David Brown with my office will be contacting you to obtain calculations and other permit documents that we may need to conduct this review and if necessary re-permitting. Sullins Dee Freeman Governor Director Secretary November 24, 2009 Mr. Scott Sullivan, Chairman of the Board of Directors Louise Wells Cameron Art Museum 3201 S. 17" St. Wilmington, NC 28412 Subject: NOTICE OF INSPECTION Louise Wells Cameron Art Museum Permit No. Sill 000226 New Hanover County Dear Mr. Sullivan: On November 16, 2009, Christine Nelson of the Wilmington Regional Office of the Division of Water Quality (DWQ) inspected the Louise Wells Cameron Art Museum in New Hanover County to determine compliance with Stormwater Management Permit Number SW8 000226 issued on March 17, 2000 and renewed on September 21, 2009. DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Additional drainage area: A portion of the newly constructed Museum Drive appears to drain toward the collection system for the pond, which increases the drainage area of the pond. 2. Additional built-upon area (BUA) not identified on the approved plans: A portion of the roadway and multi-use trail associated with the newly constructed Museum Drive appears to be contributing runoff to the curb inlets connected to the pond stormwater collection system. An additional parking space appears to have been added to the delivery area. An unpermitted sidewalk, which appears to drain to the stormwater collection system for the pond, was added to the eastern side of the permitted access road. A gravel walkway, which is considered to be BUA, was added around the pond. Unless it is demonstrated that the wood structure with recycled gloves is pervious, this structure must be considered as BUA. It appears that the future BUA (6,400 sq ft) was constructed without an approved modification to the stormwater permit. 3. BUA not constructed (for purposes of determining if BUA has exceeded the permitted allocation): two rows of gravel parking in the main parking area. 4. The forebay berm could not be located. The water elevation in the pond was high, preventing many of the pond features from being inspected. 5. The water elevation in the pond was high and the pond did not appear to be draining indicating that the orifice may be clogged. To bring this system into compliance, the following must be completed: 1: Demonstrate that the drainage area and BUA associated with the pond have not increased from the originally approved permit. If either the drainage area or BUA has increased, the permit must be modified and the BMP design will need to be re-evaluated. Please note that the sidewalk to the east of the access road has been permitted to removed and replaced under the 17th Street Museum Multi Use Path Permit (SW8 080904). Under this permit, it appears that the proposed multi-use path will drain away from the pond collection system. However, until the BUA associated with the existing, unpermitted sidewalk is removed, it still needs to be included as BUA within the drainage area. 2. Ensure the forebay berm is present and built according to the plans. 3. Clean the outlet device to allow the water elevation to return to the permitted level. Ensure that the relative pond elevations are consistent with the permit and approved plans. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 000226, issued to you on March 17, 2003. The project has been found in violation of Stormwater Permit Number SW8 000226 , issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: 1. Section 11.3- The permittee shall at all times provide the operation and maintenance necessary to assure the permitted system functions at optimum efficiency. The outlet structure had a lot of debris stuck in the grated sides, and the orifice appeared to be clogged. The pond itself appears to have accumulated some sediment. The forebay berm was not visible. It is supposed to be higher on the side closest to the outlet to prevent short-circuiting. It's been 2 weeks since the hurricane, and we've had approximately '/2 " of rain in the past 7 days, but the pond level was still at the 1" design overflow elevation. 2. Section 11.7-Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the type of system installed, certifying that the permitted system has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. The required Designer's Certification has not been submitted. 3. Section 11.15- The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. On August 5, 2003, the Division sent a letter to you at the address listed on the permit, 114 Orange Street in Wilmington. The letter requested that you submit the required Designer's Certification. No response to that letter was ever received. You are required to notify the Division of any changes in your mailing address. Provide a written "Plan of Action" which outlines the actions you will take to correct the violations and a time frame for completion of those actions, on or before October 28, 2005. 2. Clean off the outside grates on the outlet structure, remove the debris accumulated in the pond, and unclog the orifice.) 3. Submit the required Designer's Certification. 4. Verify your correct mailing address and phone number. Staff spoke to Mr. Johnny McCoy regarding the use of fountains in wet detention ponds. At the time this permit was issued, there was no guidance for allowing fountains. However, since that time, guidance has been developed. The maximum allowable horsepower of the pump that operates the fountain is based on the permanent pool volume in the pond. This pond was permitted with a permanent pool volume of 38,900 cubic feet. According to the guidance, the pump that operates the fountain is limited to a maximum of 1/8 horsepower. In addition, several other requirements apply, as indicated on the enclosed sheet. I noticed several colorful decorative floating objects in the pond during my inspection. If these are fountains, please do not operate more than 1 fountain at a time in the pond, and make sure the fountain complies with the guidance in regard to the pump size, its physical location in the pond, and the location of any tubing for drawing the water up into the fountain. Failure to provide the "Plan of Action" by October 28, 2005, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A. By copy of this letter to the New Hanover County Building Inspector, this Office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved. Vegetated slopes are no steeper than 3:1. 9. The inlets are located per the approved plans and do not cause short- circuiting of the system. 10. The permitted amounts of surface area and/or volume have been provided. 11. Required drawdown devices are correctly sized per the approved plans. 12. All required design depths are provided. 13. All required parts of the system are provided, such as a vegetated shelf, and a forebay. 14. In general, the models indicated that certain benefits can be derived from the correct size and placement of a fountain, namely, increased dissolved oxygen levels, increased flocculation of certain pollutants, denitrification, and the discouragement of mosquito breeding. The use of fountains is allowed under the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. (See the chart below). As an example, if the pond's volume is 350,000 cubic feet, the maximum pump horsepower for the fountain is 1. For ponds with less than 30,000 cubic feet, use 1/8 HP. MIN.
