Dear Mr. Koenig:
The Wilmington Regional Office received a complete modified Stormwater Management
Permit Application for Huntington Park at Williamsburg Plantation on July 13 2006. Staff
review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 040733, dated July 17, 2006, for the construction of the project,
Huntington Park at Williamsburg Plantation.
This permit shall be effective from the date of issuance until July 17, 2016, and shall be subject
to the conditions and limitations as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rule's') and
the approved stormwater management plans and specifications and other supporting data
as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until July 17, 2016 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1 . This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.5 on page 3 of this permit. The subdivision is
permitted for 85 lots, each allowed a maximum of 3,480 square feet of built-upon
area.
3. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project will
be recorded showing all such required easements, in accordance with the
approved plans.

II. SCHEDULE OF COMPLIANCE
1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division.
2. The permittee is responsible for verifying that the proposed built-upon area for the
entire lot, including driveways and sidewalks, does not exceed the allowable built-
upon area. Once the lot transfer is complete, the built-upon area may not be
revised without approval from the Division of Water Quality, and responsibility for
meeting the built-upon area limit is transferred to the individual property owner.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition, or sale of all or part of the project area. The
project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit
was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
5. The Director may determine that other revisions to the project should require a
modification to the permit.

6. If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed built-
upon area. Any approvals given by the Board do not relieve the homeowner of the
responsibility to maintain compliance with the permitted BUA limit.
7. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame specified
in the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide
copies of revised plans and certification in writing to the Director that the changes
have been made.
8. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built-upon
surface.
9. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received from
an appropriate designer for the system installed certifying that the permitted facility
has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
11 . If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
12. Permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual.
13. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel. The facility must be in compliance with all permit conditions. Any items
not in compliance must be repaired or replaced to design condition prior to the
transfer. Records of maintenance activities performed to date will be required.
14. The permittee shall at all times provide the operation and maintenance necessary
to assure that all components of the permitted stormwater system function at
optimum efficiency. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the scheduled intervals
including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of structures, orifice, catch basins and piping.
g. Access to all components of the system must be available at all times.
15. Records of maintenance activities must be kept and made available upon request
to authorized personnel of DWQ. The records will indicate the date, activity, name
of person performing the work and what actions were taken.

16. This permit shall become voidable unless the facilities are constructed in
accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
17. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 040733, as issued by
the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
f. The maximum built-upon area per lot is 3,480 square feet. This allotted
amount includes any built-upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line
and the edge of the pavement. Built upon area includes, but is not limited to,
structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking
areas, but does not include raised, open wood decking, or the water surface
of swimming pools.
g. All runoff on the lot must drain into the permitted system. This may be
accomplished through providing roof drain gutters which drain to the street,
grading the lot to drain toward the street, or grading perimeter swales and
directing them into the pond or street. Lots that will naturally drain into the
system are not required to provide these measures.
h. Built-upon area in excess of the permitted amount will require a permit
modification.
18. A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots. The recorded
copy must contain all of the statements in Section 11.17, the signature of the
Permittee, the deed book number and page, and the stamp/signature of the
Register of Deeds.
19. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of
the pond.
C. The falling water from the fountain must be centered in the pond, away from
the shoreline.
d. The maximum horsepower for the fountain's pump is based on the permanent
pool volume.
20. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, coquina and parking areas, but does not include raised, open
wood decking, or the water surface of swimming pools.

III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity except after notice to and
approval by the Director. In the event there is either a desire for the facilities to
change ownership, or there is a name change of the Permittee, a
"Name/Ownership Change Form" must be submitted to the Division of Water
Quality accompanied by appropriate documentation from the parties involved. This
may include, but is not limited to, a deed of trust, recorded deed restrictions,
Designer's Certification and a signed Operation and Maintenance plan. The
project must be in good standing with DWQ. The approval of this request will be
considered on its merits and may or may not be approved.
2. The permittee is responsible for compliance with all of the terms and conditions of
this permit until such time as the Director approves the transfer request.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Permittee grants permission to staff of the DWQ to access the property for the
purposes of inspecting the stormwater facilities during normal business hours.
8. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
9. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of
construction.

8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
11 . The permitted amounts of surface area and/or volume have been provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, a
forebay, and the vegetated filter.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built-upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
SW8 040733 Mod as issued by the Division of Water Quality. These covenants may not be
changed at-deleted without the consent of the:State.

WHEREAS.Owner desires to provide stability and appeal in the development of said
land;
NOW, THEREFORE, Owner hereby covenants and agrees to and with all persons, firms,
and corporations now owning or hereafter acquiring any of the numbered lots included on said
plat, that all of said numbered lots shall be and same now are, to the extent hereinafter defined
and described, subject to the following restrictions as to the use thereof, running with the said
land by whomsoever owned, to-wit:
I. LAND USE AND BUILDING TYPE: No numbered lot shall be used except for
residential purposes. No structure shall be erected,placed, altered or permitted to remain on any
such lot other than one deu,ched single-family dwelling not to exceed two and one-half stories in
height,a private garage for not more than three(3)cars,with a minimum of one (l) car garage
with it parking apron, which garage may contain living quarters for occupancy by domestic
servants or family of the tot owner only, and such other outbuildings as may be reasonably
appurtenant to the dwelling;provided that the same are constructed in line with the general
architectural design and construction standards used in the dwelling itself.
2. DWELLINti COST QUALITY AND SIZE: No single-family attached or
detached dwelling unit shad be permitted on any such lot or lots which shall give to the
improved lot or lots on which the said single-family attached or detached dwelling unit is
constructed an appraised valuation of less than One Hundred Forty Thousand and Noil00
(S140,000.00) Dollars; sucit valuation to be based upon cost levels prevailing at the date these
covenants are recorded; it being the intention and purpose of this covenant to provide that all
dwellings shall be of quality and workmanship substantially the same or better than that which
can be produced on the date these covenants are recorded for the minimum value herein stated
for the minimum permitted dwelling size.
No single-story residence or dwelling unit shall be constructed which shall have a heated
area living space of less th sn 1500 square feet. No two-story residence at dwelling trait shall be
constructed which shall have a heated area living space of less than 1500 square feet of which a
minimum of 800 square feet shall be the first floor of said two-story dwelling. Heated area
living space shall mean the ordinary living space in a house which is designated and constructed
to be capable of being heated for regular living use in cold weather. In the computation of floor
space, furnace room and exterior storage areas,garage and porches shall not be counted. No

3. RgQVISIONaRELATING TO WETLANDS: All of the properties subject to
these declarations,conditions, covenants and restrictions shall also he subject to the following
Special Provisions Relating to Wetlands. In developing the property, the Developer has agreed
with the State of North Caroli•.ta and the Department of the Army Corps of Engineers(pursuant
to a permit issued by the State of North Carolina and the Corps of 4:ngincers)to restrict and
prohibit any future ft)ling or other detrimental activities in the wetlands areas which presently
exist within the identified arch.of the property. Accordingly,all wetlands shown and delineated
on the wetland survey plat dated December 9, 1999,and verified by the Corps of Engineers of
March 4. 2003.shall be maintained in perpetuity in their natural or mitigated condition. No
person or entity shall fill, grade,excavate, or perform any other land disturbing activities; nor
cut, remove, or harm any vegetation; nor construct any structures,nor allow animal grazing or
watering or any other agricultural use on such conservation area. Benign structures, such as pile- -
supported walkways,may be'iermissibic only after reviewed and written consent is provided by
the U.S. Army Corps of Engineers. This covenant is intended to ensure continued compliance
with the mitigation condition of authorizations issued by the United States of America,U.S.
Army Corps of Engineers, Wi Imington District, Action ID 200001 107, and therefore may be
enforced by the United States of America. This covenant is to run with the land,and shall be
binding on the Owner, and all parties claiming under it.
C BUILDING LOCATION: The building line of any dwelling house of the
buildings appurtenant thereto shall not be less than 35 feet from the lot line which the dwelling
house fronts. Interior lot line and side yard set-back requirements shall be as provided in the
City of Jacksonville and/or O..,slow County Subdivision Regulations governing residential
developments. In the event that the regulatory boards for the City of Jacksonville and/or Onslow
County Commissioners at a Inter time adopt a"zero lot line"set back for the development then
that ordinance shall apply to this development. Where a garage or other permitted accessory
building is located within 30 'Ceet of the rear property line, then there shall be a five foot side yard
requirement for the rear 30 feet of the lot. A rear yard set-back requirement of 35 feet shall be
maintained for those lots abutting other properties outside this subdivision.
With respect to corner lots, the building line of any dwelling house or unit of the building
appurtenant thereto shall not be less that 35 feet from the street on which the dwelling house or
unit fronts. The provisions o:-the City of Jacksonville and/or Onslow County Subdivision
Regulations governing residential developments shall be complied with in determining the act
back from the side street property line and the required rear yard, if any.
For the purposes of these covenants, eaves and steps shall not be considered as a party of
the building; provided,bowcmr, that this shall not be construed to permit any portion of a
building to encroach upon another lot. Open fire escapes,outside stairways,the ordinary
projections of chimneys and flues, swimming pools, Flag poles, decorative fountains and other
similar items are not subject)o the building lines so long as the do not obstruct light and
ventilation necessary for the structure on the adjoining lot. A variance no more than 10% of the
sct-back requirements of this covenant shall be deemed to be in compliance with the
requirements stated herein.
5. STORMWA 'ER MANAGEMENT: The following covenants are intended to
ensure ongoing compliance •vith State Stormwater Management Pcrmit Number ,
as issued by the Division of Water Quality under NCAC 2H.1000.
The State of North C:volina is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the stormwater management permit.
These covenants are io run with the land and be binding on all persons and parties
claiming under them.
The covenants pertai.ting to stormwater may not be altered or rescinded without the
express written consent of the State of North Carolina, Division of Water Quality.

,The maximum allowable built-upon area per lot is limited to a maximum of 3,490 square
feet. This allotted amount includes any built-upon area constructed within the lot.property
boundaries, and that portion.of the right-of way between the front lot line and the edge of the
pavement. Built upon area includes,but is not limited to, structures, asphalt,concrete, gravel.
brick, stone, slate, coquina)urd parking areas, but does not include raised-open wood decking, or
the water surface of swimming pools.
All runoff from the built-upon areas on the lot must drain into the permitted system. This
may be accomplished through providing roof drain gutters which drain to the street, grading the
lot to drain toward the street,or grading perimeter swales and directing them into the pond or
street. Lots that will naturally drain into the system are not required to provide these measures.
Swales shall not be filled in, piped,or altered,except as necessary to provide driveway crossings.
G. ERF�CT10N OF FENCES AND IS_GN$: No fence shall be erected on any lot
closer to the front of the lot than the house's rear comer nearest the street. No fence shall be
built within the easement for utilities as set forth in Paragraph 7(a) of these covenants. A
minimum three-foot wide gate must be constructed if the fencing is across the"maintenance
area" described in Paragraph 7(b)hereof. Fencing traversing a lot shall be parallel with the front
line. Provided however, that with respect to corner lots, no fencing shall be erected or
maintained any closer than Eorty-five(45) feet from the front property line, not to exceed a ten-
foot extension from the back corner of the house(extended from the back line of the house);and
in the event a house has already been established on the lot adjacent to the comer lot,no fencing
shall be erected on the corner lot any closer to the front of the lot that the distance the front
comer of the adjacent struct ure is from its front property line; in any event,fencing shall be no
closer than the house's rear comer. Solid privacy fences over three (3) feet in height shall not be
built.within twenty-Five(25) feet of a public right-of-way. Chain link fences of any type are not
permitted.
No fences, includinit decorative split-rail fences,are permitted in the front yard of a lot.
7. EASEMENL-:
(a) For Utilities and Drainage: Easements for installation and maintenance of
utilities and drainage facilities are reserved as shown on the recorded plat, Within these
easements, no structure, planting or other material shall be placed or permitted to remain which
may interfere with the installation and maintenance of utilities, or which may change the
direction or flow or drainage,or which may obstruct or retard the flow of water. All areas
indicated as streets and eas(ments on the recorded plat are hereby dedicated to public use for
such uses forever;
(h) For Repairs and Maintenance: The lot owner having an abutting wall or a
wall within five (5) feet of its lot line shall have a five-foot easement along said lot line on
adjacent lot owner's propetry for the purpose of repairs and maintenance of said abutting wall or
wall within five feet of the lot line where such repairs and maintenance cannot be accomplished
otherwise.
(c) For ()verhan¢s Exlensions and Projections: As to lot owners of adjacent
lots which have an abutting wall,easements are reserved over those portions of the adjacent lot
owner's property that may x necessary or required to accommodate drainage and utilities and
overhanging eaves or other cantilevered construction which may encroach upon the adjacent lot
owner's property or the air and light space above such lot owner's property.
(d) For Underground Cables and/or Installation of Street Liahtina: The
Developer or their Assigns reserves the right to subject the real property in this subdivision to a
contract with Carolina Pomer and Light Company or any other utility company for the
installation of underground electric cables and/or the installation of street lighting,either or both
of which may require an initial payment and/or continuing monthly payment to Carolina Power
and Light Company or any other utility company by the owner of each building. Also the
County of Onslow may leery special tax assessments against cash lot to install street lighting.
9- ILLEGAL t�TIV(L: No illegal, noxious or offensive activity shall be
permitted or tamed on an) party of said land, neither shall anything be permitted or done which

is or may become a nuisance or a source of embarrassment, discomfort or annoyance to the
neighborhood. No trash, garbage, rubbish, debris, waste material or other refuse shall be
deposited or allowed to accumulate or remain on any part of said land, or upon any land or lands
contiguous thereto. No fires c r burning of trash,leaves,clippings or other debris or refuse shall
be permitted on any part of said land without the required permits issued by the appropriate
authority.
9. ARTESIAN W ELLS: No artesian wells may be drilled or maintained on any
building lot without first obtaining the consent of the Developer. The central water supply
system provided for the service of said land shall be used as the sole source of water for all water
spigots and outlets located within all buildings and improvements located on each building lot.
No individual water supply system or well shall be permitted on the building lot except to supply
water for air-conditioning or heating installation, irrigation purposes, swimming pools or other
exterior use. All lots shall be subject to service charges and fees and any and all assessments
levied in coaneelion with the central water supply system service to the respective subject lots.
10. ANIMALS A LIVESTOCK: No animals, livestock or poultry of any kind
shall be raised,bred or kept on the property,except cats,dogs, and other common household pets
and they shall not exceed thrett(3)of each,provided that they are not kept, bred or maintained
for any commercial purposes. Household pets shall not roam freely; they must remain in the
yard or, if not in the yard, on E.leash.
It. AUTOMOBIL'-�.�5,) TC: No automobiles, boats,campers or any other motor
vehicle may be dismantled on said property. No mechanically defective automobile or currently
unlicensed automobile shall be placed or allowed to remain on said property over ten(10)days.
No junked cars shall be placee or allowed to remain on the property. No trailer, mobile home,
camper or like recreational vehicle shall be permitted to remain upon any lot unless it is located
so as not to he visible from anv street or road within the subdivision.
12. O S UCTIO'1N5j: The Developer shall have the right, but not the obligation, to
remove or require the removal of any fence, wall hedge, shrub, bush, tree or other object, natural
or artificial,placed or located on any building plot, if the location of the same will, in the sole
judgment and opinion of the Developer,obstruct the vision of a motorist upon any of the access
ways.
13. REGULATE TRAFFIC: The Developer shall have the right, but not the
obligation, from the time to time to control and regulate all types of traffic on said access ways,
including the right to prohibit use of said access ways by traffic which, in the sole discretion of
the Developer, would or might result in damage to said access ways or pavements or other
improvements thereon, and thy:right,but not the obligation to control and prohibit parking on all
or any part of said access way.;,
14. TYPE OF CONSTRUCTIQN: No building or other improvement may be
constructed with an exterior wall finish of material of concrete or cinder block type construction
or shall be finished in asbestos siding shingles.
15. WINDOW A1F:CONDITIONERS: No window air conditioning units shall be
installed in a building visible liom the road which the building faces.
76. UTILITY: All telephone, electric and other utility lines and connections between
the main utility lines and the residence and other buildings located on each building plot shall be
located underground.
17. UTILI1-Y COMPANY: The Developer reserves the right to subject the real
property in this entire subdivision to a contract with the Carolina power and Light and/or City of
Jacksonville or any other utility company, for the installation ofunderground electric cables
andlor the installation of streer.lighting,either or both,of which may require a continuing
monthly payment from the owner of the lot,
18. TYPE OF RESMENCE: No trailer, basement, garage or any outbuilding of any
kind, other than a guest house or servant's quarters, cven if otherwise permitted hereunder to be
or remain on a building lot, shall be used as a residence either temporarily or permanently.

19. DEVELOPL<F SIGNS: Nothing contained in these covenants and restrictions
shall prevent the Developer, approved Builder,or any person designated by the Developer, from
erecting or maintaining such commercial or display signs and such temporary dwelling, model
house and other structures as the Developer may deem advisable for development purposes.
20. SIGNS: No sign or signs other than a "For Sale"or"For Rent" sign shall be
displayed on the property, and these signs shall not exceed five(5)square feet total area.
21. SWIMMING POOLS: No swimming pool shall be constructed on any lot unless
the proposed location shall have been first approved in writing by the Developer and said pool,
with required fence, shall be built in accordance with all applicable City of Jacksonville and/or
Onslow County Inning Ordinances and Regulations. Above ground Wools are not permitted.
22, MAIL BO7XE 5: No mail box or paper box or other receptacle of any kind for use
in the delivery of mail or newspapers or magazines or similar material shall be erected or
located, on any building lot unless the size, location and design and type of material for said
boxes or receptacles shall have been approved by the Developer. To insure uniformity, the
Builder does hereby agree tc provide the original mail box post if at any future time the post
becomes damaged or has to be replaced for some other reason, it will be replaced with a post of
the same size and material a".the owner's expense.
23. APPROVAL OF PLANS: No construction shall begin on any lot,neither shall
any building or other impro,,ement be erected,placed or altered on any lot until the construction
plans and specifications and plans showing location of the structure on the individual lot have
been approved in writing by the Developer. its successors or assigns. This approval shall be as to
the quality of workmanship and materials.harmony of external design with existing structures,
and as to the location with rrzspeet to topography and finished grade elevation. The Developer
may delegate its duties under this paragraph to an architectural committee created for this
purpose. Such assignment will be by a document recorded in the office of the Register of Deeds
for Onslow County,North Carolina.
24. RADIO OR F-EL.EVISION AERIALS: Except as provided below, no radio or
television aerial,antenna or satellite dish, or any other exterior electronic or electronic equipment
or devices of any kind shall be installed or maintained on the exterior of any structure located n a
building lot or any other portion of any building lot. A satellite dish,no greater than eighteen
(18) inches in diameter maybe installed, as long as it is not visible from the street.
25. AMLITIDM£NT OF COVENANTS: These covenants are to run with the land and
shall be binding on all parti,ss and all persons claiming under them for a period of twentyfrve
(25) years from the date these covenants are recorded, after which time said covenants shall be
automatically extended for:successive periods of ten (10)years unless an instrument signed by a
majority of the then owners of the lots has been recorded,agreeing to change said covenants in
whole or in part. During the first rwenty-five(25)year period, these covenants may be amended
in full or in pan by an amer dment, signed by not less than eighty (80%)percent of the owners of
the numbered lots. To be e,Fective, any amendment must be recorded. However,the covenants
in contained in Paragraph 3 hereinabove are in perpetuity and may not be amended without the
express consent of the State of North Carolina and the Department of the Army Corps of
Engineers.
26. ENFORCEI`PENT: Enforcement shall be by proceedings al law or inequity
against any person or perso is violating or attempting to violate any covenant either to restrain
violation or recover damages. The Developer Df Williamsburg Plantation Homeowner's
Association, or any lot owner, shall have the right to enforce,by any proceeding at law or in
equity,all restrictions,cone itions, reservations, liens and charges now or hereafter imposed by

Back in January, 2006, I emailed Dave Newsom regarding this project and
requested some information from him that I have not yet recieved. Dave may
not have known the status of this.
Before I issue the permits for Huntington Park and Kensington Park, I need
to know if any lots have been sold in Huntington Park. If lots have been
sold, I must require that you submit a copy of the RECORDED deed
restrictions for Huntington Park before I can issue the modified permit. If you
recall, the modification was necessary to accommodate the offsite
drainage from Kensington Park.
I am prepared to issue both permits upon the timely receipt of this
information.

The Division received this modified application on April 12, 2007. You don't really
need to modify this application since the permit already included 196,400 sq. ft.
for future development. Since only 152,616 sq. ft. of that amount is being used,
there will be 43, 784 leftover for additional future development or as a contingency
amount . I will write a plan revision to cover this change. I will send Mr. xQa*iig
his money back for the unnecessary 040733 Mod. PI-mg—
In regards to the application for Kensington Park II, I moved the "Offsite"
supplement that you had submitted with 040733 to the Kensington Park II
application, where it belongs. Additionally, please redo the drainage area map and
clearly label the new onsite pond and delineate its drainage area, label the
offsite pond under 040733, label Kensington Park II and clearly delineate the area
of Kensington Park II that is draining to the offsite pond.

I 'd like to know if any lots are being built on or have been sold in Huntington
Park. I have a copy of the previously approved deed restrictions from 2004, before
the original permit was issued. However, for the modification to accommodate
Kensington Park, I need to know if any of the Huntington Park lots are sold in
order to know if I should be requesting a copy of the recorded deed restrictions
before issuing the permit.

Complaint by Ms.Ramero & Ms. Armstrong, regarding the pocket of wetlands
behind their houses. Every time it rains, their back yards flood.
Met onsite on .lanuary 4, 2007 with Ms. Ramero, Ms. Armstrong and with Mr.
Fowler(representative for developer).
A shallow Swale and possible berm were proposed to divert water from wetlands
into the road-side curb and gutter.
This is not really a stormwater issue, mostly a flood and county issue.

The developer is currently in the process of constructing Huntington Park, an eighty seven
(87) lot residential subdivision on a 36.04 acre tract located in the Williamsburg Plantation
Development in Jacksonville, N.C.. This project was permitted in April of 2005 under SW8
040733. This "high density" project includes a Wet Detention basin to provide treatment of
stormwater.
The developer now proposes to construct Kensington Park, a thirty four (34) lot residential
subdivision on a 10.15 acre tract located immediately to the north and west of the
Huntington Park subdivision.
The project area is tributary to New River (C:NSW) in the White Oak Basin. The proposed
development activities are high density (BUA=42.33%).
A portion (Lots 15 — 34 & all streets) of the Kensington Park subdivision is located within the
drainage area of the existing Huntington Park pond. Therefore, stormwater emanating from
this portion will be diverted to the existing Huntington Park Pond. The pond must be
enlarged to accommodate the additional impervious surfaces.
The remainder of the Kensington Park subdivision (Lots 1-14) is not tributary to the existing
pond. Therefore, a new Wet Detention Basin is proposed to provide treatment from
stormwater emanating from this portion.

The Wilmington Regional Office received previously requested information regarding the
Stormwater Management Permit Modification for Huntington Park on August 22, 2005. A
preliminary review of that information has determined that the application is not complete.
The following information is needed to continue the stormwater review:
1. Please revise Section 111.6 on page 2 of the application so that the total
proposed built-upon area matches up to what is provided for in the
calculations, i.e., 912,694 square feet. The application only shows a total
proposed BUA of 900,108 square feet. Please include the 12,586 square feet
of existing street impervious area in the proposed total since that BUA will
remain as part of the BUA total draining to the pond. "Proposed" is a
misleading term in that even though 12,586 square feet of the total BUA
draining to the pond is existing, it is "proposed" to drain to the pond.
2. The required proposed deed restrictions have not yet been submitted, as was
previously requested.
Please note that this request for additional information is the result of a preliminary review.
The information submitted in response to this letter will be reviewed within 90 days of
receipt, and if it is determined to be incomplete or if it generates more questions, more
information will be required. The currently requested information should be received in this
Office prior to November 20, 2005, or the application will be returned as incomplete. The
return of a project will necessitate resubmittal of all required items, including the application
fee. The Division is allowed 90 days from the receipt of a completed application to
issue the permit.
If you need additional time to submit the information, please mail or fax your request for a
time extension to the Division at the address and fax number at the bottom of this letter.
The request must indicate the date by which you expect to submit the required information.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is
subject to enforcement action pursuant to NCGS 143-215.6A.

Application for Huntington Park @Williamsburg Plantation on June 15, 2005. A preliminary
review of that information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
1. Please add the nearest intersection of two major roads to the vicinity map. A major
road is any 1 , 2 or 3 digit NC, US or interstate highway.
2. Please provide a copy of the recorded deed restrictions per the requirements of the
original permit for Huntington Park to include the BUA per lot limitation of 3,480 for
the 85 lots.
3. The built-upon area listed in Section 111.6 of the application does not match up with
what is reported on the supplement and what is used in the calculations. Please
revise the application such that the numbers match up.
4. Please add the 226,725 square feet of "Future" BUA to the application.
5. Please dimension the permanent pool contour.
