The 2012 permit that you mention below was transferred from Mr. Koenig to the HOA. This permit was found in compliance in 2012. It does have some association with SW8 050629, has offsite to Kensington Park and Western Blvd. And it has 196,400sf of future. See attached permit. The idea of the commercial area having its own BMP sounds like it might be a good idea, especially site they often are resold time and time again. It needs to be self-reliant. I have cc'd Linda so she can answer your specific questions since she has looked at all these permits and knows more than I do about them. Discuss your ideas with her and if you still want for all of us to meet we can do so after you get more of your ideas together. Our Client, Mr Schaeffer, purchased all of Mr Koenig s undeveloped property in Williamsburg Plantation here in Jacksonville. I know that Dave Newsom PE was the original engineer for this project, and he had some area maps and permit applications that he sent to me to review. I then went onto the State permit website using the "active and expired stormwater permits tracker" webpage to find this permit.( at bottom of email) It shows that it was modified back in 2012. I don't have any of that information so I don't really know whats going on with the permit. As I previously stated, our client now owns the undeveloped property. Part of that undeveloped property is a commercial tract of land adjacent to Gum Branch road, and according to the stormwater permit information that I have, this tract of land is included in the drainage area for the "Huntington Park at Williamsburg Plantation" stormwater plan. The permits that I have show a Future BUA of around 196,000 SF. This is woefully too low to be of any use for the commercial area. I need to discuss with you our clients options regarding this stormwater permit. Now that we have the EZ-LID toolbox as I call it, I would think that we could permit a new BMP device for the commercial area to handle that developed property before it drains to the Huntington park BMP. That seems the most simple fix, however I think we would need to discuss this before I propose any solution to the new owners. I also suspect that this email doesn't fully explain our situation in enough detail for you to understand what may be going on and what we want to do. I will try and call you Monday morning to see if we can discuss this concern. As always, this is for commercial property and the rush is on to get a solution so they can get the land under contract ( Very Important), we don't have to have plans and permits figured out,just a solution we can work towards so that everybody knows what we must do. SW8 951220/990339/001114/010919/040733/050629/070422 Onslow County Dear Ms. Fowler: I strongly urge you to seek the opinion of an attorney regarding your belief that permeable pavement, constructed within certain lots in Williamsburg Plantation to reduce their net effective BUA amount, would be a BMP and a "common element" and therefore, the maintenance expenses would have to be borne by the Association. An attorney can advise you on the special language needed for an amendment to the deed restrictions which will add the use of permeable pavement, but structure it so that the onus to pay for the maintenance is assigned to each owner that utilizes a permeable pavement on their lot. Under the stormwater permit, the HOA would be responsible for the review of all applications for permeable pavement. The options are for the HOA to maintain it via dues and/or assessments or to put the maintenance responsibility on the lot owners. In the event that the lot owners are not performing the maintenance, then your attorney should also structure the amendment language so that the HOA can perform that maintenance and bill the lot owner, or so that the HOA can assess a special maintenance fee for only those lot owners having permeable pavement in addition to the usual and customary HOA dues, without affecting any other lot owners. I've attached a document containing some language for consideration by your attorney as a basis for the necessary deed restriction amendment, appropriation of maintenance costs, and standards to be added to the Architectural Guidelines. Alternatively, the Division can accept and process permeable pavement applications from the lot owners. However, due to the number of applications that might generate, and given our limited review staff, we would prefer that the permit be modified so that the Association is the reviewer and "approver" of those applications. The permittee shall designate a point of contact to all lot owners wishing to install a permeable pavement on their lot. 2. The necessary rules, requirements and forms for the installation of permeable pavement are available to the permittee.on the Division's website. The permittee shall supply all lot owners, . . wishing to install a permeable pavement on their lot, with the necessary forms or direct such lot owners to the Division's website. 3. The permittee shall review for completeness and accuracy, all such permeable pavement applications within the permitted project, for compliance with the permeable pavement design, inspection and maintenance requirements listed in the latest version of the Best Management Practices Manual. A complete permeable pavement application includes the completed and signed supplement, calculations, a soils report prepared by a NC licensed professional with expertise in soils, and a signed Operation and Maintenance Agreement from each lot owner wishing to install a permeable pavement on their lot. 4. The permittee shall approve or reject each permeable pavement application by checking the appropriate box on the supplement form, signing the form and returning the original to the lot owner. The permittee shall reject all applications for lots that do not meet the minimum soil hydraulic conductivity rate and the minimum water table separation requirements, or which propose a permeable pavement that does not meet the minimum design requirements. 5. The permittee shall keep a copy of all permeable pavement applications on file for the life of the Stormwater Management permit. Permeable Pavement is referred to as a BMP.Therefore,it is grouped into the same category as a Stormwater Pond-a Common Element to the WPHOA.As a common element it would become the responsibility of WPHOA to ensure maintenance and operation tasks are performed and documented as required. This poses a possible issue as it is the duty and fiduciary responsibility of WPHOA to act in the interest of,and benefit of,the WPHOA as a whole (all Members) -not some Members,if . a lot-owner chooses to replace their existing sidewalks and/or driveway with Permeable Pavement,the design,installation,and required future repairs/maintenance and inspections can only be at the expense of the lot-owner- it cannot be at the expense of the WPHOA. We are requesting clarification and assistance from NCDENR with the following: 1. Consideration to have Permeable Pavement not to be identified as a BMP for a residential lot within a fully developed Association with an existing BMP in place, but solely as a means to reduce the Built Upon Area (BUA) for said developed lot. 2. How to assign the responsibility and liability of the required operation, maintenance,inspections and repairs of the Permeable Pavement onto the individual lot-owner within the Stormwater Management Permits and covenants. SW8 951220 / 990339/001114/ 020919 / 040733 / 050629 /070422 Onslow County Dear Mrs. Fowler: Per the meeting on February 13, 2015, the Division is providing this letter in regard to the overbuilding situation which was discovered at Williamsburg Plantation in the wake of the permit transfers from the developer, John Koenig, Inc., to the HOA. Please assure the members of the Homeowners Association that the Division is exploring all of the options available to it to resolve the overbuilding situation. We will make every effort to keep the HOA informed and to work with you. Unfortunately, we cannot provide specific timelines for this process. Per 15A NCAC 02H.1003(h), the Division may take enforcement action against any individual or entity that is found to be in noncompliance with the provisions of a stormwater permit or the stormwater rules. This can include the individual lot owners. In order to remain in compliance with the permit, the HOA cannot approve any new additions to existing lots that will put that lot into further noncompliance. The HOA should consider reviewing applications from individual lot owners that are proposing to reduce their BUA footprint such that compliance with the BUA limit is attained, or allowing the Division to assist in reviews. Among the options the Division is exploring is for the HOA to propose to modify the permit to add permeable pavement as an option for existing developed lots to replace traditional impervious concrete sidewalks and driveways; and as a means for undeveloped lots to stay under the BUA limit. Another option being considered is the ability to increase everyone's BUA limit. This requires that the as-built condition of the ponds be analyzed to determine if there is excess capacity in the design. Yet another option might be to remove some of the pond's extraneous drainage area (such as the right-of-way of a portion of Western Boulevard). Some combination of available options might provide enough capacity to allow for an increase of the per lot BUA allocation with no required physical changes to the pond itself. You may be missing some data, which would explain your confusion. This permit was modified 7/17/2006 — back then modified permits received a new 10-year expiration date, rather than keeping whatever the current expiration date of the permit was. So the modification changed the expiration date to 7/17/2016. Then in 2012, we issued the Ownership Change and include the Permit Extensions (2009-406 & 2010-177) which extended the expiration date four (4) years to 7/17/2020.
