All previous references to DWO will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that any updated pages or addendums to this permit will now reference DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal Application for Regency Park Section 1 at Williamsburg Plantation on January 26, 2015. The Division is hereby notifying you that permit SWS 001114 has been renewed on March 30, 2015, and shall be effective until March 27, 2023. The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and conditions of this state stormwater permit. The plans previously approved on March 27, 2001, will remain in full force and effect in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995. Please attach this cover letter and permit addendum to your High Density Permit issued on March 27, 2001 and transferred on September 19, 2012. This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. . If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their website at www.NCOAH.com. Unless such demands are made this permit shall be final and binding. If you have any questions, need additional copies of the permit or approved plans, please contact Christine Hall with the Division of Energy, Mineral and Land Resources in the Wilmington Regional Office at (910) 796-7215. It is not too late to add permeable pavement to the application. I believe you would need to check the box on the renewal form marked a"€mBAC , renewal plus modification. I dons€'"t think a new SWU-101 application form is required because nothing about the numbers themselves will be changing. Christine said that the renewal application is third in her review line, so you will need to submit the following items quickly: 1. Soils information, 2. Who will be responsible for maintaining the permeable pavement? If the HOA will do the maintenance, then we will need a signed O&M document from the HOA. If the HOA is going to pass on the maintenance responsibility to the lot owners and just monitor the lots to assure that the maintenance is getting done, then we need to know that, too. 3. A proposed amendment to the deed restrictions to add the maintenance responsibilities, and to describe the entity and process that each lot will apply to for the use of permeable pavement. We have some draft statements that you can use. If you cans€'"'t submit quickly, then you could request that the renewal be delayed, or the renewal could be issued and the modification to add permeable pavement could come later. Other than that, please talk to Christine about any other comments, suggestions or information she might have. SW8 951220/990339/001114/010919/040733/050629/070422 Onslow County Dear Ms. Fowler: I strongly urge you to seek the opinion of an attorney regarding your belief that permeable pavement, constructed within certain lots in Williamsburg Plantation to reduce their net effective BUA amount, would be a BMP and a "common element" and therefore, the maintenance expenses would have to be borne by the Association. An attorney can advise you on the special language needed for an amendment to the deed restrictions which will add the use of permeable pavement, but structure it so that the onus to pay for the maintenance is assigned to each owner that utilizes a permeable pavement on their lot. Under the stormwater permit, the HOA would be responsible for the review of all applications for permeable pavement. The options are for the HOA to maintain it via dues and/or assessments or to put the maintenance responsibility on the lot owners. In the event that the lot owners are not performing the maintenance, then your attorney should also structure the amendment language so that the HOA can perform that maintenance and bill the lot owner, or so that the HOA can assess a special maintenance fee for only those lot owners having permeable pavement in addition to the usual and customary HOA dues, without affecting any other lot owners. I've attached'a document containing some language for consideration by your attorney as a basis for the necessary deed restriction amendment, appropriation of maintenance costs, and standards to be added to the Architectural Guidelines. Alternatively, the Division can accept and process permeable pavement applications from the lot owners. However, due to the number of applications that might generate, and given our limited review staff, we would prefer that the permit be modified so that the Association is the reviewer and "approver" of those applications. However, after reviewing Chapter 18 of the Best Management Practice (BMP) Manual detailing Permeable Pavement, this may not be a viable option for WPHOA. Permeable Pavement is referred to as a BMP.Therefore, it is grouped into the same category as a Stormwater Pond-a Common Element to the WPHOA.As a common element it would become the responsibility of WPHOA to ensure maintenance and operation tasks are performed and documented as required. This poses a possible issue as it is the duty and fiduciary responsibility of WPHOA to act in the interest of,and benefit of,the WPHOA as a whole (all Members) -not some Members. If a lot-owner chooses to replace their existing sidewalks and/or driveway with Permeable Pavement, the design, installation, and required future repairs/maintenance and inspections can only be at the expense of the lot-owner- it cannot be at the expense of the WPHOA. We are requesting clarification and assistance from NCDENR with the following: 1. Consideration to have Permeable Pavement not to be identified as a BMP for a residential lot within a fully developed Association with an existing BMP in place, but solely as a means to reduce the Built Upon Area (BUA) for said developed lot. 2. How to assign the responsibility and liability of the required operation, maintenance, inspections and repairs of the Permeable Pavement onto the individual lot-owner within the Stormwater Management Permits and covenants. We thank you for your assistance in this matter. SW8 951 220 / 990339/ 0011114 020919 1040733 1050629 / 070422 Onslow County Dear Mrs. Fowler: Per the meeting on February 13, 2015, the Division is providing this letter in regard to the overbuilding situation which was discovered at Williamsburg Plantation in the wake of the permit transfers from the developer, John Koenig, Inc., to the HOA. Please assure the members of the Homeowners Association that the Division is exploring all of the options available to it to resolve the overbuilding situation. We will make every effort to keep the HOA informed and to work with you. Unfortunately, we cannot provide specific timelines for this process. Per 15A NCAC 02H.1003(h), the Division may take enforcement action against any individual or entity that is found to be in noncompliance with the provisions of a stormwater permit or the stormwater rules. This can include the individual lot owners. In order to remain in compliance with the permit, the HOA cannot approve any new additions to existing lots that will put that lot into further noncompliance. The HOA should consider reviewing applications from individual lot owners that are proposing to reduce their BUA footprint such that compliance with the BUA limit is attained, or allowing the Division to assist in reviews. Among the options the Division is exploring is for the HOA to propose to modify the permit to add permeable pavement as an option for existing developed lots to replace traditional impervious concrete sidewalks and driveways; and as a means for undeveloped lots to stay under the BUA limit. Another option being considered is the ability to increase everyone's BUA limit. This requires that the as-built condition of the ponds be analyzed to determine if there is excess capacity in the design. Yet another option might be to remove some of the pond's extraneous drainage area (such as the right-of-way of a portion of Western Boulevard). Some combination of available options might provide enough capacity to allow for an increase of the per lot BUA allocation with no required physical changes to.the pond itself. The 30% limitation is for Hyde Park Section I, which appears to be an overall low density project with an area of high density. Low density means the entire project is limited to a certain percent of BUA (30% in this case). I haven't looked through the file for Regency Park Phase 1, but I did go through the permit and did not see the same limitation written into that permit. Regency Park Phase 1 seems to be a full high density permit, which means the total amount of BUA allowed is limited by how much the pond can treat and by the deed restrictions. The built upon area for each lot is based on the impervious surfaces located within the lot. Per Section 11.15.a of the permit, the BUA allocated for each lot: "includes any built-upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the water surface ofswimming pools. Thank you for the email and the phone call. I wanted to discuss the right way of moving forward with the least delay (I've already paid for plans/trusses and building permits). I also wanted you to have the specifics vice an arbitrary discussion without specific details in your hand. We have had several discussions with people that gave me the indication that there might be an alternative way to get this completed without going through DENR? Specifically, number 3. Is there any validity to these numbers, less than 30% BUA would actually be 5227 sf, if so could I get approval through the HOA...? I'm trying to avoid the 45 day delay. I'll try to call you right now if you're available. Which is it. 1. Is it the footprint of the house? 2. Is it built upon surface as in our covenants? or 3. Is it 30 percent of the lot per denr regs? For arguments sake lets go with 3. 1 Nelson, Christine V From: Nelson, Christine ' I I Sent: Monday, January 06, 2014 4:39 PM To: 'Mclellan, Archibald M Col USSOCOM MARSOC MSOSG' Cc: kevin o'connor(njarhead@yahoo.com); 'Pam McLellan' Subject: RE: REQUEST ASSISTANCE GcS G-icl,l Arch, I'm guessing your lot is withi Hyde Park Section Hyde Park Section 1 is permitted under permit no. SW8 990339 and alloca es each lot either 3,000 or 1,500 square feet. The lot owner may not exceed the amount of built upon area allocated to a lot without the permittee submitting a change to the permit to the Division for approval. Off the top of my head, here are a few of the options available: 1. removing other built upon area on the lot (e.g using concrete strips instead of a full driveway) or converting impervious areas to a pervious surface (like open slatted decking) to ensure the maximum 3,000 sq ft is not exceeded. 2. finding a donor lot(s) that has not reached the maximum allocation of BUA and work with them to "donate" their extra BUA to you. 3. work with the permittee to modify the permit to allow permeable pavement or rain barrels or cisterns and use them to offset the additional BUA 4. have an engineer re-visit the design of the BMP(s) to see if there is extra room available in the pond for additional BUA 5. have an engineer design a another BMP If you think option 2 be a good option for you, please let me know and I can pass that form and instructions along in a few days. The instructions were a bit outdated and I have passed a revised version up the chain for review. For options 3-5, an engineer or other design professional must demonstrate that the minimum design requirements for the selected BMP are met. Your e-mail is not very clear regarding how much built upon area is currently present on your property. If you are planning on exceeding the limit set for your lot, please work with the permittee, Williamsburg Plantation Home Owners Association and possibly your engineer to put together either a plan revision or permit modification to submit to the Division for approval. I've attached my Building Permit with the Storm Water Retention Plan (if necessary), my Lot Plot for 202 Newport, and my Engineered plans. I've got approval from the Williamsburg HOA contingent on approval from DENR. I'm up against the 3000 sqft BUA (Built Upon Area) part of our conveyance. If I build on Covered Patio (20x28) do I need to request a mod to the development/lot permit? I'd like to follow this up with a phone call if you are available this afternoon?
