to these Protective Covenants shall
contain not less than 1000 square feet of fully enclosed and heated floor space all devoted to living purposes
(exclusive of roofed or unroofed porches, breeze ways, terraces, porches, steps, walks, garages and any
outbuildings) In computing the number of square feet allowed as provided herein,no square footage in any
part of the dwelling that is constructed over a garage will be counted,unless it is an integral part of the living
space and approved by DECLARANT In the event of hardship, the Declarant or its successor in its sole
discretion may grant a variance of up to ten percent (10%)from the minimum square footage requirement
Section 3 All Lots are subject to the State of North Carolina rules and regulations concerning
stormwater runoff as these rules and regulations are set out herein and are as amended from time to time
a) The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number SW8140321 and modifications,as issued by the Division of Energy, Mineral
and Land Resources under NCAC 2H 1000
b) The maximum built-upon area of impervious surface for Lots in ADAMS LANDING shall
by,3,300 square feet for all lots including future sections These allotted amounts include any built-upon
area constructed within the Lot property boundaries, and that potion of the right-of-way between the front
lot tine and the edge of the pavement Built upon area includes, but is not limited to, structures, asphalt,
concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood
decking, or the water surface of swimming pools.
c) The State of North Carolina is made a beneficiary of these covenants to the extent necessary
to maintain compliance with the Stormwater Management Permit
d) These covenants are to run with the land and be binding on all persons and parties claiming
under them
e) The covenants pertaining to stormwater may not be altered or rescinded without the express
written consent of the State of North Carolina,Division of Energy,Mineral and Land Resources

Dear Ms. Sharp:
The Wilmington Regional Office of the Division of Energy,Mineral and Land Resources(DEMLR) received and
accepted a signed Permit Transfer Application Form for the subject project on March 3, 2023. The current and
proposed permittees have requested to transfer the permit in accordance with 15A NCAC 02H.1045(1)(a).A
preliminary in-depth review of the documentation submitted with the transfer request determined that the
application is incomplete, and that additional information is needed.
Since the transfer was submitted under 15A NCAC 02H.1045(1)(c) and G.S. 143-214.7(c5), please provide the
following documentation in a single, hard cony submittal package to complete the application:
1. Impervious Area per Lot [15A NCAC 02H.1045(2)(e)]: Since the project has been built, please provide
documentation that the maximum allowed built-upon area per lot has not been exceeded. The permittee's
lot review records, tax records, aerial photos,and/or lot surveys can be used to demonstrate the allocated
BUA has not been exceeded.
2. Operation and Maintenance Agreement(O&M) [15A NCAC 021i.1045(2)(d)]: Please provide an
operation and maintenance agreement from the proposed permittee signed by Joy Sharp. (Please ensure it
is an original signature as opposed to a copy.) I have attached the current O&M Agreement signed by the
outgoing permittee as well as a copy of a blank form. Please submit the signature page. Your signed
form will become an addendum to the current O&M Agreement.
Notice of Inspection
On May 28, 2023, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project to determine the status of compliance with this permit, most recently
issued on March 1, 2023. DEMLR file review and site inspection revealed that the site is in compliance with the
terms and conditions of this permit. A copy of the completed form entitled "Compliance Inspection Report"
summarizing the findings of the recent inspection is attached to this letter.
All of the requested information listed above should be received in this Office by June 29,2023 in accordance
with 15A NCAC 02H.1045(4)(a)(i). Please note that only two letters requesting additional information is allowed
in the State Stormwater Program, this being the first. If the required information is not satisfactorily provided by
this date,the project will be returned in accordance with 15A NCAC 02H.1045(4)(a)(ii). If the project is returned
and you wish to re-submit later, you will need to resubmit all required items at that time, including the application
fee.

Please note that if, upon review of the submitted information or upon a deficient compliance inspection of the
project, it is determined that a major modification to the permit is required to resolve the compliance issues, the
transfer application will be returned as incomplete. Upon the issuance of the modified permit, and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition,the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.
Please remember that the permittee is responsible for complying with the terms and conditions of the permit and
the approved plans and specifications until the Division approves the transfer request.

1. Dale Ward: Proof of notice of meeting which included solicitations for 2 open board position
nominations and budget

c. There were only 9 members represented at the meeting meaning the 50%attendance
(21 members) required for quorum was not met.

are no common areas from sidewalk to the roadway. Should be a DOT right-of-way. DOT
however will not maintain strip of grass.

Contract for Adam's Landing- Pond Maintenance ,m
ALL ABOUT PONDS, LLC, will assume responsibility for the maintenance of the
Adam's Landing pond effective January 1st. 2023. After the completion of one year,
either party may terminate this contract within thirty days of written notification.
At the request of Adam's Landing HOA, ALL ABOUT PONDS, LLC, will assume
responsibility for the maintenance of the pond at Adam's Landing. Under this contract
ALL ABOUT PONDS, LLC will be responsible for maintaining all aquatic growth in the
ponds within reasonable limits in compliance with all regulatory authorities having
jurisdiction over it. The pond will be monitored and inspected on a monthly basis and
any applications needed, will be made at that time. If problems arise between routine
monthly inspections, please call so that corrective action can taken before the next
inspection. ALL ABOUT PONDS, LLC reserves the right to use any of the following
treatment methods or combinations thereof to control and maintain pond quality. This
includes, but not limited to: chemical applications, bacterial maintenance, dyes, and,or
fish such as; Tilapia, Channel Catfish, or Grass Carp.
Our pond service includes monthly visits, state required inspections, all necessary
chemical or biological applications to maintain aquatic growth within reasonable limits,
and trash removal in and immediately around the ponds. Any additional requirements
such as: dredging, sediment removal, overflow or pipe replacement, fountains and
aerators, erosion control due to repair work or flooding, storm debris or damage,
rip-rap replacement, or additional fish stocking will be at extra cost to Adam's
Landing HOA. Additional work not covered under the contract will not be conducted
without proper notification of the management.
ALL ABOUT PONDS, LLC will perform these services for............$65.00 per month
Our maintenance schedule will be performed as follows:
Monthly
A. Inspect trash rack, inlets and outlet basin. Clean debris and trash from inlets, outlet
basins and trash racks.
B. Inspect pond side-slopes for vegetation coverage and length, erosion, and remove
any debris and trash.
C. If a vegetation filter is used to operate the pond, the filter will be checked for
sediment and trash accumulation, erosion and proper operation of the flow spreader
mechanism.
D. Any needed chemical or biological maintenance of aquatic vegetation in the pond will
be performed.
E. A record will be kept of the inspection and visit. Any damage or deficiencies will be
reported and an estimate will be provided to Adam's Landing HOA for the repairs.
Repairs will not be.performed without approval from Adam's Landing HOA.
Quarterly
A. Along with the monthly requirements, perform inspection of the collection system
(i.e. catch basins, piping, grassed swales) for proper functioning. Any damage or
deficiencies will be reported and an estimate will be provided to Adam's Landing
HOA for the repairs. Repairs will not be performed without approval from Adam's
Landing HOA.
B. Accumulated trash will be removed from the basin grates and piping will be
checked for any obstructions.
C. Inspect inlets, outlet basin and trash racks for damage, erosion, and undercutting
Any damage or deficiencies will be reported and an estimate will be provided to
Adam's Landing HOA for the repairs. Repairs will not be performed without
approval from Adam's Landing HOA.
D. Along with and including the vegetated filter, if,applicable, grassed swales will be
inspected for vegetated coverage. Any damage or deficiencies will be reported and
an estimate will be provided to Adam's Landing HOA for the repairs. Repairs will not
be performed without approval from Adam's Landing HOA.
E. A record will be kept of the inspection.
Semi-Annual
A. Along with the monthly and quarterly requirements, inspect outlet basin for
accumulated sediment. If sediment has accumulated a report will be taken and an
estimate will be provided to Adam's Landing HOA for its removal. Repairs will not be
performed without approval from Adam's Landing HOA.
B. Pond depth is to be checked at various points. If the pond depth is reduced to 75% of
original design, a report will be taken and an estimate will be provided to Adam's
Landing HOA for the.repairs. Repairs will not be performed without approval from
Adam's Landing HOA.
C. A record will be kept of the inspection and depth certification.
Copies of all depth recordings and,reports will be available upon request. As well the
pond can be re-evaluated after one year upon the request of Adam's Landing HOA.
Additional repairs will be the responsibility of the Adam's Landing HOA. These include

A. Inspect and remove any debris from the trash rack and area in and immediately
around the ponds.
Included
B. Check pond side-slopes; remove any debris and trash. Any minor eroded areas are
to be repaired and noted on the monthly pond report.

C. If a vegetation filter is used to operate the ponds, the filter will be checked for
sediment and trash accumulation, erosion and proper operation of the flow spreader
mechanism. Repairs will be made as necessary and a record will be kept of the
inspection and cleaning visit.
Inspection is included, repairs would be extra.
D. Any needed chemical or biological maintenance will be performed.

Quarterly
A. Along with the monthly requirements, perform inspection of the collection system (i.e.

reseeded twice a year or as necessary. Minor erosions will be repaired immediately.
Any major erosion caused by things such as flooding, heavy rains, and repair work
will require approval from Adam's Landing HOA before additional work above the
contract is performed. This process will need to be performed in a timely fashion.
Inspection and reseeding are included, major erosion repairs extra.
D. A record will be kept of the inspection. Included
Semi-Annual
A. Along with the monthly and quarterly requirements, accumulated debris and
sediment from the bottom of the outlet structure will be removed.

B. Pond depth is to be checked at various points. If the pond depth is reduced to 75% of
original design, upon permission of the Adam's Landing HOA, sediment will be
removed, to the original design depth, at a cost additional to the monthly fee.
Inspection is included, dredging and sediment removal is extra.
C. A record will be kept of the inspection and depth certification.

Annual
A. In addition with the monthly, quarterly and semi-annual requirements, pond depths
are to be checked at various points. If the pond depth is reduced to 75% of original
design or 3 feet, whichever is greater, upon permission of Adam's Landing HOA,
sediment will be removed, to the original design depth. Depth is measured vertically
from the draw down orifice to the pond's bottom. Any removal of accumulated
sediment will not be included in the monthly maintenance fee.
Inspection is included, dredging and sediment removal is extra.
B. A record will be kept of the inspection and depth certification.
Included
Copies of all depth recordings and reports will be available upon request. As well the
pond can be re-evaluated after one year upon the request of Adam's Landing HOA.

(paper files)from a flood from Florence. How do you move forward without it given that the Pond has a
company who maintains it and or is there a way to recreate it?
Please advise, or have the reviewer advise me what else we can do to move this forward.

ADAMS LANDING HOA Annual Membership Meeting Minutes
Thursday, November 18, 2021, 5:30pm CEPCO main office- 1628 Doctors Circle, Wilmington, NC 28401
Board members in attendance:

Dale Ward-CEPCO Community Manager
Meeting Began at 5:35 pm.
The following was discussed at this meeting:
1. Dale Ward: Proof of notice of meeting which included solicitations for 2 open board position
nominations and budget
2. Dale:Attendance
a. 6 Mailed in Proxy
b. 3 Homeowners
c. There were only 9 members represented at the meeting meaning the 50%attendance
(21 members) required for quorum was not met.
3. The budget ratification does not need quorum to be approved. Budget ratified.
4. There was 1 nomination form submitted. Incumbents keep their positions
5. Dale: Reviewed Balance Sheet
a. Explained overage in Reserves-Pond category as funds being held for pond
maintenance/dredging
i. Joy Sharp: How often is pond dredging required &who reports this& performs
this
ii. Dale: Average 15-20 years, pond co will notice this and notify CEPCO
6. Dale: Review of Income Statement ending 8/31/2021
a. Increase in Insurance due to claim filed and pay out regarding 2 homeowners and a
general rate increase
i. Joy: Is insurance shopped at renewal?
ii. Dale: Yes generally. Will speak to Cindy(Ins rep) prior to Feb 2022 renewal
b. Dale: Landscaping line item discussion
I. Andrew/Joy: Holiday decor not up yet.We do want to keep the holiday decor at
the signage.
ii. Dale: Will check with landscapers on why this hasn't been done yet.
c. Dale: HOA is owed $330 as of 8/31/2021 from homeowner dues
I. HOA is owed $1100 at time of meeting

7. Dale: Review of Operating Budget
a. Increase in Management fees charged by CEPCO
i. Contract allows for 2%or 6%CPI increase, whichever is greater.
ii. CEPCO asked for 3%
b. HOA dues increased to$155 per unit per quarter
8. Roger Green:Yard has sinkhole due to AT&T drilling into sanitary sewer pipe a while back
however just now showing signs of damage. Will HOA repair his yard?
a. Dale: No. HOA is not responsible for repair of the yard/damaged pipe. Also stated-There
are no common areas from sidewalk to the roadway.Should be a DOT right-of-way. DOT
however will not maintain strip of grass.
