Effective August 1,2013 the Post-Construction Stormwater Management Program has been transferred from the Division of Water Quality("DWQ")to the Division of Energy,Mineral and Land Resources("DEMLR"). All previous references to DWQ will.remain in older permits issued prior to August 1, 2013 until they are modified. Please note that this permit will now reference DEMLR as the Division responsible for enforcement of the permit. On August 5,2009,the Governor signed Session Law 2009-406.This law impacted any development approval issued;by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at point between January 1,2008,and December 31,2010. The law.extended the effective period of any permit that was set to expire during this time frame to three(3)years from its current expiration date. On August 2,2010,the Governor signed Session Law 2010-177,which granted an extra year for a total of four(4)years extension. The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources received.a complete Permit Transfer Application on August24.2021 requesting to transfer ownership of the subject permit under the provisions of 15A NCAC 02H.1045(I)(c)and N.C.G.S. 143-214.7(c5). Staff has inspected the project, reviewed the available documentation, and confirmed that the requirements of N.C.G.S. 143-214.7(c5)have been met, including: 1. The successor-owner of the property has submitted a written request for the transfer of the.permit. Reference is made to the attached signed Permit Transfer Application form; 2. The original permit holder,Boggs Paving,Inc.,was lawfully and finally divested of title to the property on which the permitted activity is occurring. 3. The successor-owner holds title to the property on which the permitted activity is occurring. Reference is made to the deed recorded on 11/8/2013 in DB B3473 PG P0335 with Brunswick County. 4. The successor owner has not proposed any substantial changes to the permitted activity. 5. The updated permit does not impose new or different terms of stormwater control. By signing the Permit Transfer Application and the Operation and Maintenance Agreement and providing the schedule of compliance to correction of the deficiencies outlined in the inspection report, you have accepted the responsibility for complying with the terms and conditions outlined in this permit. Since the requirements of N.C.G.S. 143-214.7(c5)have been met, permit SW8 000329 has been transferred, updated, and re-issued on November 19, 2021,as attached. This permit remains effective until October 13,2024,which includes all available extensions, and does not supersede any other agency permit that may be required. The.project shall be subject to the conditions and limitations as specified therein, which includes a condition to bring this project into compliance as described in-Attachment D. This permit does not impose new or increased stormwater control requirements or design standards; it clarifies the rules and requirements of this program to provide you with a better understanding of your obligations under this permit. Failure to comply with these requirements will result in future compliance problems. The compliance inspection by the Division of Energy, Mineral, and Land Resources (DEMLR) on November 9, 2021 identified that the following non-compliant items. As the incoming permittee, I understand that I will be transferred a non-compliant permit, and 1 agree to resolve these items to bring the project into compliance by (Permittee to Insert Date) 1. The BUA is not graded so that runoff can drain to the stormwater system, especially for Pond 92, which is almost entirely isolated from receiving runoff due to the large piles of asphalt debris, which are considered impervious. These piles cover the proposed swales and block the flow of water from getting to the pond. For pond 41, the Swale on the west side of the pond is missing and it appears that runoff can enter the discharge side of the pond, which is short-circuiting. The runoff must enter the forebay side first. 2. Drainage area is not stabilized. So, large amounts of sediment can enter the ponds. Therefore, the ponds need to be mucked out to restore them to design conditions, as shown on the plan. 3. Stormwater ponds do not have dimensions which match the plans. Ponds must be re- graded as necessary to meet the design conditions shown on the approved plan. 4. Grassed swales are not installed per the plans. These will need to be restored to design conditions to match the approved plan. 5. Vegetated debris needs to be removed from trash rack on Pond 41. 6. Trash rack needs to be repaired on Pond 42. 7. The pond slopes show erosive gullies, especially on Pond #2. These must be repaired. All pond slopes and grassed swales must be stabilized with grass. The BUA is not graded so that runoff can drain to the stormwater system, especially for Pond #2, which is almost entirely isolated from receiving runoff due to the large piles of asphalt debris, which are considered impervious. These piles cover the proposed swales and block the flow of water from getting to the pond. For pond #1, the swale on the west side of the pond is missing and it appears that runoff can enter the discharge side of the pond, which is short-circuiting. The runoff must enter the forebay side first. 2. Drainage area is not stabilized thus large amounts of sediment have entered the ponds. Therefore, both ponds need to be mucked out to restore them to design conditions, as shown on the plan. 3. Stormwater ponds do not have dimensions which match the plans. Ponds must be re-graded as necessary to meet the design conditions shown on the approved plan. 4. Grassed swales are not installed per the plans. These will need to be restored to design conditions to match the approved plan. 5. Vegetated debris has accumulated on the trash rack of Pond #1. 6. Trash rack was severely damaged on Pond #2. 7. The pond slopes show erosive gullies, especially on Pond #2. The following actions need to be taken to bring this project into compliance: 1. For Pond 1, please re-grade the west side swale so that it matches the approved plan. For pond 2, which is isolated from receiving runoff, the swales must be constructed in accordance with the plans or an alternative plan proposed. 2. Both ponds need to be mucked out to restore them to design conditions, as shown on the plan. 3. Ponds must be re-graded as necessary to meet the design conditions shown on the approved plan. 4. The grass swales will need to be restored to design conditions to match the approved plan. 5. Vegetated debris needs to be removed from trash rack on Pond #1. 6. Trash rack needs to be repaired on Pond #2. 7. Slopes on both ponds, and all grassed swales must be stabilized with grass per seeding specifications. page 2 Permit: SW8000329 Owner-Project: Boggs Paving Inc Inspection Date: 11/09/2021 Inspection Type Transfer Renewal Reason for Visit: Other File Review Yes No NA NE Is the permit active? ® ❑ ❑ ❑ Signed copy of the Engineer's certification is in the file? ® ❑ ❑ ❑ Signed copy of the Operation & Maintenance Agreement is in the file? ® ❑ ❑ ❑ Copy of the recorded deed restrictions is in the file? ❑ ❑ ■ ❑ Comment: Built Upon Area Yes No NA NE Is the site BUA constructed as per the permit and approval plans?
