I appreciate you taking the time to explain the issue at hand. As this time, we are renewing permits without inspections or the assumption that the are compliant with the requirements of the stormwater management permit. The post construction state stormwater permits place the responsibility for monitoring the BUA and maintaining the stormwater system with the current permittee. The permit itself requires maintenance to ensure the system will function in its designed condition (Section 11.3 of the SW8080807 permit issued in September 2008). As long as the maintenance work will maintain or restore the SCM and/or features to its permitted condition, the Division does not need to give permission for any maintenance work. I would also suggest keeping records of the maintenance activities in case there is ever any question. The designer certification is also required to be submitted per permit condition Section 11.7. HoweveL this isalso considered a compliance issue which is not stopping renewal processing at this time. Please complete the required maintenance per the conditions of the permit as soon as possible and submit the designer certification. Ms Ashley, I missed you with a phone call on Monday and understand that your office is in the process of moving, so we decided to send an email and follow up with a phone call. 1 Concerning our storm water renewal request for Wrightsboro Baptist Church (SW8 080807), we have the survey of the pond and are double checking the numbers at this time. It appears from the initial design that the storage volume provided for this retention pond was about 3.5 times the minimum volume needed during the construction for our Family Life Center. Question: Is there anyway the storm water permit could be renewed with the understanding that we would have any sediment removed by the next time the process cycles around again, which now sounds like it would be 5 years instead of the normal 8 year cycle? The reasons I am just asking this question is that we just attached to CFPUA sewer two years ago, resurfaced the parking lot last year, and paid off the Family Life Center note in the spring. These were all major undertakings for our Church and we were not anticipating another project of this size this soon. If necessary, I could meet on site to discuss, and can be reached at 910-604-3421. B. Warran . GRANTOR makes the following warranties to the GRANTEE concerning the Existing Facilities: (i) Warranty of Materials and Equipment. GRANTOR warrants to GRANTEE that the Existing Facilities conveyed herein are of good quality and free from faults and defects, and conform to as-built drawings. GRANTOR warrants all such Existing Facilities for a period of one (1) year from the date of recording this Conveyance in the office of the Register of Deeds. (ii.) Warranty of Work. GRANTOR and its assigns warrant to GRANTEE for a period of one(1)year from the date recording this Conveyance in the office of the Register of Deeds that all work performed on the Existing Facilities has been performed in a workmanlike quality and consistent with good construction practice prevailing in North Carolina at the time of construction. (iii.) Covenants by Grantor. GRANTOR, for itself, its heirs, executors, administrato and assigns, does covenant with GRANTEE, its successors and assigns, that it is the owner of those certain sewer utilities located in the DOT right of way at Castle Hayne Road and more particularly shown on the on Exhibit A; that it is seized of the Existing Facilities in fee and has good right to convey the Existing Facilities described herein; that said Property is free and clear from all restrictions, easements or encumbrances, except for encumbrances of record as of the date of this Deed which do not affect the easements granted herein to GRANTEE and the lien of local property taxes; that the Existing Facilities are free and clear from all encumbrances whatsoever; and that it shall, and its heirs, executors, administrators and assigns shall, warrant and defend the title to rights and the Existing Facilities against the lawful claims and demands of any and all persons whomsoever. GRANTOR further covenants that the individuals executing this document on behalf of GRANTOR have all necessary and appropriate authority to bind GRANTOR to the obligations and conveyances granted herein, and, in the event that GRANTOR is a corporation or similar entity, that the execution of this document has been authorized by all appropriate and necessary corporate action.
